ORDINANCE NO. 1983-109
AN ORDINANCE AMENDING ORDINANCES NOS. 62 AND 57
SODAS TO REQUIRE WATER AND SEWER BILLS TO BE PAID
BY THE OWNER OF THE PROPERTY RATHER THAN THE TENANT

BE IT ENACTED by the City Council of the City of
Tiffin:
Section I . Section 4 of Ordinance Number 62 is thereby
repealed and the following Section 4 is enacted in lieu thereof:
Section 4. The rates and charges hereinbefore
perscribed shall be assessed against each premises,
tenement or other place served and shall be paid by
the owner of such premises , tenement or other- place.
If the owner of the building differs from the owner
of the real estate, bills shall be paid by the owner of
real estate. Any such rates and charges which are not
paid by the owner shall continue to be a lien and
assessement against the property served, and- may be
{ collected in the same manner as property taxes .
Said rates and charges shall be paid by all persons ,
corporations and other consumers, including said Town,
and no free service shall be supplied to any premises,
tenement or other place. A deposit Of $12. 00 shall be
=required from all building owners. Such deposit shall
be applied to any bill for water service delinquent
more than thirty (30) days . Upon the disconnection
of the water service, any balance of such deposit shall
be returned to the applicant without interest.
Section II . - Section 7 of Ordinance Number 57 is hereby
repealed and the following Section 7 is enacted in lieu thereof:
Section 7. Owner pays bills : the owner of the
property served shall pay all bills for sewer rent,
repairs -or supplies' furnished to the premises . If the
owner of the building differs from the owner of the
real- estate, bills shall be paid by the owner of the
real estate.
Section III . Repealer. All ordinances or parts of
ordinances in conflict with the provisions of this ordinance
. are hereby repealed.
Section IV. Severability Clause. If any section,
provision or part of this oridnance shall be adjudged invalid
or unconstitutional , such adjudication shall not affect the
validity of the ordinance as a whole or in any section, pro-
• vision or part thereof not adjudged invalid or unconstitutional

Section V. When Effective. This ordinance shall be in effect
after its final passage, approval and publication as provided by
law.

day of February, 1983, by posting copies thereof in `three public places
within the city limits, two of which are the mayor's` office and the post

Councilman Rohret introduced the foregoing Ordinance which was
then read and duly considered by the Council. Its adoption was moved
by Councilman Stevens and seconded by Councilman Spivey. On roll call
Councilmem Brown, Spivey, Rohret, Stevens, Cox voted "Ayes."
voted "Nays."
Whereupon the Mayor declared the motion carried. Councilman
Stevens then moved that the rule or law requiring three readings of
this ordinance on three different dates be dispensed with. Motion
seconded by Councilman Spivey. On roll call Councilmen Spivey,
Rohret, Stevens, `Cox, Brown voted "Ayes." Councilmem
voted "Nays."
The Mayor then declared the Ordinance duly passed and adopted on
{the 9th day of February, 1983. 1
