AN ORDINANCE REGULATING BURNING AND BURNING OF
TRASH AND REPEALING ORDINANCE N0. 471 AND SECTION
34-A OF ORDINANCE N0. 305 OF THE CITY OF LYNWOOD.
The City Council of the City of Lynwood does ordain as
follows:
Section l: It shall be unlawful for any person, firm, or
corporation, after the effective date of this ordinance, to burn any
combustible waste material except between the hours of 4:00 o-'clock
p.m, and 8:00 o~clock p.m. of any calendar day except that:
On any calendar day for which the Air Pollution Control
Officer of the Los Angeles County Air Pollution Control District
has forecast that there will be favorable burning weather and has
so notified the Fire Chief of the Lynwood Fire Department, a person
may also burn combustible rubbish at any time during such calendar
day in a Class I Incinerator, and. between 6:00 o~clock a.m. and 10:00

o-clock a.m.,of such day in a Class II Incinerator.
As used in this section the term "favorable burning
weather" means the weather on a calendar day other than a calendar
day during which the Air Pollution Control Officer of the Los Angeles
County Air Pollution Control District has forecast that:
(a) The inversion bas e, at 7:00 o~clock a.m. Pacific
Standard Time will be lower than 1500 feet, and.
(b) Such inversion will not break or the maximum
mixing height will not raise 3500 feet, and
(c) The average surface wind speeds between 6:00
o'clock a.m, and noon, Pacific Standard. Time, will
not exceed five miles per hour.
Notwithstanding any of, the provisions of this
section, combustible waste material may be burned in
a multiple chamber incinerator at any time.
A Class I Incinerator may operate at any time if
it is used in connection with an industry which has

presented sufficient proof of need and which the Chief
of the Fire Department of the City of Lynwood. has
approved for continual use of Class I Incinerators to be
essential to the operation of such industry.
Notwithstanding any provisions of this section, no
person shall burn any combustible waste material in an
open outdoor fire, except upon first having received a
permit from the Chief permitting said open or outdoor
fire, on conditions specified by the Chief.
Section 2: "Incinerator Class I" shall mean a.ny incinerator
which is: '
(a) Within or a part of a building, or is constructed.
under permit and in accordance with the requirements of
the Uniform Building Code, or
(b) Any separate incinerator that;
1. Has a firebox volume of 27 cubic feet or more, or
2. Exceeds six feet in height exclusive of the
chimney, or
3• Has a concrete or unit masonry chimney more than
six feet high or a reinforced concrete chimney
more than 12 feet high.
"Multiple Chamber Incinerator" shall mean any article,
machine, equipment, contrivance, structure, or part of a structure,
used to dispose of combustible refuse by burning, consisting of three
or more refractory lined combustion furnaces in series, physically
separated by refractory walls, interconnected by gas passage ports
or ducts and employing adequate design parameters necessary for maximum
combustion of the material to be burned. The refractories shall have
a Pyrometric Cone Equivalent of at least 17, tested according to the
method. described in the American Society for Testing Materials, Method
C-24.
All other incinerators are hereby defined. as Class II
Incinerators.

Section 3: It shall be unlawful for any person, firm, or
corporation to:
(a) Use, construct„ or maintain any type incinerator in
violation of this ordinance or any rules, regulations, or
specifications from time to time adopted. by the Fire Chief
of the City of Lynwood.
(b) Locate any approved Class II type incinerator within
10 feet of any residence; locate any approved Class II
type incinerator within 20 feet of any window or opening
within a residence unless said incinerator shall have a
sufficient 20 gauge galvanized iron or steel stack carried
above the roof line of adjacent residence, properly braced
• and guyed to insure its permanent placement and equipped
with approved. type spark arrestor at top; locate any
approved Class II incinerator within 4 feet of any fence,
accessory building or other structure or hedge; and pro-
vided.further that no incinerator shall be placed closer
than one (1) foot of any commercial building of Type 1, 2,
or 3 construction (brick or masonry) or closer than four (4)
feet from any commercial building of Type 5 construction or
closer than twenty-five (25)-feet from any automobile filling
station building or filling station dispensing apparatus or
other inflammable storage.
Section 4: It shall be unlawful for any person, firm; or
corporation to burn any combustible rubbish in Fire Zone No. 1 of
the City of Lynwood except in an approved Class I type incinerator.
Section 5: Ordinance No. 471 and Section 34-A of Ordinance
No. 305 of the City of Lynwood are hereby repealed.
Section 6: .This ordinance is intended to govern and. regulate
open burning and burning in incinerators and shall not be construed
to apply to other incidental type burning such as in gas appliances
in homes, barbecue pits, interior fireplaces, in residences, and.
industrial uses such as furnaces, et cetera.

Section 7: The Fire Chief of the City of Lynwood is hereby
empowered to grant necessary permits for authorized burning pursuant
to this ordinance and is likewise empowered to grant exceptions from
the terms and provisions of this ordinance in cases where the operation
of this ordinance as to existing conditions or future conditions
would cause undue hardship or be unreasonable; the FireChief may impose
conditions in the granting of any such exception.
Section 8: Any person, firm, or corporation violating any
of the provisions of this ordinance shall be deemed guilty of a mis-
demeanor and upon conviction thereof shall be punishable by a fine
of not to exceed five hundred dollars ($500.00) or imprisonment in
the City Jail of the City of Lynwood or the County Jail of Los Angeles
County, State of California, for a period of time not to exceed.~six
months, or by both such fine and imprisonment.
Each such person,firm, or corporation shall be deemed guilty
of a separate offense for every day during any portion of which
violation of any provision of this ordinance is committed; continued,
or permitted by such person, firm, or corporation, and. shall be
punishable therefor as provided by this ordinance.
Section 9: The City Clerk shall certify to the passage and
adoption of this ordinance and shall cause the same to be published
once in the Lynwood Press, a newspaper published, printed., and. cir-
culated in the City of Lynwood, California, and which said. newspaper
is hereby designated for that purpose.
