REGULATING CERTAIN KINDS THEREOF; FIXING THE AMOUNTS OF THE RESPECTIVE LICENSE FEES UPON THE SAME; PROVIDING FOR THE COLLECTION OF SAID LICENSE FEES; A.ND REPEALING AL,L OftDINANCESAND PARTS OF ORDINANCES IN CON- FLICT THEREWITH, The City Council of the City of Lynwood, California, does hereby ordain as follows: CHAPTER 2 TITLE AND DECLARATION Section. 1.00. Title. .This ordinance shall be known as and. may be cited and referred. to as "The Business License Ordinance." Section 1.01.. Declaration. There is hereby imposed upon every business, trade, profession, or occupation transacted within the City of Lynwood as specified in this ordinance, license fees• in the aanounts hereinafter prescribed. Section 1.02 License Required. It shall be unlawful for any person, firm, or corporation, or otherwise, to commence or carry on any business, trade, pr°ofession, or oooupation within the City of Lynwood, without first having procured a license from said City so to do, or without complying with any and all applicable provisions of this ordinance. Section 1.03. License a Debt. The amount of any license imposed by this ordinance shall be deemed a debt to the City of Lynwood, and any person, firm, or corporation carrying on any such business, trade, profession, or occupation mentioned in this ordinance without ha.vi.ng a license from said City so to do, shall be liable to an action iri the name of said City in any court of competent ,,j uris- diction for the amount of license fee and penalties imposed by this ordinance; and nothing herein shall prevent a criminal prosecution of any violation of the provisions of this ordinance:.,° Section 1.04. Conviction for Violation. 'Phe conviction and punishment of any person for transacting any business, trade, _1__ ;, profession, or ocoupation without a license shall not excuse or exempt such person from the payment of any license due or unpaid at the time of such oonviction, -2- 3 CHAPTER II DEFINITIONS Section 2.00. Definitions. For the purpose of this ordinance, unless it is plainly evident from the context that a different meaning is intended, certain terms used herein are defined as follows: 1. Amusement Park. An amusement park shall be and. is defined as any collection of the following: a. Ferris wheels b. Merry-go-rounds. c. Miniature trains. d. Ponies. e. Small autos. f. Small boats, or any other animal or mechanical rides and similar concessions and apparata intended for amusement purposes, 2. Bus trip, scheduled, For the purpose of this ordinance a scheduled trip is defined to mean a complete circuit route within the city limits of Lynwood or to mean that the scheduled passage of a bus from one city limit boundary through another city limit boundary shall constitute a scheduled trip. 3. Business, Established, is any occupation, trade, profession, calling, or any other commercial enterprise in the City of Lynwood regularly kept open, with someone in charge thereof, for the transaction of the particular business engaged in during the hours customary to transact such business. 4, Carnival, Circus, Rodeo, or Itinerant Show shall be and is defined as a collection of any shows, acrobatic feats, vaudeville performances, exhibitions, contests, events, feats of strength, merchandise booths, games of skill or chance, amusement rides, or other rides or devices of similar nature. 5.. Contractor. The term contractor for the purpose of this ordinance is synonymous with the term "builder" and, within the meaning of this ordinance, a contractor is any person who undertakes to or offers to undertake to or purports to have the capacity to undertake to or submit a bid to, or does himself or by or through others, construct, -3- alter, repair, add to, subtract from, improve, move, wreck or demolish any building, highway, road, railroad, excavation or other structure, project, development or improvement, or to do any part thereof, including the erection of scaffolding or other structures or works in connection therewith. 6. Contractor, General Building, is a person who has an agreement, written or verbal, expressed or implied, with the owner, his agent, lessee, or licensee for the construction, alteration, wrecking, moving, or demolishing of any of the structures or improve- ments described in the definition of "Contractor" as hereinabove set forth, as a whole; or to superintend the said work, and wherein there is required the use of two or more unrelated trades or crafts. 7. Contractor, Electrical; is a contractor whose operations are the performance of construction work requiring special electrical skill. 8. Contractor, Plumbing, is a contractor whose operations are the performance of construction work requiring special plumbing skill. 9. Contractor, Special,.(sub-contractor) is a contractor whose operations as such are the performance of construction work requiring special skill and whose principal contracting business involves the use of specialized building trades or crafts as specific- ally classified by the State of California Department of Professional and Vocatim al Standards, excepting therefrom General Building, Electrical, and Plumbing Contractors. 10, Peddler. A peddler is defined to be and include every person not having a fixed place of business in the City of Lynwood, who travels from house to house or place to place or at or along the streets of the City of Lynwood who sells or offers for sale any goods, wares, merchandise, service, or other things of value in his possession. 11. Person, as used in this ordinance includes an individual, a firm, copartnership, corporation, association, or other organization, -~+- or any combination of any thereof, 12. Solicitor, A solicitor is defined to be and include every person, firm, or corporation not having a fixed place of business within the City of Lynwood, who engages in the business of going house to house;° place to place, or at or along the streets in the City of Lynwood and who by appointment, invitation, visitation, or other means sells or offers to sell or takes orders for goods, wares, merchandise, or other things of value for future delivery, or for services to be performed in the future. -5- CfIAPTER III ADS~INIS`T°RATION Section 3,00. License Collector and Duties. The City Clerk of the City of Lynwood is hereby designated as the License Collector cf sa9_d City, and is hereby charged zaith the'duty of carrying out the provisions and enforcement of this ordinance. All officers and employees of the City of Lynwoad shall render such assistance in the enforcement hereof as may be from time to time required by said License Collector. The License Col.lectory in the exercise of tree duties imposed upon him hereunder, ox° his duly authorized deputies, shall have the power and authority to enter at any reasonable time any place of business required to'be licensed herein to ascertain whether the provisions of this ordinance have been complied with, and request exhibition of said license. Any person who fails to exhibit 'the same upon request shall be guilty of a misdemeanor and subject to the penalties provided for by the provisions of this ordinance. It shall be the duty of said License Collector to cause a complaint to be filed against any and all persons found to be violating any of the provisions of said ordinance. Section 3.01. Unlawful Business. No license issued under the previsions of this ordinance shall be construed as authorizing .the conduct of or continuance of any illegal or unlawful business. Section 3.02. Indebtedness for Past .Licenses and/or Retail. City Sales Tax. No liceaise shall be issued for any succeeding current or unexpired license period knowingly to a.ny person who at the time of requesting any nevr license is indebted to the City of Lynwood for any unpaid license fee or for any unpaid retail city sales tax. Section 3.03. Statements. No statement or affidavit filed, as hereinafter required, she'll be conclusive upon the City or upon any officer thereof as to the matters therein set .forth, and the same shai.l not pre,j~adice the right of the City of Lynwood to recover ary a.mo~ant that may be ascertained to be due from such person -6- in addition to the amount shown by such statement to be due, in case such statement should be found to be incorrect. If any person, as may be hereinafter required to make any such statement or affidavit shall fail to do so, such person shall be required to pay a license fee at the maximum rate herein prescribed for the business. Section 3.04, Prerequisite to Issuance of Business License. Before any license can be issued by said License Collector to: 1. Commence any business in any structure, a Certificate of Occupany must be first obtained from the Building Inspector of said City, as provided in Ordinance No. 5'20, and amendments thereto, or 2, Commence the business of manufacturing, preparing, hawking, storing, serving, selling, or offering for sale, or giving away, amy food intended for human consumption, written approval must first be obtained from the Health Officer of said City, or 3. To perform any contracting service as defined in the Contractors License Law of the Business and Professions Code, a valid certificate of registration must be first presented. Section 3,05. License Fees, How and When Payable, Unless otherwise specifically provided, all license fees under the provisions of this ordinance shall be due and payable in advance at the office of the License Collector, as follows: 1. Annual License. Due on the first day of January of each year; delinquent on the fifteenth day of February. 2. Semi-annual License Due on the first day of January and the first day of July of each year Delinquent on the fifteenth day of February and fifteenth day of August of each year. 3. Quarterly License. Due on the first day of January, April, July, and October. Delinquent on the last day of the first month in which the quarterly license is due. 4. Monthly License. Due on the first day of each and every month, Delinquent on the tenth day of the month. 5. Daily License. Due on its effective date. Delinquent on the following day, Section 3.06. Penalties, To all delinquent licenses -7- there shall be added a penalty of ten per cent (10°0} of the amount of the license fee due for terse period and shall be collected and the payment thereof shall be enforced to the same manner as other licenses are collected and enforced. No proration of any license fee due herein shall be m;3de for any poration of the period for which the license is payable, except on the following basise 7.. I,ic;enses purchased during period of April 1 to June 30, 3/4 of annual rate; 2. Licenses puroerased during period of July 1 to September 30, 1/2 of annual rate; 3. Lf.censes purchased during period of October 1 to December 30, 1/4 of annual rate. No greater or lesser amount of money shall be charged or recei~red from any license than is provided in this ordinances and ne License shall be sold or issued far any period of time other than is provided for in this ord5.nanee. Bastion 3.07. Contents of License. Upon the payment of the prescribed fee, the License Collector shall prepare and issue a license as provided in this ordinance to every person liable to pay a license as hereinafter prescribed. Said license shall be prepared on a pre-numbered form convenient for said use and shall contain the following informationo 1, Type of business or prof°ession to be licensed, 2. The number of persons employed (where required). 3. 'The license fee for aa3.d business. 4. The period of time covered by said license. 7~ The owner or person con.duoting said. business. 6. Tn.e name of sa3.d business. 7. The address of where said business is conducted. 8. Such other information as may be deemed necessary for the enforcement of this ordinance. Section 3.08. Posting and Keeping of License. All licenses must be kept and posted in the following manners -8- 1. Any licensee transacting and carrying on a business at a fixed location in the City of Lynwood shall keep said license posted in a conspicuous place upon the premises where such business is being transacted or carried on. 2. Any licensee transacting and carrying on a business, but not at a fixed location in the City of Lynwood, shall keep the license upon his person at all times while transacting and carrying on such business within the City of Lynwood, 3. Any licensee using a vehicle or vehicles in the conduct of the licensed business shall keep attached to each and every vehicle the device or sign issued by the License Collector for such vehicle while transacting and carrying on such business within the City of Lynwood. Section 3.09. Duplicate License. A duplicate license may be issued by the License Collector to replace any license previously issued hereunder which has been lost or destroyed, upon the licensee filing an affidavit attesting to such fact. Section 3.10. Exemption from Fees - Constitutional. Nothing in this ordinance shall be deemed or construed to apply to any person transacting and carrying on any business exempt by virtue of the Consti- tution or statutes of the United States or the State of California from the payment of license fees to municipal corporations. Section 3.11. Exemption from Fees - Veterans. Every honorably discharged or honorably relieved member of the Armed Service of the United States who served in any state of emergency as declared by the President of the United States, or war as declared by the Congress of the United States, who is physically unable to obtain a livelihood by manual labor, and. who is a voter of this State, may distribute circulars, and hawk, peddle, and vend any goods, wares, or merchandise except spirituous or other intoxicating liquor, without payment of any license tax or fee what- soever, and the License Collector shall issue to such veteran, without cost, a license therefor, provided such veteran exhibits his Honorable Discharge Certificate and Certificate of Disability issued by the United States Armed Service. Section 3.12. Exemption from Fees - Physical Disability. The City Council may, upon written evidence received from charitable organizations, License Collector, or other competent source, that any person by reason of physical infirmity, unavoidable -9- misfortune, or unavoidable povertya merits exemption from operation of any license required by any provision of this ordinance, or by any ordinance of the City of Lynwoody allow such person an exemption from the payment of said license fee far the conduct of any one business licensed by~any provision of this ordinanoe or by any ordinance of the City of Lynrrrood9 or grant such persona without cos t9 a license 'to peddle or solicit within the City of Lynwood. Section 3.1.3 Exemption from Fees _ Charitable Crganizations. fihe City Council. may, upon written evidence received from any religious, charitablee fraternal, educational, military, veteran, or municipal organization or assoCiationn waive the requirement of a license far the purpose of conducting or staging of any enter- prise where the receipts derived from the same are to.be used wholly for the benefit of such organizat~.on or charitable purposes and not for the purpose of private gain of any one individual. However, in the event any local organization referred to herein merely sponsors such enterprise, and when only a percentage of the receipts reoeived are apportioned to the local organization,-the person Conducting such enterprise-shall pay a license fee as may be hereinafter presCribFd, equal to the percentage recel.ved by hi.m for conducting such enterprise. Section 3.1~+. Exerripti.en from Fees - Interstate Commerce. Nothing in this ordinance shall be construed a,s imposing a license fee on or otherwise regulating or restricting foreign or interstate commerce and .any business or portion :thereof 'which is embraced in the term '"Interstate Commerce" or "Foreign Commerce." Every person claiming to be entitled to exemption from the payment of any license fee upon the ground that such license oasts a burden upon his rights ,to engage in such interstate Commeroe shall file a statement with the License Collector, disclosing the interstate or other Character of his business entitled to such exemption. If it appears to the satisfaction of the License Collector that the applicant is entitled to such exemption, the License Collector shall issues without costs a license therefore. -TO- 4 Seotion 3,1.5. Exemption - Right to Revoke. At any time that it sha1.1 appear to the satisfaction of the granting authority that any of the conditions of this ordinance as meriting exemption from license requirements do not exist as to any person to whom such exemption has been allowed9 said granting authority may revoke such exemption and the license issued thereunder, Section 316. Transfer of Location of Same Business. Any license issued pursuant to the provisions of this ordinance may be amended to authorize the continuance of the same business at a new location to which said business is to be relocated, subject to the obtaining of a Certificate of Occupancy for said new location, Seotion 3.37. Branch Establishments, A separate license must be obtained for each branch establishment or sepax°ate place of business carried on :under the same ownex°skxip. Howevera warehouses and distributing plants used in conneoti.on with and incidental to a business licensed under the provisions of this ordinance shall not be deemed to be a separate place of business or branch establishment. Section 3,18. Concessions, Every person who operates any businessp whether upon a, lease, sub-lease, or contract basis as a concession, or upon rented floor spade in or upon the premises of any person licensed under any provision of this ordinance, shall be required to obtain a separate and independent license pursuant to the appropriate provisions of this ordinance, and shall be subject to all the provisions of this ordinance. Seotion 3,19. No License Transferable ,or Refundable. No license issued. pursuant to this ordinance shall be transferable or refundable. Section 3,20. Identification Cards. Every hawker, peddler, or solicitor who does not have a fixed place of business within the City of Lynwood and every massage parlox^ operators private detective, private investigator, private police patrol, and taxi drivers whether or not having a f°ixed place of business in said city, shall obtain an identifioat3.on card from the Police Department of said City, which must be presented to the License Collector before any license can be issued. -11- CHAPTER IV LICENSE FEES Section 4.00. Advertising. 1. Advertising by bill posting or signing or other than permanent billboards, by hanging or otherwise, displaying signs on posts, buildings, or other structures, $5.00 per day. 2. Advertising by means of distributing handbills, dodgers, stickers, advertising samples, circulars, booklets, or other notices of advertisements, $60.00 per year, $20.00 per quarter, or $5.00 per day, at the option of the licensee. 3. Advertising by means of sound trucks, portable loud speakers, or sound producing apparatus or equipment, $5.00 per day, Licenses issued pursuant to this paragraph shall be subject to com- pliance with the requirements of the Traffic Authority. 4. Advertising by means of portable searchlights or are lights or light producing apparatus or equipment, $50,00 per year to cover an unlimited number of machines or devices, or $5,00 per day for each machine or device, at the option of the licensee.. Section 4.01. Amusements. 1. Boxing, wrestling, and similar events. $100.00 per year for every person, firm, or corporation managing, conducting, or carrying on any wrestling, boxing, or other similar events, exhibitions, or shows. 2. Amusement Parks. $100.00 per year for every person, firm, or corporation managing, conducting, or carrying bn the business of operating any amusement park. Section 4,02. Auctioneer, $25,00 per day for every person, firm, or corporation managing, conducting, or carrying on the business of an auctioneer for the purpose of selling at auction any real or personal property, except jewelry, or any person, owner or otherwise, carrying on an auction wherein any real or personal property is sold., except jewelry. Section 4.03. Building Maintenance, Cleaning of Buildings. $10.00 per year for every person, firm, or corporation managing, conducting, or carrying on the business of cleaning buildings rooms, -12- furnishings, windows, or any cleaning service for hire, except domestic help. Section 4.04, Coin Operated Machines - License Required, Every person, firm, or corporation furnishing to established places of business, or owning or having control over any coin operated machine whatsoever which is placed for the use of the public, except machines owned by the owner of the place of business in which said machines are located, shall be required to secure a license for each of said coin operated machines as hereinafter required. 1. Amusement Machines. Where an amusement feature is connected therewith or the operation of said machine tests the skill of the operator, the owner, lessee, or person in charge thereof shall pay a license fee as follows: a. $8.00 per year, or $2.00 per quarter, at the option of r the licensee, for each machine where the value of the coin inserted is less than five cents ($0.05); b. $20.00 per year, or $5.00 per quarter, at the option of the licensee, for each such machine where the value of the coin inserted is five cents ($0.05) or greater. 2. Music and/or Juke Boxes. $10.00 per year for each such master machine, plus $2.00 per year additional for each coin slot, if any, to which such master machine or device is connected or from which the same may be operated. 3. Television and Radio Sets. $2.00 per year for each such television set, radio, or other similar device furnished to or in individual apartments or living units operated as a single business, such as motels, hotels, and courts. 4. Vending Machines. Where only merchandise is received and no amusement feature or device is connected therewith, the owner, lessee, or person in charge of such machine shall pay a license fee as follows: a. Ice Vending Machine, $15.00 per year for each such machine. b. Cigarette Vending Machine, $5.00 per year for each such machine. c. Candy, Weighing, or any other Vending Machine, $2.00 -13- per year for each such candy, weighing, gum, peanut,popcorn, or any other machine vending merchandise only. Seals and Stickers for Coin Operated Machines. Any person, firm, or corporation liable for a license as hereinabove required shall file with the License Collector a true and correct list of the various coin operated machines placed within the City of Lynwood, giving the exact location and number and type of such coin operated. machines. It shall be the duty of the License Collector to permanently affix proper identification stickers to each such machine so licensed. No license issued for said machines shall be transferable from one machine to another unless permission to do so has first been obtained from the License Collector. Section 4.05. Contractors, 1. Contractor, General. $50.00 per year or $25.00 semi= annually, at the option of the licensee, for every person, firm, or corporation conducting, managing, engaged in, or carrying on the business of General Contracting, whether or not as an established place of business in the City of Lynwood, 2, Contractor, Electrical. $50.00 per year or $25.00 semi-annually, at the option of the licensee, for every person, firm, or corporation conducting, managing, engaged in, or carrying on the business of installing, maintaining, altering, or repairing of electrical wiring, equipment apparatus, or fixtures, whether or not as an established place of business in the City of Lynwood. 3. Contractor, Plumbing, $50.00 per year or $25.00 semi- annually, at the option of the licensee, for every person, firm, or corporation conducting, managing, engaged in, or carrying on the business of installing, altering, maintai~ngor repairing of plumbing and ga.s equipment, pipes, apparatus, or fixtures, whether or not as an established place of business in the City of Lynwood. 4, Sub-Contractor, $25,00 per year or $12.50 semi- annually, at the option of the licensee, for every person, firm, or -14- corporation conducting, managing, engaged in, or carrying on the business of sub-contracting, whether or not as an established place of business in the City of Lynwood. Sub-contracting shall include installing, altering, maintaining, and/or repairing the following; Accoustical Alarm and Time Systems Awnings Boilers, Hot Water Heating, Steam Fitting Cabinet and Mill Work Carpentry Cement and Concrete Electric Signs Elevator Installation Excavating, Grading, Trenching, Paving, Surfacing Fencing Fire Protection Engineering Flooring Glazing Heating, Ventilating, Air Conditioning House and Building Moving , Insulation Landscaping Lathing Linoleum Masonry Metal Sash and Doors Ornamental Metals Painting, Decorating, and Paperhanging Plastering Rig Building Roofing Sewer, Sewage Disposal, Drain, Cement Pipe Laying Shades, Venetian Blinds Sheet Metal Sign Painting and/or Writing Soil Tests Sprinkler Systems Steel, Reinforcing and Structural Structural Pest Control Tile Waterproofing Welding Well Drilling Wrecking and/or Demolition Classified Specialists Section 4.06. Delivery. 1. Delivering Foodstuffs at Wholesale to Established Businesses. $25.00 per year per vehicle for every person, firm, or corporation managing, conducting, or carrying on the business of -15- delivering from a vehicle any roods or other edibles intended for use as food for human consumption, exclusively at wholesale, to any established place of business, for resale to oustomers.or for use by said established place of business in the conduct of their businesso 2~ Delivering Other than Foodstuffs at Wholesale to Established Businesseso $15000 per year per vehicle for every person, _ firm, o:r corporation managing, oonduoting, or oarrying on the business of.' deliver'°ing from a vehi.ele any goods, wares, or merchandise, other than foods or other edibles intended for use as food for human oon- sumption, exclusively at wholesale to any established plaoe of business, for resale to oustomers or for use by said established place of business in the conduct of their businesso 3a Del~.vering Gasoline and Other Petroleum. Handcart or Pushcart, $15.00 per year per handcart or pushcart. c. Basket, Tray, or Hand Container, $10.00 per year per person or $2.50 per day per person, at the option of the licensee, carrying such basket, tray, or other container carried by hand. 2. Peddling Dairy Products, Ice Cream, Ice, or Bottled Water at retail. $15.00 per year per vehicle for every person, firm, or corporation peddling at retail any dairy product, ice cream, ice, or bottled. 3. Section 4.11 Personal Finance, Money Lending. $200.00 per year for every person, firm, or corporation conducting, managing, or carrying on the business of loaning money, advancing credit, or loaning credit, whether or not security of any kind is taken for such loan or advance, or purchasing or discounting of any obligation of money due or to become due, or any evidence of any obligation of noney due or to become due. Soliciting, le $100,00 per year per person, or $25x00 per quarter per persons or $5000 per day per persons at the option of the licensees for every persona firma or corporation managingg oondu,oting, or oarrying on the business of sobicitingo 20 Soliciting - Magazine Subsoriptionsa $15.00 per year per persona or $5000 per quarter per person, at the option of the licensee, f°or every person, firma or corporation soliciting sub- scriptions for any book, set of booksa anagazines, newspa.persa or other literature, -18- Section 4.16. Shoe Shine Stands. $4.00 per year for every person engaged in the business of operating or maintaining a shoe shine stand or parlor. Section 4.17. Armored Car Service, Parcel Delivery, Transfer, Moving, and/or Trucking. $15.00 per year for every person, firm, or corporation collecting or delivering any money, baggage, freight, household goods, or other articles of merchandise, building materials, or other materials not otherwise specifically covered elsewhere in this ordinance, whether or not such vehicles operate over a defined or undefined route. Section 4.18. Taxi Drivers. $2.00 per year for every person engaged in the occupation, whether as owner or not, or driving any automobile or taxicab for hire. Section 4.19. Auto Wrecking Yards. $100.00 per year for every person, firm, or corporation managing, conducting, or carrying on the business of an automobile wrecking yard or otherwise dealing in buying or selling of wrecked or junked automobiles or their parts. Application filing fee $300.00. 3. Carnival, Circus, Rodeo, or Itinerant Show. $100.00 per day for every person, firm, or corporation managing, conducting, or carrying on any carnival, circus, rodeo, or itinerant show. Application filing fee $5,00. 4 Similar Nature. $100.00 per month or $25.00 per day, at the option Closing-Out, Bankrupt, Fire Sales, and Sales of a of the licensee, for every person, firm, or corporation managing, conducting, or carrying on any closing out sale, going out of business sale, bankrupt sale, or any sale of a similar nature where it is advertised or represented to convey to the public the belief that the sale will be for the disposal of goods, wares, or merchandise and the business will cease or discontinue, or to any sale of goods, wares, or merchandise damaged by fire, smoke, or water. Provided, however, that the provisions of this section shall not be construed to include any person, firm, or corporation that has been engaged in business in the City of Lynwood continuously £or a period of not less than one year and that said closing out, bankrupt, or similar sale is for the purpose of disposing of his stock on hand and of closing out his business, or to where goods, wares, or -21- merchandise have been actually damaged by fire, smoke, or water within the City of Lynwood. The applicant shall, at the time for making such appli- cation for a special permit, submit a notarized inventory including date of purchase of the goods, wares, or merchandise to be sold at said proposed sale. No other articles, other than the bona fide. part of the applicants stock in trade and listed on the origin- ally submitted inventory list may be brought in for said proposed sale. No permit shall be granted for more than 60 days for the purpose of conducting said sale. The provisions of this section shall not be construed to apply to any public officer selling any goods, wares, or merchan- dize under or pursuant to any order of any court, commission, or other legal authority. Application filing fee $50.00. 5. Dance Halls, Dancing Clubs, and Public Danc $250.00 per year for every person, firm, or corporation managing, conducting, or carrying on the business of operating any public dance hall, dancing club, or any public dance. Nothing herein contained shall be construed as abrogating or repealing the provisions of any present or future ordinance or regulation dealing specifically with said types of business, or as interfering with any present or future regulatory ordinance, regulation, or requirement made or adopted with reference to said. types of business. Home Occupations. $15.00 per year for every person managing, conducting, or carrying on any business within the home at any location within the City of Lynwood by the occupant as a secondary use in connection with which there is no display of stock in trade maintained on the premises and no persons employed. Dealers The license fee shall be 'as provided. in Chapter IV, Section 4.08 for every person, firm, or cor- poration, the major portion of whose business constitutes, the buying, selling, or otherwise dealing in second-hand goods, wares, or merchandise. Nothing, however, herein contained sha11 be construed as abrogating or repealing the provisions of any present or future ordinance or regulation dealing speoifically with said. type of business. Rubbish Disposal $400.00 per° year far every person, firm, or corporation. managing, conducting, or carrying on the business of soliciting for and oallecting, removing, and disposing of refuse and rubbish. 2~e provisions of this section shall not apply to any person, firm, or corporation with whom the City of Lynwood has entered. into, or may hereafter enter into a oontraot for the colleotion, removal, and disposal o~ garbage, trash, or rubbish, nor shall the provisions of this section prahibit any owner from removing his own garbage, trash, or rubbish. Application filing fee X5.00. Section 5.04. Revocation of Special Permits. The City Council hereby reserves the right to revoke any speeial permit which it may have authorized or granted under the provisions of this chapter at any time upon either written request of the Lieense Collector, Chief of Police, or City Manager of said. airy, stating his reasons fbr such revocation, or upon the Councils own motion. Suoh request for revocation shall be in writing and filed''in the office of the City Clerk for presentation to the City Council. 1. Upon receipt of any such written request for revocation or upon the action of the City Council, the City Clerk shall serve or cause to be served. a notice of said request for revocation 'upon the holder of suoh permit, and at the time of service of such notice upon the permit holder, give notice of the time and~plar<e for d public hear°ing upon the question of such requested revocati'on'. 2. Such notices Wray be given by either serving the same upon the permit holder personally or by registered. mail to the permit holder at the address shown on the application. Such hearing shall be held at the next regular meeting of the 'City Council. The decision of the City Counoil shall be final and oonclusive. -26- CHAPTER VI PENALTIES AND VALIDITY OF ORDINANCE Section 6.00. Penalty for Violation. Any person, firm, or corporation violating any of the provisons of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be punishable by a fine of not to exceed $500,00 or imprison- ment in the city ,jail of the City of Lynwood or the Los Angeles County Jail, State of California, for a period of time not to exceed six months, or by both such fine and imprisonment. Each such person, firm, or corporation shall be deemed guilty of a separate offense for every day during any portion of which violation of any provision of this ordinance is committed, and continued, or permitted by such person, ~?irm, or corporation,/shall be punishable therefor as provided by this ordinance. Section 6.01. Validi of Ordinance. If any chapter, section, sub-section, sentence, clause, phrase or portion of this ordinance is for any reason held to be invalid or unconstitutional by the decision of any court of competent ,jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council of this City hereby declares that it would have adopted this ordinance and each chapter, section, sub- section, sentence, clause, phrase, or portion thereof, irrespective of the fact that any one or more chapters, sections, sub-sections, clauses, phrases, or portions be declared invalid or unconstitutional. Section 6.02. Repeal. Ordinances Nos. 418, 425, 438, 480, 482, 486, 510, 532, 562, 584 of this City are hereby repealed, and all ordinances or parts of ordinances in conflict with or inconsistent with the provisions of this ordinance are hereby repealed, except that this repeal shall not affect or prevent the prosecution or punishment of any person for any act done or committed in violation of any ordinance hereby repealed prior to the taking effect of this ordinance.
