HomeMy Public PortalAboutOrd. 0659ORDINANCE NO'. 659 AN ORDINANCE OF THE CITY OF LYNWOOD, CA FINDING AND DETERMINING THAT THE PUBLIC AND NECESSITY REQUIRE, AND ORDERING THE TION FOR VEHICLE PARKING DISTRICT N0. 1 CITY AND ESTABLISHING THE BOUNDARIES OF DISTRICT, ~IFORNIA, INTEREST ACQUISI- OF SAID SAID WHEREAS, proceedings have been duly taken and. a hearing duly held pursuant to notice duly given under the Special Assessment Investigation, Limitation and. Majority Protest Act of 1931, and. no written protest was filed by the owners of one-half of the area. to be assessed for the proposed. acquisition, and. this City Council by resolution duly adopted, determined that the public convenience, interest, and necessity require the acquisition substantially as set forth in the report.on file in the office of the City Clerk, and that said project is feasible, and WHEREAS, on February.21, 1956, pursuant to the provisions of the Vehicle Parking District Act of 1943, as amended, this Council duly adopted. Ordinance No. 642 of said. city d.eelaring the intention of this Council to form said. district and to acquire the lands pro- posed in petition .on file in the office of the City Clerk, and. fixing April 3, 1956 at 8 orclock p.m. in the Council Chambers of this Coundil, as the time and place for the hearing of protests and. objections, and WHEREAS, said. Ordinance No. 642 was duly published., posted., and mailed. as provided by said. Act, and. said hearing was duly held at the time and. place so fixed, and. all interested. persons were given a full opportunity to be heard, and WHEREAS, at said hearing there were no protests or objections, either written or oral, to any of the things proposed ,to be done, and said hearing has been duly concluded., and WHEREAS, this City Council has determined. that written objections or protests to the thing or things proposed. to be done as co+ Pnv,+h „-, ooiA n,-,A 4,., ~. ,..., .. nr.. G1~-~ v... ., ., .__.~ ti____ ._.__,_ ,_ . land. included. within the proposed. district and. subject to assessment, and. has further determined that there has been no majority protest within the meaning of Section 2930 of the Streets and Highways Code of the State of California, and WHEREAS, this City Council has acquired in fee simply? by private purchase all of the real property except: That portion of Lot 463 of Tract 2551 as shown on map recorded. in Book 24, Pages 78, 79, and 80 of Maps, records of the County Recorder of Los Angeles County, described as follows: Lot commencing North 27° 42r East 64.32 feet from the most Southeast corner of said Lot 463, said point being the true point of beginning; thence North 14° 24t West 74.58 feet more or less to the northwesterly line of said Lot 463; thence along said. northwesterly line North 27° 42r East 30.34 feet more or less to the most northerly corner of the southwesterly 150 feet of said Lot 463; thence northeasterly in a direct line to a point in the Easterly line of said. Lot 463 dis- tant thereon North 14° 24'~ West 37.00 feet from the most easterly corner of said. Lot 463; thence along the easterly line of said Lot 463 South 14° 24~' East to the most easterly corner of said. Lot 463; thence southerly along the southeasterly line of said. Lot 463 South 27° 42'~ West 97.36 feet more or less to the point of beginning. NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Lynwood as follows: Section l: That the City Council fixes and. determines that the public interest and. necessity require the acquisition described. in said Ordinance No. 642; that inasmuch as all of the real property described in said Ordinance No. 642 except that portion hereabove described. has already been acquired. in fee simply by private purchase, the City Council hereby orders the acquisition of that portion of said. real property not already acquired., which real property is hereinabove described. Section 2: .That the boundary of Vehicle.Parking District No. 1 of the City of Lynwood. is hereby fixed. and. determined. as follows: Beginning at the northeast corner of T,ot 394 of mract the-northwest corner of said. last mentioned. lot; thence southerly to the southwest corner of Lot 334 of said Tract No. 2551; thence easterly to the south- east corner of said Lot 334; thence southerly to the northeast corner of Lot 337 of said. last mentioned. tract; thence westerly along the northerly line of said. Lot 337, 50.00 feet; thence southerly in a direct line to a point on the southerly line of Lot 340 of said. last mentioned tract, distant thereon 50.00 feet westerly from the southeast corner of said. lot; thence southerly. to the northwest corner of Lot 402 of said Tract No. 2551; thence southerly to the southwest corher of said. last mentioned. lot; thence southeasterly to the most northerly corner of Lot 462 of said Tract No. 2551, said point being on the westerly line of the first alley westerly of Long Beach Boulevard; thence southerly along said last described. line to the north- westerly line of Fernwood. Avenue (40 feet wid.e); thence southeasterly along said. last described. line to the westerly line of Long Beach Boulevard.; thence northerly along said. last d.eseribed. line to the point of beginning. Providing, however, that no lands within the parking district owned. by the United States, and no streets, alleys, or highways therein, and no property to be acquire d. for parking places in this proceeding shall be assessed. to pay. the cost and expenses of the action herein ordered., and. any road or parcel of land in any other public use belonging to the State or to any county,.city, district or to a public corporation, in use for the performance of a public function and_ lying within the exterior boundary of the parking d.istriet as above d.eseribed., is not included in said. district. Section 3: That this City Council hereby declares that a Vehicle Parking District as above described. and designated and numbered as Vehicle .Parking District No. 1 of the .City of Lynwood. has been duly formed. under the provisions of the Vehiele,Parking District Act of 1943, as amended.. Section 4: That the City Attorney of the City of Lynwood. is hereby directed to bring an action in the Superior Court of the State of California. in and. for the County of Los Angeles, in the name of the City of Lynwood for the condemnation of the property necessary Section 6: .That the City Clerk shall certify to the adoption of this ordinance and shall cause this ordinance to be published. once in the Lynwood. Press, a newspaper published. in the :City of Lynwood. Section 7: This ordinance shall take effect upon the lapse of thirty days from the time of its final passage. First read: at a regular meeting of the City Council of said City held. on the 2nd day of January, 1957, and finally adopted. and ordered. published at a regular meeting of said.
