HomeMy Public PortalAbout1997/12/11 The Agenda Meeting of the Mayor and Council of the Borough of Carteret preceding the Regular Meeting December 18, 1997 was held on December 11, 1997, 7:00 P.M., Municipal CourtlPolice Facility, 230 Roosevelt Avenue, Carteret, New Jersey. The following were noted present: Councilmember Bialowarczuk " DuPont " Fazekas " Gutowski Noted absent were Mayor Sica, Councilmembers Failace, Feingold and Borough Attorney Craig Coughlin. Statement of Meeting Notice mailed to the Home News Tribune, The Star Ledger and posted on the bulletin board on December 5, 1997. Richard Potter rrom Potter Architects addressed the Governing Body. He said he would like to give a brief update for where the project currently stood and the buildings involved in the proposed complex. He said he had the drawings checked out by their engineering firm to establish the stability of the structures. He said a report was submitted to the Council in writing on that. He said the conceptual drawings have been completed and he presented to the Council the completed drawings for the Community Recreation/Senior Library Center. He requested the Council review the conceptual drawings and respond back to him. He wants to receive bids by the second week in February and award the contract by March 1, 1997. He said this would give the contractor two months to strictly do interior work and then start on the exterior in May. Tom Potter from Potter Architects addressed the Governing Body. He gave a quick review on the sight plans and the conceptual drawings. He went into detail, described the dimensions of the buildings involved and parking availability. Councilmember Gutowski asked Richard Potter if the Council were to agree with the conceptual ideas what type of time rrame would the Council be looking at. Richard Potter said hopefully within two weeks he will be able to bring things to a conclusion and prepare the color renderings of the complex itself. He said if the Council gives its approval tonight on the conceptual drawings the mechanical engineering people will be designing the basic mechanical system for the bathroom, air conditioning etc., so right away work will began on the final drawings. He said it is imperative the bids are received back in February. Councilmember Gutowski said he took a copy of the plans to the Library Board Meeting on Tuesday. BOROUGH ENGINEER agreement, they like the conceptual plans as well and hope it moves ahead as quickly as possible. Councilmember Gutowski asked if anyone had any problems with Potter moving forward with the conceptual drawings. Councilmember DuPont said he thinks Potter should move forward. Councilmember Gutowski said he would make sure the Mayor gets a copy of the plans when he gets back on Monday. He told Potter to go ahead with the next phase. James McGovern, Esq. from Genova, Burns, Vernoia addressed the Governing Body. He gave a presentation about the services his company offers. Borough Attorney Craig Coughlin was noted present at approximately 7:30 P.M. Councilmember Gutowski said Mr. McGovern has been a great help in answering question for him and he recommended Mr. McGovern be hired at an hourly rate so when ever he was needed he could be hired not as a retainer. Borough Attorney said typically with Special Counsel payment is done by an hourly rate with a not to exceed amount. James McGovern, Esq. said his rate for 1997 is $130.00 per hour 1998 $150.00 per hour. Borough Gutowski said he has already spoken with Patrick DeBlasio, Treasure and was informed if Mr. McGovern was retained a Resolution should be drawn up with a not to exceed amount of $5000.00. He said put the Resolution on for next week and hopefully it will pass. Borough Engineer Parmar addressed the Governing Body. 1. Contract documents - He said drawings and Specs - for Sabo and Etheridge pump stations have been completed and handed over to Purchasing Department. He said bids are due on December 30, 1997 at 2:00 p.m. at Annex. He said he is requesting authorization for the Purchasing Officer to open the bids to expedite the projects. - Council gave permissiou to Parmar to opeu the bids. 2. Parmar reported now that the Borough has the D.O.T. grant of $164,000.00 for improvements to Post Boulevard, he is requesting authorization for John Cilo to do a field survey and preparation of survey drawings set for an amount not to exceed $5,000.00. - Council gave permission to draw up Resolution. 2 3. Parmar said as reported in the last meeting, the emergency work on Etheridge Drive force main was done by B&W Contracting Company. He said this being special work on top priority executed on Saturday and Sunday also, B&W has submitted an invoice for $16,896.00. He said in order to approve this payment, he is requesting adoption of a Resolution for this work as emergency work. He said the amount of the invoice has been checked and found reasonable for this type of work. - Council approved Resolution to pay for the emergency services. 4. Parmar said as per the instructions rrom Councilman John DuPont, R.F. P. is under preparation for general survey, Geotechnical and environmental investigation, wetland and stream investigation works for the extension of the Industrial Road from Middlesex Avenue to Port Reading in Woodbridge. He said this will be sent early next week to : a. French & Parrello. b. T & M Associates. c. Coastal Engineering. d. Sadat Engineering. which are the leading Environmental Engineering Firms. 5. Parmar said like wise as instructed by Councilman John DuPont the tabulated list of engineering projects addressed from January 1996 --December 1997 is prepared, and the priority engineering projects for 1998, 1999 and 2000. He said these are submitted to the Council and these are now held for study. 6. Parmar said after the meeting with New Jersey Transit and Carteret Community Development seven additional locations have been picked up for installing bus shelters. He said the New Jersey Transit agreement was that they would install these at no cost to the Borough, but the cost of maintenance will have to be born by the Borough. He said no private advertisement or graphics should be installed without prior written approval of New Jersey Transit, and provide adequate comprehensive public liability and property damage insurance with a minimum limit of $1,000,000.00 per occurrence for each bus shelter. He said another company, Amherst Media rrom Summit, New Jersey has approached offering installation of new or replacement of existing ones, and they well assume all responsibility of repairs, liabilities, maintenance at no cost to the Borough. He said in return they would share a portion of the revenue generated from advertising. He said it is therefore requested to approve this proposal and authorize the Engineering Department to negotiate and finalize contract under legal guidance rrom the Borough Attorney. Borough Attorney Craig Coughlin and the Mayor will go to represent the Borough. BUSINESS TO BE ADDED: Councilmember Fazekas spoke about the appeal from Conrail. Borough Attorney Coughlin said Conrail did in fact file an appeal. He said the appeal was filed in a timely manner. He said he is waiting for a date from the County Construction Board. Councilmember Gutowski asked how long does the County Construction Board has to make a determination on whether the appeal will be heard or disregarded. Borough Attorney said he does not know how long the time period is. He said he thinks it is just a function of their calendar. He said he would call the County Construction Board and see what their time frame is. Councilmember Gutowski said since Conrail has filed an appeal that does not mean the Fire Superintendent could not continue to fine Conrail ifhe sees a violation. Borough Attorney Coughlin said the fact that Conrail has filed an appeal does not mean the Borough has to stop issuing violations. Councilmember DuPont said he would like to speak about two things. 1. He said the Police Committee is looking into the Loitering Ordinance as for establishing curfews. He said there is nothing right now. He said there are a couple of samples the Police Department has provided the Council to look at. 2. He said there is a very serious issue with coverage for daytime First Aid workers. He said the Borough does not have proper coverage for paramedics or drivers. He spoke about hiring an E.M.T. and paying them on a per hour basis. He will continue to look into this and he will get back to the Council with more firm details. Councilmember Gutowski said the Library property is being auctioned off on December 30, 1997. He said in the absence of the Mayor he was in a conference with the MCUA about garbage. He said they have lowered the rates at the landfill now because of the Supreme Court decision. He said they are going to lower the rates at Edgeboro to $51.00 per ton. He said if a three-year contract were signed with the landfill, they would lower it down to $38.00 per ton. He said they are 6 offering this deal to the Municipalities and to private haulers. He said if the Borough were to sign a contract with Edgeboro, there would be a savings of $54,369.00 a year which is about $163,000.00 over a three- year period. He said the goal is to have Municipalities sign this contract by December 22,1997, which the Borough could not do. He said the latest is March, and again the Borough could not sign the contract because the Borough's garbage contract is not up until June. He said he thinks the Borough should look at the contract because it will save money and the Borough's contract is expiring in June. Councilmember Fazekas said there would be an Open House at the Fire Headquarters this Saturday from 11:00 a.m. -2:00 p.m. He said someone at the last Council Meeting requested frost-rree refugerators. He said he spoke with the Housing Authority and as long as the refrigerator is working it can not be replaced. Upon MMS&C, by Councilmembers DuPont and Fazekas and unanimous affirmative vote of the four (4) Councilmembers present the meeting was in recess at approximately 8:10 P.M. At approximately 8:15 P.M. the meeting was reconvened. Upon individual roll call, the following were noted present Councilmembers Bialowarczuk, DuPont, Fazekas and Gutowski. Noted absent were Councilmembers Failace and Feingold. Council President Gutowski asked for a motion to go into Closed Session to discuss Personnel Matters, Contract Negotiations and Litigation. Upon MMS&C by Councilmembers Fazekas and Bialowarczuk RESOLUTION #97-371-A "RESOLUTION TO GO INTO CLOSED SESSION" was adopted. Upon individual roll call vote, Councilmembers Bialowarczuk, DuPont, Fazekas and Gutowski voted in the affirmative. Councilmembers Failace and Feingold were noted absent. At approximately 8:18 P.M., a Closed Session was held. Upon MMS&C by Councilmembers Fazekas and DuPont and unanimous affirmative vote of the four (4) Councilmembers present this meeting was opened to the public at approximately 9:05 P.M. ADOPTED ADJOURNED Borough Attorney Coughlin stated there is an application for water Fire Protection Services with Middlesex Water Company. He said it is in rront of the building on 70 Cooke Avenue. He said a motion needs to be made to authorize the Mayor to execute the application agreement on behalf of the Borough. RESOLUTION #97-372 was introduced by the Council President and referred to the Council for action. Upon MMS&C, by Councilmembers Fazekas and DuPont RESOLUTION #97-372 "WATER SERVICES APPLICATION" was adopted. Upon individual roll call vote, Councilmembers Bialowarczuk, DuPont, Fazekas and Gutowski voted in the affirmative. Councilmembers Failace and Feingold were noted absent. Councilmember Gutowski said he would like a motion to be made authorizing the execution and serving of the disciplinary charges against William Kolibas, Jr. and to set the hearing for January 9, 1998. He said it should also so be noted that a Fact Finder would be retained to hear this case. He said the suspension would be with out pay. RESOLUTION #97-373 was introduced by the Council President and referred to the Council for action. Upon MMS&C, by Councilmembers Fazekas and DuPont RESOLUTION #97-373 "AUTHORIZING EXECUTION OF DISCIPLINARY CHARGES - WILLIAM KOLIBAS, JR." was adopted. Upon individual roll call vote, Councilmembers DuPont, Fazekas and Gutowski voted in the affirmative. Councilmember Bialowarczuk abstained. Councilmembers Failace and Feingold were noted absent. Upon MMS&C by Councilmembers Fazekas and Gutowski and unanimous affirmative vote of the four (4) Councilmembers present, after no further discussion, this meeting was adjourned at approximately 9:10 P.M.
