ORDINANCE NO. 1983-112 .
AN ORDINANCE AMENDING THE ZONING ORDINANCE NO. 1979-83 .OF THE
. MUNICIPAL CODE OF TIFFIN, IOWA, BY CHANGING THE USE REGULATIONS„
OF CERTAIN PROPERTY FROM R-1 SINGLE FAMILY RESIDENTIAL TO A2
RESTRICTED AGRICULTURAL USES.
BE IT ENACTED' BY THE CITY COUNCIL OF TIFFIN, ,.IOWA:
• SECTION I . Purpose: The purpose of this ordinance is to
• amend the zoning map of the zoning ordinance 1979-83 of the
Municipal. Code of Tiffin, Iowa, by changing the use
classification of the real estate described in Section II , ., from'° -
R-1' Single Family Residential to A2 Restricted Agricultural Uses
SECTION II . Amendment. The lot hereinafter described shall
be zoned as follows : •

Agricultural Uses, the following' lot: ' ,
Commencing at a concrete nail found at the . South .
Quarter corner of Section 28, Township 80 North, .
Range 7 West of the 5th Principal -Meridian; Thence
NO°00 ' 00"E, (an assumed bearing) along the West ' ,
• line of the Southeast Quarter of said Section 28,
630 . 45 feet; Thence N87°40 ' 24"E, 433. 31 feet, to a
point which is 50 . 00 feet normally distant •.
Northwesterly of the- centerline of the Main
trackage of the Chicago Rock Island and Pacific

Railroad Company, and which point is the Point of
Beginning; Thence N2°19 ' 36"W; 100. 00 feet, to a -
point on the Southeasterly line, of .Railroad .
Street; Thence N87°40 ' 24."E, 290. 00 feet, along
said Southeasterly line; Thence. S2°19 ' 36"E, 100.00-
feet, to a .point which is 50. 00 feet normally -.F` •
-distant Northwesterly of said Railroad centerline;,

Beginning. Said tract of land contains 0.66 " `
acres, more or less , and is subject to easements., ,.

. SECTION III . Authorization: The mayor or other appointee
of the City Council is hereby authorized and directed to change
r the zoning map of the City of Tiffin, Iowa, which was duly
recorded in Book 19, page 53 , Records of Johnson County, to
conform to this amendment upon final passage, approval , and •
.. publication of the ordinance as provided -by law. `
SECTION IV. Certification: The City Clerk is hereby' ,
authorized and directed to certify a copy of this ordinance to
the County Recorder of Johnson County, Iowa, upon final Ipassage,
approval , and publication as provided by law.

SECTION V. Repealer: All ordinances or parts of ordinances
in conflict with the provisions of this ordinance are repealed.
SECTION VI . Savings Clause: , If any section, provision --or
part of this ordinance shall be adjudged to be invalid or
unconstitutional , such adjudication shall not affect the validity .
. of the ordinance as a whole,. or any section, provision, or part
thereof not adjudged invlaid or unconstitutional .
SECTION VII . Effective Date: This ordinance shall be
. effective after its final passage, approval , and publication as;_
provided by law. ,._
On the 13 day of May , 1983, at a regular
meeting of the Tiffin City Council , Tiffin, Iowa, "Councilperson
Cox introduced Ordinance No. 112 , and moved that it
be given its first reading. The motion was seconded by
Councilperson Stevens . Ayes: Cox, Stevens, -.Spivey,
Rohret .
Nayes:
Motion carried. . Absent: Brown.
The reading of the ordinance was completed and discussed and
placed on record. .
A motion was made by Councilperson Rohret to
adopt Ordinance # 112 and seconded by ,Councilperson .
Spivey . Ayes: Cox, Stevens, Spivey, Rohret . . '
Nayes: . Motion carried. Absent: Brown
On the 1-3 day of May , 1983 , at a regular
meeting of the City Council of Tiffin, Iowa, with a majority of
. the Council members present, Councilperson Stevens
moved that the rule requiring a second and third reading and
reading on three different dates be dispensed with. This motion ,
was seconded by Councilperson • Cox .
Ayes : Cox. Stevens. Spivey. Rohret
Nayes: • A
Motion carried. Absent:, Brown. 4 , .
Whereupon the Mayor declared that Ordinance No. . 112 be
adopted and signified his approval of the same by fixing .his
signature thereto.
