ROLL CALL President Richard Bishop called the meeting to order at 7 :32 P.M. Members Present: Katherine Duffy, Daniel Wendin, Barbara Green, Nonette Hanko and Richard Bishop. Harry Turner arrived at 8 :00 P.M. Member Absent: Edward Shelley Personnel Present: Herbert Grench, Craig Britton, Charlotte MacDonald, Stanley Norton, and Iris Youngs. II, APPROVAL OF MINUTES Motion: R. Bishop moved the approval of the minutes of November 10 , 1981. D. Wendin seconded the motion. The motion passed unanimously. III. WRITTEN COMMUNICATIONS I. Youngs stated that there was a letter, dated November 13 , 1981, to Peter Dangermond, Director of the California Department of Parks and Recreation from Doni Hubbard, President of the Midpeninsula Trails Council, in support of the District 's application for Land and Water Conservation Funds which would enable the District to acquire 97 acres as an addition to the Monte Bello Open Space Preserve. IV, AD0',)"JT()!J OF AGEND' R. Eishop stated the Board would adopt the agenda as written. V. ORAL COMMUNICATIONS There were no oral communications. VI. SPECIAL ORDERS OF THE DAY A. Ellie Huggins of the Peninsula Open Space Trust presented a slide show entitled "Peninsula Landscapes" , photographed and produced by Dewitt Jones. B. H. Grench acknowledged the receipt of a gift of $10 ,000 from the Peninsula Open Space Trust. He said the District had been awarded a federal Land and Water Conservation Fund grant of $35 ,000 for the development of the 3 ,200 acre Monte Bello Open Space Preserve, and said the District had to match the federal funds with $35 ,000 in District out-of-pocket funds, District labor, volunteer or other "free" labor, and private contributions toward the project. Motion: N. Hanko moved the adoption of Resolution 81-52 , a Resolution of the Board of Directors of the Midpeninsula Regional open Space District Thanking the Peninsula Open Space Trust for its Generous contribution to the Monte Bello Development Project. K. Duffy seconded the motion. The motion carried unanimously. Discussion: N. Hanko stated that everyone involved in approving the Monte Bello development project was comfortable with the plan. R. Bishop thanked N. Hanko for her efforts in bringing the various agencies together on the plan and expressed the District 's appreciation to Peninsula Open Space Trust representative Ellie Huggins for P.O.S.T. ' s generous gift and support. VII . OLD BUSINESS WITH ACTION REQUESTED A. Final Adoption of Summary Review of Use and Management Plan for Planning Area VII - El Sereno and Costanoan Way Open Space Preserves. R. Bishop, referring to R-81-47 , dated October 30 , 1981, stated that at the November 11 Board meeting the Directors had given the Use and Management Plan their tentative approval. Motion. R. Bishop moved the final adoption of the Summary Review of the Use and Management Plan for Planning Area VII - El Sereno and Costanoan Way Open Space Preserves. D. Wendin seconded the motion. Discussion: H. Grench stated that the District had not re-_-cived any further comments from the public on th�. recommendations. The motion passed unanimously. VIII. NEW BUSINESS WITH ACTION REQUESTED A. Agreement with the City of Mountain View for Stevens Creek Shoreline Nature Study Area Trail Construction. C. Britton, referring to M-81-122 , dated November 18 , 1981 , stated that in March, 1981 the Board approved staff ' s proposal to submit an application for a Coastal Conservancy Bayland Access Grant jointly with the City of Mountain View for development of a hiking/bicycling trail in the Mountain View Regional Shoreline Park and adjacent Stevens Creek Shoreline Nature Study Area, adding that the grant was awarded in the amount of $125 ,000. He said that Mountain View is the lead agency on the grant contract and has agreed to oversee the ' construction of the project. He noted all of the project within Shoreline Park will be the responsibility of the City of Mountain View and all improvements from the end of Shore- line Park (beginning at the bridge crossing Stevens Creek) and the pathway on the levee adjacent to the Stevens Creek Shore- Meeting 81-28 gage Four San Carlos , for Thursday, December 10, for the purpose of gathering public input on the Hassler property; and to cancel the December 23 Regular Meeting. The motion was seconded by D. Wendin. The motion passed unanimously. IX. INFORMATIONAL REPORTS H. Grench reported on recent activities involving District rangers, including two stolen car incidents and a rescue at Sanborn County Park. H. Grench reported he , J. Boland and E. Mart attended a meeting in Los Altos regarding the St. Joseph ' s parking problem on November 13 , 1981 (meeting notes distributed as an FYI item with the November 23 packet) and said the meeting was held in an effort to resolve the ongoing park- ing problems in the St. Joseph' s area. He said that unless the Board objected, he would work with Los Altos to implement the signing program. There were no objections. He said he would return with the question of the bridge in the County Park. C. Britton said he, H. Grench, and D. Woods attended a meeting of the Montana Land Alliance held at the Golden Gate National Recreation Area at the Yosemite Institute. The meeting concerned private options for land preservation. R. Bishop thanked H. Turner for writing a letter to the editor of the Peninsula Times Tribune in response to the series of articles published about the District. H. Turner reported that he had made a status report presentation to the Menlo Park City Council on November 17 , 1981. H_ Grench reported on joint meetings held by the San Mateo County Planning Commission and East Palo Alto Municipal Council regarding the East Palo Alto Community Development plan. He said that District staff had reviewed that plan and submitted comments pertaining to the Baylands, a copy of which had been sent to the Board. X. CLAIMS Motion: R. Bishop moved the approval of the revised claims 81-231 dated November 23 , 1981. B. Green seconded the motion. Discussion: N. Hanko abstained from item No. 2571. K. Duffy questioned claim 2678 , District ' s share of Road Repair-Long Ridge. C. Britton stated that as a result of the purchase of the Bridgeman parcel adjacent to Long Ridge , an Meeting 81-28 Page three line Nature Study Area will be the responsibility of the District. He pointed out that the cost analysis figure of $124 ,995 had increased by $30 ,000 because of the cost of a longer bridge than originally planned and said the Coastal Conservancy staff had been contacted and had agreed to support the increase and carry it to the Coastal Conservancy board. He pointed out that the contingency figure is $10 ,000 and expressed confidence that the projt,-_act cost will come in under $155,000. Britton said that the anticipated completion date for the project is July 1, 1982 . S. Norton pointed out that, although it seemed likely that the project would be funded for the increased amount, the District should be aware that the increased cost of the bridge does fall under the responsibility of the District. Under paragraph 5 of the Agreement between Mountain View and the District, which states that "if the City is unable to obtain funding to cover additional costs , the party whose portion of the project is identified shall reduce the scope of that portion until the cost equals the estimated cost contained in Exhibit B. " He said the District could be asked to pick up the difference between the previous cost analysis and the actual cost. Motion: D. Wendin moved that the Board approve the Agreement with the City of Mountain View for Stevens Creek Shoreline Nature Study Area Trail Construction and authorize the General Manager to sign the Agreement on behalf of the District. B. Green seconded the motion. The motion passed unanimously. B. Appointment of Committee for Study of Ward Boundaries R. Bishop referred to memo M-21-121 , dated November 17 , 1981, rogarding the analysis of -the District ' s population distribution !Dared on 19-80 census figures , and thc adj­tst­_-,-_,nt ward boundaries, as necessary, by the Board. Motion: R. Bishop moved that the President be authorized to appoint a committee for study of the 1980 census data and to recommend any necessary ward boundary adjustments to the full Board. The motion was second- ed by K. Duffy. The motion passed unanimously. R. Bishop appointed D. Wendin , N. Hanko, and H. Turner to the committee, with D. Wendin serving as chairman. C. Scheduling of December Meetings (memorandum M-81-118 , dated November 13 , 1981) Motion: B. Green moved to authorize the President to re- schedule the December 9 Regular Meeting to December 16; to schedule a Special Meeting, to be held in Meeting 81-28 Page five agreement calling for cost sharing on road repair was implemented. The motion passed unanimously. XI. CLOSED SESSION The Board recessed to a closed session on land negotiation matters at 9 : 12 P.M. XII. Iris Youngs Secretary F WRI= COMMUNICATION Meeting 81-30 Dec. 16, 1981 December 4, 1981 Midpeninsula Regional Open Space District 375 Distel Circle, Suite D-1 Los Altos, CA 94022 Dear Sirs: According to a recent item in the Peninsula Times, there continues to be parking problems at the Rancho San Antonio County Park and Open Space Preserve. We urge you to continue to allow a limited amount of parking under the 280 overpass and not totally ban parking at this entrance. My husband and I are daily joggers at the Preserve - he at noon, my- self early morning. We live a 5-minute drive from the St. Joseph entrance, and park beneath the 280 overpass. It is a 15-minute drive to the Cristo Rey parking lot. We park there on weekends when the driving time is not important. We have never seen cars parked in front of residences or blocking driveways during our week-day jogging hours. In fact, there are seldom more than 5 or 6 cars parked under the 280 overpass at those times. Please take our needs into consideration when investigating this issue. Young 229 STEVENS COURT SAN CARLOS,CALIFORNIA 94070 415/592-1"7 11 December 1981 Board of Directors Mid Peninsula Regional Open Space District 375 Distel Circle Suite D-1 Los Altos, California 94022 Subject: Hassler Property Acquisition Gentlemen: My wife and I have actively supported the Hassler acquisition and accordingly, we attended your board meeting on December 10. Although we agree that the only feasibile alternate is to acquire the property through the courts, I would like to share a sobering commentary with you. The theme is "the ineffectiveness of government bodies" . Perhaps this analysis can be useful . Excessive time has passed in the effort to acquire Hassler. All organizations share responsibility in this pursuit, and San Carlos and San Francisco carry the burden. San Carlos had the less mentally gifted type of guidance from DeRosa, Bennie and the school principal , who initally opposed the assessment district formation in spite of voter self assessment decisions made years ago. Now San Francisco apparently has not functioned in good faith with your organization. Perhaps some of that is because of ineffective communications by MPRSOD. Now there is another delay to file notices, have another hearing and God knows what else before you file suit. Before you take legal action, you may want to consider the realities of taking on San Francisco on the basis of power considerations. They are much larger and can probably afford to hire more and better lawyers. I say this in spite of the quip by the lawyer on Thursday night; lawyers like to say those things because many of them took an elective in law school that is similar to the medical school elective called "How to play God." Coming full circle, I do riot think that it is a consequence that lawyers run governments. Nothing gets done, and this is sad. Very truly yours, Jerome A. Grench, General Manager RESPONSIBILITY AND PREPARATION: C. Britton, Land Acquisition Manager, D. Woods, Open Space Planner, M. Gundert, Associate Open Space Planner SUBJECT: Proposed Addition to Windy Hill Open Space Preserve (Catalano Property) Introduction: The Midpeninsula Regional Open Space District has been offered the opportunity to purchase three parcels totaling 107 . 5 acres located in the foothills above Portola Valley and adjacent to the District ' s Windy Hill Open Space Preserve. The parcels are located adjacent and north of the southeastern boundary of the Windy Hill Open Space Preserve and would become an addition to that site (see attached map) . A. Description of the Site 1 . Size, Location and Boundaries. Located within the Town of Portola Valley, the property extends from Alpine Road to Skyline Boulevard. The property is comprised of three parcels; parcel 1 is 91 . 8 acres, parcel 2 is 9 . 5 acres , and parcel 3 is 6. 2 acres . Parcel 1 is bounded by Windy Hill Open Space Preserve to the northwest, parcel 2 to the northeast, and Skyline Boulevard to the southwest. Damiani Creek forms the southeastern boundary of parcels 1 and 2. Private property bounds all other sides of the parcels . The site is 0 . 7 miles north of Mt. Melville and would adjoin Windy Hill Open Space Preserve , making it an important link in the planned Skyline Corridor Trail , a major recreational route linking public lands in three counties. The parcels also represent a potentially valuable link between the planned trail system of Portola Valley and the Skyline Corridor. 2 . Topography, Geology and Natural Landscape. The razorback ridge located on the property extends from the 800 foot elevation at the Alpine Road boundary to a high of 2000 feet along Skyline Boulevard. Steep hillsides are charac- teristic of both sides of the ridge. Damiani Creek forms R-81-49 Page two the southeastern boundary of parcels 1 and 2 and drains into Corte Madera Creek at the northeastern edge of parcel 2 . The moderate to very steep slopes are covered with clusters of oak-madrone-Douglas fir woodlands and chaparral . The creek banks are lushly vegetated with ferns and other riparian vegetation. B. Planning Considerations The entire property is designated Mountain Residential in the Portola Valley Zoning ordinance. The designation is designed to protect the foothill integrity, and open space acquisition would be a compatible use. Portola Valley also has an adopted Trails and Pathways Plan which indicates various trails on the property. The parcels are rated high to moderate on the District ' s Master Plan composite rating of suitability as open space land. C. Current Use and Development An unsurfaced road running from Skyline Boulevard to Alpine Road is located on the property with several spur trails branching from it. The road crosses private property at several points and would need signing to indicate property boundaries. An easement across the private parcels would be allowed for patrol only at this time. However, the property is capable of supporting a public trail extending from Alpine Road to Skyline Boulevard without crossing private property. D. Relationship to Regional Trails The property represents a key link in the planning of the Skyline Corridor Trail . The connection made by the acquisition of these parcels would significantly narrow the gap between Mt. Melville and the Windy Hill open Space Preserve . The remaining parcels separating Mt. Melville and the Catalano property are owned by Thomas Fogarty. In March 1981 , Portola Valley placed a condition on Mr. Fogarty' s Use Permit for a winery, stating a 20 foot trail easement would be required for dedication at such time as trails exist at either end of the parcels. The land for such trails would be secured by this acquisition. Portola Valley ' s adopted Trails and Pathways Plan indicates three trails on the property, the first linking Portola Valley with the Skyline Corridor and the remaining two connecting to planned trails on Windy Hill Open Space Preserve. E. Potential Use and Management The property could be incorporated into the existing and planned trails system of the adjacent Windy Hill open Space Preserve and could form a connection in the Skyline Corridor Trail . R-81-49 Page three Public access would be from Skyline Boulevard and adjoining properties with the private property owners ' permission.. The existing road/trail is very steep in places and should eventually be realigned to reduce the grade, minimize erosion, and provide a variety of landscapes for visitors. Patrol access would be available from Skyline Boulevard and Alpine Road. F. Use and Management Recommendations 1. Existing fencing and the gate along Skyline should be re- placed with split rail fencing and a pipe gate with a hiking/equestrian stile. Estimated cost of the project is $950. 2 . The road entering the parcels is gated 1000 feet from the junction of Alpine Road, within parcel 3 . If the gate is not maintained by the private property owner, the District should install a gate at the entrance to parcel 1 along the northern boundary. 3 . Boundary plaques should be installed at the Preserve bound- aries to identify the limits of the Preserve. 4 . A regulatory sign should be placed at the entrance to the site from Skyline Boulevard set back somewhat from the fence. G. Dedication The parcels should be withheld from dedication at this time to allow for boundary adjustments or the exchange of property rights, including the possibility of improved access rights across the adjacent private lands. H. Name. It is recommended that the parcels become additions to the Windy Hill Open Space Preserve. I. Terms As outlined in the attached purchase agreement, the total price for this property would be $500 ,000 ($4 ,650/ac. ) . $348 ,000 would be paid in cash and the balance of $152 , 000 would be in the form of an assumption of an existing deed of trust with very favorable terms : 10 years, 60 (interest only in advance) , principle balance due and payable at the end of the term (9/24/87) . Recommendation: It is recommended that you adopt the accompanying Resolution of the Board of Directors of the Midpeninsula Regional Open Space District Authorizing Acceptance of Agreement to Purchase Real Property, Authorizing officer to Execute Certificate of Accep- tance of Grant to District, and Authorizing General Manager to Execute Any and All Other Documents Necessary or Appropriate to Closing of the Transaction (Windy Hill Open Space Preserve - Catalano Property) . The existing road/trail is very steep in places and should eventually be realigned to reduce the grade, minimize erosion, and provide a variety of landscapes for visitors. Patrol access would be available from Skyline Boulevard and Alpine Road. F. Use and Management Recommendations 1. Existing fencing and the gate along Skyline should be re- placed with split rail fencing and a pipe gate with a hiking/equestrian stile. Estimated cost of the project is $950. 2. The road entering the parcels is gated 1000 feet from the junction of Alpine Road, within parcel 3 . If the gate is not maintained by the private property owner, the District should install a gate at the entrance to parcel 1 along the northern boundary. 3. Boundary plaques should be installed at the Preserve bound- aries to identify the limits of the Preserve. 4 . A regulatory sign should be Placed at the entrance to the site from Skyline Boulevard set back somewhat from the fence. G. Dedication The parcels should be withheld from de the at this time to allow for boundary adjustments or the exchange of property rights, including the possibility of improved access rights across the adjacent private lands. Gundert, Associate Open Space Planner SUBJECT: Proposed Addition to Russian Ridge open Space Preserve (Crist Property) * Introduction: The Midpeninsula Regional Open Space District has been offered the opportunity to purchase 120 acres of land south of Russian Ridge Open Space Preserve in an unincorporated area of San Mateo County. The District has also been offered the opportunity to lease, with the option to purchase, an additional 92 acre parcel which adjoins the 120 acre parcel and the southern border of Russian Ridge Open Space Preserve (see attached map) . The option to purchase the 92 acre parcel could be exercised in January, 1983 . A. Description of the Site (1) Size, Location and Boundaries: The 120 acre parcel is located south of Russian Ridge Open Space Preserve in an unincorporated area of San Mateo County and is bordered by private property to the east, west , and south and by the 92 acre proposed lease parcel to the north. The 92 acre parcel is bordered by Russian Ridge Open Space Preserve to the north and east and private property to the west and south- west. The two parcels would adjoin Russian Ridge Open Space Preserve , which is a key part of the planned Skyline Corridor trail , destined to become a major recreational route link- ing public lands in three counties . Positioned along Mindego Creek , the parcels could Play an important role in a future link to Pescadero Creek County Park. (2) Topography, Geology and Natural Landscape : The elevation of the parcels extends from a high of 2 ,200 feet at the northeast corner to a low of 1 ,400 feet along the two tributaries of Mindego Creek. The slope of the parcels are generally southwest facing and are covered with oak- madrone-douglas fir woodland along the steep slopes and creek banks , and open grassland along the ridgetops. B. Current Use and Development A dirt road traverses the southern portion of the 120-acre parcel Providing access from Alpine Road. This road crosses private property and could be used as a patrol road but would not be appropriate as a public access. R-81-46 page two The site was h-.torically used for cattle grazing and remants of this past use remain. A cattle crossing in the road marks the eastern boundary of the property, and a cattle chute with fencing and gates used to herd cattle are located at the junction of the trail and road. No other structures are present. Both parcels are currently subject to a grazing lease which encompasses other adjacent private property as well as the adjoining District owned Russian Ridge Open Space Preserve. C. Planning Considerations The land is located in San Mateo County ' s Resource Management District, and acquisition of the property is in conformance with the San Mateo County General Plan. Both parcels lie outside the District boundary, but adjacent to existing District lands and the District boundary. D. Relationship to Existing and Proposed Trails Trails on the two parcels would connect with an existing trail on the Russian Ridge Open Space Preserve, extending the trail from Skyline Boulevard to the southermost corner of the property, a distance of two miles . The parcels could also play an important role in a trail link between the proposed Skyline Corridor Trail and Pescadero Creek County Park located to the south. Both parcels , together with the existing areas of Russian Ridge Open Space Preserve would provide a loop trail passing through an area of extreme beauty with sweeping vistas. E. Potential Use and Management The property should be incorporated into the existing and planned trails system of the adjacent Russian Ridge Open Space Preserve. F. Use and Management Recommendations (1) Preserve boundary plaques should be placed at the southern boundary of the property bordering private property . (2) The existing trail should be repaired as needed. (3) Land Management staff should work with adjoining owners to provide any additional gating or security along the existing private road which enters the 120 acre parcel from Alpine Road. (4) The current grazing lease should be continued until an assessment of the lease conditions can be completed in connection with the site use and management review scheduled for April, 1982 . G. Dedication It is recommended that both the 120 acre and 92 acre parcels be considered for dedication as public open space in January, 1983 when a decision is made regarding purchase of the latter parcel . R-81-46 page three H. Name It is recommended that the 120 acre parcel become an addition to Russian Ridge open Space Preserve, and that the 92 acre parcel also become an addition to Russian Ridge Open Space Preserve if the option to Purchase is exercised. I. Terms The attached Purchase Agreement provides for the acquisition of the 120 acre parcel for a total purchase price of $339 ,600 (approximately $2 ,800 per acre) , with $79 ,900 cash down payment (240) and the balance of $259 ,700 payable over seven years at the rate of 8% per annum on the unpaid balance. Escrow would close on or before December 1, 1981 , and down-payment funds would come from the New Land Commitments budget category. Also attached is an Option Agreement which includes the payment of $30 ,000 to enable the District to acquire the 92 acre parcel during the period from January 1, 1983 , to January 31 , 1983 , and lease the entire premises during the interim period of time. The option payment would not apply toward the purchase price , but would cover the Grantor ' s costs of carrying the property (taxes, cost of equity, insurance, etc. ) , the expected appreciation during the option period, and the rental value during the option term. Should the District exercise this option , the purchase price would be $260 ,000 (approximately $2 ,800 per acre) with $50 ,000 cash down payment (190) and the balance of $210 ,000 payable over six years at the rate of 8% per annum on the un- paid balance . Escrow would close on or before February 15 , 1981. If this option is approved, staff would return to the Board during the option period (January, 1983) with a recommendation on the purchase of this parcel. I further recommend that you withhold the parcel from dedication at this time, name the site as an addition to the Russian Ridge Open Space Preserve , and tentatively adopt the use and management recommenda- tions included herein. Grench, General Manager SUBJECT: Additions to Legislative Program for 1981-1982 Legislative Session Introduction: Since my report to you on November 10 regarding the status of the legislative program for the 1981-1982 legislative session (see M-81-115, dated November 3 , 1981) , your Legislative Committee, consisting of Directors Bishop, Duffy, and Turner, met to consider additions to the program. Discussion: The Committee and I support additions to the program in the following categories : A. Amendments to Public Resources Code Sections Governing Regional Park and Open Space Districts 1. "Housekeeping" Amendments Regarding Signatory Require- ments to Sections 5544. 1 and 5544 . 2 Bond Counsel has advised the District that it is an archaic procedure to reauire that promissory notes or contracts be signed by two-thirds of the members of the board (Section 5544 . 2) . It is particularly cumbersome when there are multiple notes for a given debt issue, such as the District ' s Series A note issue ($4,600 ,000 in $5 ,000 denominations) . It is important to note that no change is being suggested in the board' s vote require- ment to approve the resolution authorizing the contract or note. Additionally, he feels it would be helpful for the District ' s code to specify that one of the two signa- tures may be by facsimile reproduction and thereby avoid the necessity of registering the signature with the Secretary of State. Finally, there would be additional flexibility if either the secretary or treasurer could attest to the president' s signature , according to who was available or the desires of the board. The following language is that of the existing sections with proposed deletions shown as cross-outs and proposed additions shown as italics. M-81-124 Page two 5544 . 1 Notwithstanding any other provisions of this article, the board may borrow money by issuance of promissory notes or other evidences of indebtedness in an amount, or of a value, not exceeding in the aggregate at any one time the greater of 5 percent of the total of the district' s general fund and development fund budgets for the year in which the loan is made, or the sum of five hundred thousand dollars ($500 , 000) , to be used for any revenue-producing Purpose for which the district is authorized to expend funds. A district shall not exercise the borrowing authority conferred by this section if the district, at any time during the Previous two years, had not met the loan repayment requirements of this section and the renayment provisions set forth in the promissory )romissory note or other evidence of indebted- ness issued for a loan entered into Pursuant to this section. A district shall not expend in any one year any amount of money in excess of what it collects in property taxes, state and federal subventions, grants, loans, fees, gifts, bequests, or income from other sources. Indebtedness incurred Pursuant to this section shall be repaid in approxi- mately equal annual installments during a period not to exceed five years from June 30th of the fiscal year in which it is incurred and shall bear interest at a rate not exceeding 10 percent per annum, or the rate allowed under Section 53531 of the Government Code, if higher, payable annually or semiannually or in Part annually and in part semiannually. Each indebtedness incurred under this section shall be authorized by a resolution of the board unanimously adopted, and shall be evidenced by a promissory note or contract signed by the president of the board and attested by the secretaryT or treasurer. One of the two signatures may be by facsimiZe reproduction. The indebtedness authorized to be incurred by this section shall be in addition to, and the provisions of this section shall not apply to, any bonded indebtedness authorized by vote of the electors . Nothing herein shall be construed so as to limit or restrict the authority of the district to issue promissory notes or deeds of trust in the acqui- sition of real property or the exercise of its right of eminent domain subject to the limitations in Section 5568 . Nothing herein shall limit the authority of the district to borrow Pursuant to Section 5544 . 3 5544 . 2 (a) A district may acquire all necessary and proper lands and facilities, or any portion thereof, by means of a plan to borrow monev or by purchase on contract. (b) The amount of indebtedness to be incurred shall not exceed an amount equal to the anticipated tax income for the next four-year period derived pursuant to Section 5545 or the anticipated tax income for the next 10- year period derived pursuant to Section 50077 of the Government Code, or both; or, with respect to the East Bay Regional Park District only, the anticipated tax income for the next two-year period derived pursuant to Sections 5545 and 5545. 5 or the anticipated tax income for the next 10-year period derived pursuant to Section 50077 of the Government Code, M-81-124 Page three or both. All indebtedness which is incurred on or after July 1, 1982 , pursuant to this section shall be repaid in approximately equal'Tual annual installments during a period not to exceed 10 years from the date on which it is incurred and shall bear interest at a rate not exceeding 10 percent per annum, or the rate allowed pursuant to Section 53531 of the Government Code, if higher, payable annually or semiannually or in part annually and in part semiannually. Each indebtedness shall be authorized by a resolution adopted by the affirmative votes of at least two-thirds of the members of the district board and shall be evidenced by a promissory note or contract signed by oi-d+reetars. the president of the board and attested by the secretary or treasurer. At the time of making the general tax levy after incurring each indebtedness and annually there- after until the indebtedness is paid or until there is a sum in the treasury set apart for that purpose sufficient to meet all payments of principal and interest on the indebtedness as they become due, a portion of the taxes levied and collected pursuant to Section 50077 of the Government Code, if any, and pursuant to Sections 5545 and 5545. 5 shall be levied and collected and set aside sufficient to Day the interest on the indebtedness and the Dart of the principal that will become due be- fore the proceeds of a tax levied at the next general tax levy will be available. (c) The indebtedness authorized to be incurred by this section shall be in addition to, and the provisions of this section shall not apply to, any bonded indebtedness authorized by vote of the electors. 2 . Lease of District Property for Compatible Purposes (New Section 5563 . 5) Land or property that is temporarily unnecessary for District purposes can be leased for a maximum term of 25 years (see Section 5563 reprinted herein) . In order for some leases to be sufficiently profitable to the lessee, a longer Period is needed. The prospective lessee of the Picchetti Winery complex would like to lease some adjacent land for viticulture but feels that forty years is needed to justify the investment. Such a lease might enhance the economic feasibility of the winery lease and Promote a working vineyard for the pub- lic to enjoy viewing as part of the whole operation. The proposed language is quite restrictive in allowing these longer leases for purposes that are compatible with or enhance public use and enjoyment of the land or property. 5563. (EXISTING) Sale or lease of unneeded property If, in the opinion of the board, any land or property owned by the district, or any interest therein, becomes unnecessary for the purposes of the district, the board may, subject to the provisions of Section 5540 , sell such lands or property, or interest therein. When land or property is temporarily unnecessary for park or open- space purposes , it may be leased for other purposes for a term not exceeding 25 years with an express Provision M-81-124 Page four in the lease that should the board by ordinance determine to use the lands for park, open-space , or other district purposes, the lease shall thereby be terminated. The proceeds of any sale or lease of lands or property, or any interest therein, shall be used for and applied to such purposes of the district as the board may, by reso- lution, determine . 5563. 5 (NEW) Lease for compatible purposes Notwithstanding the provisions of Section 5563 , the board may lease land or property for a term not exceeding 40 years when the board makes an express finding that the purpose of the lease is for park or open space purposes, or for an historic preservation, recreation or agricul- tural purpose which is compatible with or enhances Public use and enjoyment of the land or property. B. Other State Legislation 1. State Administrative and Legislative Action Regarding State' s Murray Ranch Property and Trail Connection to Skyline The State of California has accepted the approximately 1000 acre Murray Ranch that was left to the State as a bequest. This property lies just outside Half Moon Bay and abuts the Rancho Raymundo property acquired by the Peninsula open Space Trust (P. O.S.T. ) (see attached map) . Staff has been working with P .O.S .T. and the State in order to accomplish two things : (1) Designate the Murray Ranch as a State park and (2) have the State acquire from P.O.S .T. the Rancho Raymundo property to make the connection to Skyline Boulevard where a parking area for hikers and equestrians could be located. The State has yet to so designate the property but the Department of Parks and Recreation supports the designation. The District and P.O.S .T. were unsuccessful in convincing the State Parks and Recreation Department staff and Parks and Recreation Commission that 1980 parks bond act funds should be used for the Rancho Raymundo acquisition. The Gregorio trail funds ($280 ,000) which might have gone toward the now defunct Slate Creek project, could be applied through additional legislation toward the Rancho Raymundo trails connection to Skyline. The attached resolution would show your interest in seeing the total project accomplished. Please note that this matter has been a part of your adopted legislative program. 2 . Endorsement of Bottle Bill Petition In the past you have supported the so-called "bottle bills" (SB 4) authored by Senator Rains that require a deposit on certain beverage containers. Experience in other states and in national parks has shown that litter M-81-124 Page five is greatly reduced when beverage container deposits are required. The legislation has been "bottled-up" in the Legislature for at least two years, and a petition drive is underway to place this matter on the ballot next year. The petition-sponsored measure (attached) is essentially the same as SB 4 . If you approve the attached resolu- tion, the fact of your support of the petition to put the matter on the ballot could be used by the proponents. Recommendation: I recommend that you take the following actions : (1) Instruct the General Manager to seek legislation amending the District' s enabling legislation as described herein. (2) Adopt the attached resolution regarding the Murray Ranch and Rancho Raymundo. (3) Adopt the attached resolution supporting the petition to put the beverage container measure on the ballot. RESOLUTION NO. RESOLUTION OF THE BOARD OF DIRECTORS OF THE MIDPENINSULA REGIONAL OPEN SPACE DISTRICT REQUESTING DESIGNATION OF THE MURRAY RANCH AS A STATE PARK AND THE ACQUISITION OF THE RANCHO RAYMUNDO PROPERTY AS AN ADDITION THERETO WHEREAS, the Murray Ranch, an approximately 1000 acre parcel of beautiful mountain and streamside terrain owned by the State of California in San Mateo County, has already been placed in the priority list for future State Park development funds, and WHEREAS , the Murray Ranch, yet to be designated by the State of California as a State Park, would be an excellent and needed addition to the State Park system and would, as a Park, fulfill the donor' s intent that the property be used for park and open space purposes, and WHEREAS , the Peninsula Open Space Trust, a private land conservancy, purchased the adjacent Rancho Raymundo property, a beautiful natural resource, when it was on the verge of develop- ment in order to hold it for the State as an addition to the Murray Ranch property, and. WHEREAS, the Rancho Raymundo property would provide an excellent staging area for hikers and equestrians, a viewpoint and picnic area on. the State ' s Skyline Scenic Highway, and a trails corridor to the Murray Ranch property, and WHEREAS , there are unused State funds called the Gregorio Trails Fund which could, through legislation, be applied to this acquisition, NOW, THEREFORE, THE BOARD OF DIRECTORS OF THE MIDPENIN- SULA REGIONAL OPEN SPACE DISTRICT DOES RESOLVE to request urgently that the State of California designate the Murray Ranch as a State Park and that the Rancho Raymundo property be acquired by the State as an addition thereto. Grench, General Manager SUBJECT: Review of Policies Regarding Improvements on District Lands and Agricultural Uses Introduction: Your Policies Regarding Improvements on District Lands (see attached copy) indicate that a house (or other structure) that the District acquires as part of a land acquisition will be retained and maintained only if it has an immediate or potential use that is complementary to the use of the site as open space . Panger residences and historic buildings fit into this classification. The Policies also indicate that "Structures will not be maintained or constructed solely for the purpose of producing revenue. " Accordingly, for ex- ample, the brown house on the Fremont Older Open Space Preserve has been slated for demolition in the adopted use and management plan. I felt that there was a need to review these policies in the light of reduced revenues brought about by Proposition 13 and to consider retaining structures which otherwise would be demolished as revenue producing uses. I do not, however, advocate a change in policy in this regard. Discussion: The Structures Committee (a.k.a. Site Use Committee) met twice to review these issues. The Committee as a whole made no recommendation but felt there should be a discussion by the full Board. Two members of the Committee (Directors Duffy and Shelley) felt that the Policies were proper as now written. Director Shelley felt that a policy statement could be inserted to the effect that if the District determined that any structures should remain, but for non-District uses , then the structure should be returned to the private sector. Director Hanko felt that such structures should not necessarily be returned to the private sector but that a cost-benefit analysis should be considered regarding the lease or return to the private sector of residences or other imurovements. Costs would include costs to the District of managing and maintaining the structures. Benefits would include the financial benefits of leasing rather than selling and the intangible benefit of retaining the structure and, particularly, the lot for future park and open space related use. I think that you should consider modifying the present policies so as to recognize explicitly that structures which detract from scenic areas or which are incompatible with potential public recreational use of the surrounding area could be acquired over a long period of M-81-125 Page two time as they came on the market and rented or leased by the District during the interim. Public recreational needs may not develop for a period of time, or other open lands may not be feasible to acquire immediately, which would necessitate demolition or use of the struc- tures. Also, there may be two houses, for example, next door to one another which should be acquired in the long term, but only if both are ac- quired. One might come on the market one year and the other ten years later. During the ten years , the first house could be rented, and part of the purchase price could be defrayed. The life of a resi- dential structure as a living unit could be extended with this approach. Another issue the Committee considered was whether the District should take a more proactive role in encouraging agricultural uses (see Agricultural Use Policy Statements , adopted February 8 , 1978) . A study of revenue producing agricultural uses for District lands has been in the Action Plan for the last two years or so, but has not been done because of higher priority projects . The continuation of existing agricultural uses is considered when developing use and management plans for specific sites. The consensus was that the District' s approach has been appropriate (i.e. , sufficiently proactive considering other priorities) . Recommendation: I recommend that you debate these matters and, possibly, give further direction to the Committee or staff. V ik,I oe 8"MW MIDPENINSULA REGIONAL OPEN SPACE DISTRICT Policies Regarding Improvements on District Lands Adopted By Board of Directors January 11, 1978 Revised February 22, 1978 Introduction: in the process of fulfilling is primary function of acquiring open space, the District also becomes the owner of structures and other improvements of varying condition, use- fulness and value. Some of these improvements are appropriate to the open space around them, and others are not. Frequently, structures have some degree of historical value. As use of District lands increases, there will be additional pressure on the District to construct new facilities such as recreational buildings and parking lots. Since there are many costs involved with the maintenance, patrol and liability of structures, it is important that the District establish a policy for the use, construction and/or removal of structures on District lands. Information on specific structures and their use, potential uses and final disposition will be found in the specific site plans. The following policy statements are intended as a guide for the staff in the preparation of such specific site plans to be approved by the Board. A. Definitions. For the purpose of these policies, improvements will include all constructions such as buildings, recreation and sanitary facilities, utility structures, dams, fences and gates, roads, trails and parking lots. B. Policy Statement. All structures and other improvements existing on District lands at the time of acquisition are potential resources and as such will be considered for retention and will be addressed in the site plan. In other than emergency situa- tions, public notice will be given as specified in the Land Use and Management Planning process document before the de- cision is made to remove a major structure. The District will retain and maintain or build a structure or other improve- ment only if it is complementary to the objectives of the District outlined in the Basic Policy. Important considera- tions in the decision to retain an improvement will be its compatibility with the open space character of the site, its potential financial burden to the District in terms of lia- bility and management, and its proposed use. Existing R-77-58 Page two structures which have identified potential uses may be retained for an indefinite period as stated in the use and management plan for the site. other improve- ments will be removed from the site as soon as it is eco- nomically feasible within the constraints Of the land management budget. The time scale for the removal will be determiend on the basis of both the cost of removal and the degree of negative impact on the site. The -site plan will consider the cost and practicality of salvaging materials being removed. C. Discussion. (1) Improvements Used for Site Protection and Management: (i­.g. Ranger station, Ranger and Caretaker Residences, Equipment and Water Storage Facilities, Fences and Gates) If it is deemed necessary or desirable to have a ranger station or ranger (caretaker) residence in order to pro- perly care for the site, the decision to use an existing structure or to build a new structure should be made on the basis of cost effectiveness and site compatibility. When a structure is used as a ranger or caretaker res- idence, rental will be at fair market value minus the value of services rendered to the District. Allow- ances may be made for the fact that available facili- ties may exceed the actual need of the occupant. Some improvements such as fences, gates, equipment and water storage facilities may be required for the proper maintenance and protection of a site. Such im- provements will be constructed and/or maintained as required. (2) Improvements for Public Utilization of the Site: (i.g. , Education and Recreation Facilities, Youth Hostels, Restrooms, Drinking Water, Trails, Roads, Bridges and Parking Lot) Because the District's principal role is that of pro- viding low intensity recreational uses of its lands, improvements such as trails and parking lots will be considered as part of each site plan. Improvements which have potential for more intensive recreational or environmental and historic educational use will also be considered for retention or construction; however, the willingness of other agencies to bear any major costs of construction and/or management will be an important consideration. Facilities required for the health and safety of the public will be constructed and maintained only as required. In emergency cases, the staff will have discretion for immediate mitigation of hazards. R-77-58 Page three (3) Improvements whichContribute to the Character of the Site: (e.g. , Buildings with Unique Historical or Architectural Merit, Barns, Sheds and Fences) In order for the Board to determine the historical, cultural or architectural significance of a structure, the District will notify and consult such agencies as specified in the Land Use and Management Planning Process Document. As an aid to this determination, the District will conduct and maintain a survey of significant struc- tures within the planning area. When the District considers acquisition of a site which includes a structure or structures which are listed on the Na- tional Register for Historic Places or are clearly eligible for inclusion on that register, the District has a special responsibility to seek some means to protect these structures. An important consideration in the decision to retain such structures will be the availability of special funding programs or resources from other public agencies, private organizations or individuals for the costs of their restoration, main- tenance and operation. In extraordinary situations involving structures of exceptional historical or architectural merit, when other resources are not available, the District will either exclude the structures from its acquisition or accept the respon- sibility to protect and preserve them for an indefi- nite period while seeking other means for continued preservation and/or restoration as identified in the historical resources inventory. Some structures associated with agriculture or other former uses of the site can contribute significantly to the site without detracting from its open space character. When economically feasible within the constraints of the land management budget, examples of these structures will be retained, maintained, and whenever possible put to use. (4) Improvements as Income Sources : Structures will not be maintained or constructed solely for the purpose of producing revenue. Rentals may be employed to maintain a structure which is being re- tained for another potential use or on a temporary basis in order to help defray the cost of removal of an undesirable structure. IV-47hen a structure is temporarily retained for the purpose of revenue pro- duction, it should be rented for the fair market val- ue consistent with possible special restrictions due to its location on open space lands, and its availa- bility should be advertised through normal channels generally used for this purpose, e.g. , newspaper ad- vertisement. R-77-58 Page four Generally the decision to lease an improvement will be made to optimize special factors related to managing District lands. If other factors are equal, a lottery will be used to determine the tenant, if more than one potential lessee is interested in the same improvement. The Board of Directors will review and approve improve- ments leases or licenses which are long term (over 1 year) and/or involve an anticipated income in excess of $3 , 500. The General Manager or his/her designee may enter into lease or license agreements on behalf of the District without specific Board approval if they are: (a) in amounts not exceeding $3, 500 income to the District (including in-kind services) , and (b) no more than 1 year in duration, and (c) not long range commitments, e.g. , through improve- ments, which go beyond the scope of Board adopted interim or long term site plan, and (d) pursuant to a Board adopted interim or long term site plan Staff will have the discretion to enter into leases specifying either cash or in-kind services or a com- bination of the two as payment. If in-kind services are being accepted, they will in no circumstance exceed one year' s cash value without Board approval, to pre- clude the expectation of a continuing relationship. (5) Improvements for Agriculture and Other Special Uses : Agricultural use which is consistent with the open space use of a site is encouraged by the District. We propose that a policy statement along the following lines be placed in the section on "Future Use of the Baylands" (page 4-24 of the Plan) . Role of San Mateo County As funding permits , develop a regional shoreline park if such a County park is to be desired after further public hearings , and a park cannot be otherwise developed in connection with a marina. I believe this would be consistent with the other Dolicv state- ments, consistent with the County parks plans, mindful of the current funding picture, and responsive to the apparent desire of East Palo Alto officials to take a strong role in determinincr the future recreational development of the baylands. We appreciated the opportunity to hear your concerns and express our own. As a follow-up to that meeting, we understand you will investigate solutions to two areas of further concern: 1. Interim Trail Since the Navy's flood control project may not be implemented until 1988/1989 or later, and the adjoining trail segments are now under construction, the concerned public agencies (Mid- peninsula Regional Open Space District, city of Mountain View, City of Sunnyvale, and the County of Santa Clara) would like to construct an interim trail through Navy lands linking Mountain View Shoreline Park and Stevens Creek Shoreline Nature Study Area with Sunnyvale Baylands Park and ultimately, Alviso and the National Wildlife Refuge. As a result of our discussions, we understand the Navy might be receptive to such use, as long as the trail is located outside the safety arc and does not endanger the jet fuel pipeline. As shown on the attached map, a trail could pass along the levee between the Open Space District 's land and Leslie ' s land (subject to an agreement from Leslie) , continue along the outboard Moffett levee to the beginning of the safety arc, cross the corner of Leslie ' s salt pond (again with Leslie ' s permission) on a boardwalk out- side the safety arc, bridge the jet fuel pipeline, and connect with the north levee of the Lockheed property where the Sunny- vale trail segment would intersect. The District would appreciate the consideration of such a proposal, as suggested at the meeting. If the interim rights to construct this trail were available, it is our belief that the Coastal Conservancy would favorably consider a grant for construction, and a joint agency agreement could provide for regular patrol and maintenance . Long-term Solution Everyone at the meeting seemed to agree that a letter of in- tention and cooperation among all parties concerning a long term solution to the final trail connection through the Moffett area would be desirable. The public agencies have had many meetings with the Navy concerning the trail route , and several discussions with persons involved in the Environmental Impact Assessment for the Navy' s Flood Control Project. We under- stand the Navy prefers that the trail follow the outboard Leslie levee, while we favor a direct connection closer to Highway 101 and the existing trail termini (see attached map) . A direct route would avoid a two mile detour around the outer salt ponds, would be less disturbing to nesting waterfowl, and would provide a more direct route which trail users would tend to seek in any event. The trail could be constructed so as to stay outside the safety arc and bridge the jet fuel pipeline. The Open Space District would like further investigation of the proposal for a meandering levee alignment through Stevens Creek Shoreline Nature Study Area as suggested in the Stevens Creek Plan of opportunities (the joint study with the Santa Clara Valley Water District) . This alignment, combined with breaching the dike along Stevens Creek, would allow a large part of the marsh area to return to a natural condition, and would be shorter and less costly than alignments B and C for the Navy levee construction, as well as aesthetically more pleasing. if possible, it would be desirable to address all of these issues in such a letter of intention . All of the local agencies regard the trail segment through Moffett as a crucial final link in the Santa Clara County section of the South Bay Trail . We would like to work with the Navy for the best balanced project which could reduce the Navy ' s expense by including rights of way across District land. Andeen City of Menlo Park 701 Laurel Street Menlo Park, CA 94025 Dear Gerry: After I presented the District progress report to you and your fellow council members on November 17 you commented that you would like to see "more green" in the vicinity of Menlo Park. I'm not sure whether you felt that what we had accomplished to date was somehow misdirected, or that, since the map I projected was out of date, you still weren't adequately informed. Given the brevity of the meeting and the recent rapid progress that we have been making, I'm going to assume the latter and provide you with some additional information about our accomplishments and current activities in San Mateo County. I wish to emphasize that we work on a required pattern that is guided by topography and the location of urban areas; political boundaries like the County line are in- cidental to this. This point is illustrated by one of our first acquisitions, the Los Trancos Open Space Preserve (the site of the earthquake trail). It straddles the County line. At the same time we are very sensitive to providing regional parks throughout the District so that something significant is nearby nearly every city. Regional openspace preserves should attract people from throughout the Dis- trict as well as from their immediate neighborhoods. The Edgewood site (at the intersection of 1280 and Edgewood Road) is in the immediate backyard of Redwood City and San Carlos. The Hassler site (on the opposite side of Edgewood Road) is an active District project. Both of these sites, which will offer picnicking, hiking, horseback riding, a golf course, and glorious wild flower displays, are within a fifteen minute drive from most of Menlo Park. On the Bay side, we are in the process of assembly in an area from Palo Alto, through Cooley Landing and on up to the Dumbarton Bridge. The enclosed newspaper article and a copy of a letter from Assemblyman. Naylor illustrates a current Dis- trict activity in the vicinity of Menlo Park. The project specifically will be convenient to the Belle Haven section of Menlo Park. Another area of two-pronaed activity is around Skyline Boulevard. We have an ongoing program to provide public access all along the Skyline Scenic Corridor.
