PUBLIC INTEREST AND NECESSITY REQUIRE;:.AND ORDERING THE ACQUISI- TION FOR VEHICLE PARKING DISTRICT N0, 1 OF SAID CITY AND ESTABLISHING THE .BOUNDARIES OF SAID DISTRICT. WHEREAS, proceedings have been duly taken and. a hearing duly held. pursuant to notice duly given under the Special Assessment Investigation, Limitation anal. Majority Protest Act of 1931, and no written protest was filed. by the owners of one-half of the area. to be assessed. for the proposed. acquisition, and. this City Council by resolution duly adopted, determined. that the public convenience, interest, and. necessity require the acquisition substantially as set forth in the report on file in the office of the City Clerk, and. that said. project is feasible; and. WHEREAS, on February 21, 1956, pursuant to the provisions of the Vehicle Parking District Act of 1943, as amended, this Council duly adopted Ordinance No. 642 of said. city declaring the intention of this Council to form said. district and. to .acquire-the lands pro- posed. in petition,on file in the office of the City Clerk, and. fixing April 3, 1956 at 8 o~clock p.m. in the Council Chambers of this Council, as the time and. place for the hearing of protests and. objections; and WHEREL4S, said. Ordinance No. 642 was duly published., posted., and mailed as provided. by said. Act, and. said. hearing was duly held. at the time and. place so fixed.,. and. all interested. persons were given a full opportunity to be heard.; and. WHEREAS, at said. hearing, there were no protests or objections, either written or oral, to any of the things proposed. to be done, and. said. hearing has been duly concluded; and. WHEREAS, this City Council has determined. that written objections or protests to the thing or things proposed to be done as set forth in said. Ordinance No. 642 have not been made by the owners -1- of more than one-half of the number of parcels or of more than one- half of the area of the land. included. within the proposed district and subject to assessment, and. has further determined. that there, has been no majority protest within the meaning of 'Section 2830 of the Streets and Highways Code of the State of California. NOW, THEREFORE, BE IT ORDAINED .by the City Council of the City of Lynwood. as follows: Section 1: That said. City Council fixes and determines that the public interest and necessity require the acquisition des- cribed. in said. Ordinance No. 642 and. described. below,. and. accordingly this City Council hereby orders the acquisition described. in said. Ordinance No. 642, namely, the.acquisition,in fee simple for parking places of the following described. property in the City of Lynwood., to wit: Lots 32g, 330, 331, 332, 336, 464, and. 465 of Tract No. 2551 as shown on map recorded. in-Book 24, pages 78, 79, and. 80 of Maps, Records of .Los Angeles County, California, and those por- tions of Lots 462 and. 463 of said. Tract No. 2551 lying easterly of a line 65.00 feet westerly of, measured at right angles to and. parallel to, the westerly line.of the first alley westerly of Long Beach Boulevard. Section 2: That the boundary of Vehicle Parking District No. 1 of the City of Lynwood. is hereby fixed and. determined. as follows: Beginning at the northeast corner of Lot 324 of Tract No. 2551 as shown on map recorded. in Book 24, pages 78, 79, and. 80 of Maps, Records of Los Angeles County, Califorhia, thence westerly to the northwest corner of said. Lot 324; thence southerly to the northeast corner of Lot 333 of said Tract No. 2551; thence westerly to the northwest corner of said. last mentioned. lot; thence southerly to the southwest corner of Lot 334 of said Tract No. 2551; thence .easterly to the south- east corner of said. Lot 334; thence southerly to the northeast corner of Lot 337 of said. last mentioned tract; thence westerly along the northerly line of said. Lot 337, 50.00 feet; thence southerly in a direct line to a point on the southerly line of Lot 340 of said last mentioned. tract, distant thereon 50.00 feet westerly from the .southeast corner of said. lot; thence southerly to the northwest corner of Lot 402 of said. Tract No. 2551; thence southerly to the southwest corner of said last mentioned. lot; thence southeasterly to the most northerly corner of Lot 462 of said Tract No. 2551, said. point being on the westerly line of the first alley westerly of Long Beach Boulevard.; -2- thence southerly along said. last described line to the northwesterly line of Fernwood. Avenue f40 feet wid.e); thence southeasterly along said. last described. line to the westerly line of Long Beach Boulevard.; thence northerly along said last des- cribed. line to the point of beginning. Providing, however, that no lands within the parking district owned by the .United. States, and no streets, alleys, or highways therein, and no property, to be acquired for parking places in this proceeding shall be assessed. to pay the cost and expenses of the,aetion herein ord.ered., and. any road. or parcel of land in any other public use belonging to the State or to any county, city, district or to a public corporation, in use for the performance of a public function and. lying within the exterior boundary o.f the parking district a above described, is not included. in said. district. Section 3: That this City Council hereby declares thaw a Vehicle Parking District as above described. and. designated and. numbered. as Vehicle Parking District No. 1 of the City of Lynwood has been duly formed. under the provisions of the Vehicle Parking District Act of 1843, as amended. Section 4: That the City Attorney of the City of Lynwood. is hereby directed to bring an action in the Superior Court of the State of California in and for the County of Los Angeles, in the.name of the Cty.of Lynwood. for the.cond.emnation of the property necessary and. proposed to be acquired. as described in said. Ordinance.No. 642 and. hereinabove.described.; provided, that this.County may contract for the purchase of any of the said lands and. any part of said. land acquired. by,purchase or by gift need not be included in the condemnation action or if included. therein, need. not be condemned. except as otherwise pro- vided. in said. Vehicle Parking District Act of 1843, as amended, The condemnation action shall be filed. and. the condemnation proceedings taken substantially as provid.ed.in the Street .Opening Act of 1903 and particularly. Chapters 7, 8, 9, and 10 thereof. Section 5: That the'City Clerk shall certify to the adoption of this ordinance and shall cause-this ordinance to be published once -3- in the Lynwood. Press, a newspaper published. in .the City of Lynwood.. Section 6: This ordinance shall take effect upon the lapse of thirty days from the time of its final passage. First read. at a regular meeting of the City Council of said. City held- on the 3rd. day of April, 1956, and finally adopted. and. ordered. published. at a regular meeting of said.
