HomeMy Public PortalAboutOrdinances-1983-111 s+ • ORDINANCE NO 1983-111 AN ORDINANCE AMENDING ORDINANCE NO. 83, THE OFFICIAL_' G ZONIN ORDINANCE BY CREATING A NEW A2 ZONE AND REGULATING AND_ _....._, -4 RESTRICTING THE USES ALLOWED THEREIN:_ BE IT ENACTED by the City Council of +the City of Tiffin, Iowa: - • Section I . Purpose. The purpose of this ordinance is to amend Ordinance-No. 83, the official zoning ordinance by creating an A2 zone for restricted agricultural uses. Section 4 of- - - Ordinance No. 83 is hereby repealed and the following Section' 4 • is enacted in lieu thereof: SECTION 4. Establishment of Districts. The City of Tiffin, Iowa, is hereby divided into the following districts: • • Al - Agriculture A2 - Restricted Agriculture District . " Ri - Single Family Residential. District R2 - Two Family Residential . District • R3 - Multi-Family Residential District TC - Trailer Court District Cl - Commercial District M1 - Industrial District Section 2. SECTION 9 of Ordinance No. 83 is hereby repealed and the following SECTION 9 is enacted in lieu- thereof: . ' SECTION . 9. .»Al - Agricultural . All property within the corporate limits of the City of Tiffin which has• not • received specific classification. Al uses shall be limited to those associated with agriculture. -• A2 -' Restricted Agricultural District. Restricted - . • • agricultural. uses. All uses related to agriculture:. permitted except feed lots, manufacture and/or storage of chemicals, including fertilizer. Access permitted at two or fewer areas designated by owner, renter, or lessee ,of. . property. • Off-street parking only in areas designated by owner, renter, or lessee of property. A l]., uses must meet the ll foowing performance standards: , • (a) Smoke. The emission of smoke from any operation or " • activity shall not exceed a density of .equivalent : opacity . • permitted below. No person shall operate or cause to be operated any process or furnace or combustion device , for the burning .of coal or other natural or synthetic fuels without using approving equipment, methods' or devices to reduce the quantity of gas born or air born solids of- fumes.. . emitted into the opening air exceeding a rate . permittted below at the temperature of 500° Fahrenheit. FOr the .... ." , purpose of determining the adequacy of such devices, these conditions shall apply when the percentage -of excess air in . the stack does not exceed 50% at full load. The foregoing requirement shall be measured by the A.F.M.E. Test Code' for, dust-separating apparatus. All other forms of dust, direct and flyash shall be completely elminated insofar as escape ' or emission' into the open air is concerned. The emission of particulate matter suspended in air shall not exceed . 0. 35 grains ( . 0023 ouncesY per standard cubic feet (70°. F . and 14.7 psia) of air during any one-hour period or a. total from all vents and stacks of one-half (I) pound per hour per acre of lot area during any one-hour period. . (c) Toxic Matter.' The release of airborn toxic ' matter from any operation or activity shall not exceed the fractional quantitites permitted below the threshold Limit Values . . , . adopted .by the American Conference ' of Governmental Industrial Hygienists. If a toxic substance is not listed, verification that the proposed level of toxic matter will be safe and not detrimental to the public health or injurious ' to plant and animal life will. be required. The measurement tf, of toxic matter shall be on the average of any 24-hour sampling period. The release of airborn toxic matter shall not exceed one-eighth of the Threashold Limit Values beyond. lot lines. . (d) Odor. The emission. of offensive odorous matter from any operation or activity -shall not exceed the odor threshold concentration defined in the American Society for Testing and Materials Method D1391-57 "Standard Method for ' Measurement of Odor in Atmospheres (Diluation Method) " as the .level which will just evoke a response in the human olfactory system when measured as set forth below.' Odorous'!' , matter shall not exceed the odor threshold concentration beyond lot lines at ground level or habitable elevation. • . . • . (e) Glare. Glare or light from any operation ,and •all lighting for parking areas or for the external illumat'ion of buildings or grounds shall be directed` or located in a'' . manner such that direct or indirect illumination from .the ,;, ' source of light shall not exceed one and one-half (110 foot candles at lot lines in any zone where a residential use is ' located. . , • . Section 3. SECTION 16 of Ordinance No. 83 is _hereby • repealed and the following SECTION 16 is enacted in lieu thereof: SECTION 16. Height Requirements. The following shall be. the height restrictions for each district and no structure shall be erected to a height in,.excess thereof. SECTION 17 of Ordinance No. 83 is hereby • repealed and the following SECTION 17 is enacted in lieu' thereof: . SECTION 17.- Lot Requirements. 'The following lot sizes' shall be required for each district as follows and in addition, each lot shall have front, side, and rear yards not less than the following depth and width per district: A2 District Lot size - k. acre " Front & rear yard `- • none , Side yards - none R1 District . All ordinances or parts of ordinances in conflict with the provisions of this Ordinance are hereby repealed. Section 6 . . Severability. If any section, provision, or part of this Ordinance shall be adjudged to be invalid or- uncon- stitutional , such adjudication shall not affect the validity of the ordinance as a whole, or any section, provision, or part thereof not adjudged invalid or unconstitutional. Section 7. Effective Date. This Ordinance shall` be in effect after its final passage, approval , and posting as provided' by law. On the 11 day of May , 1983 , at a, xegu l'ar meeting of the Tiffin City Council , Tiffin, Iowa, Councilperson Stevens introduced Ordinance No. 111 and moved -'that it be given its first reading.
