AN ORDINANCE AMENDING ORDINANCE NO. 62 RELATING TO THE
WATER SYSTEM SO AS TO ELIMINATE PAYMENT OF A WATER
DEPOSIT.
BE IT ENACTED by the City Council of the City of Tiffin:
SECTION 1. Section 4 of Ordinance No. 62 is hereby repealed
and the following Section 4 is enacted in lieu thereof:
SECTION 4. The rates and charges hereinbefore
prescribed shall be assessed against each premises , tenement
or other place served and shall be paid by the owner of such
premises , tenement or other place. If the owner of the
building differs from the owner of the real estate, bills
shall be paid by the owner of real estate. Any such rates
and charges which are not paid by the owner shall continue
to be a lien and assessment against the property served, and
may be collected in the same manner as property taxes. Said
rates and charges shall be paid by all persons , corporations
and other consumers, including said Town, and no free
service shall be supplied to any premises, tenement or other
place.
SECTION 2. Repealer. All ordinances or parts of ordinances
in conflict with the provisions of this Ordinance are hereby
repealed.
SECTION 3. Severability. If any section, provision, or
part of this Ordinance shall be adjudged to be invalid or uncon-
stitutional , such adjudication shall not affect the validity of
the ordinance as a whole, or any section, provision, or part
thereof not adjudged invalid or unconstitutional .
SECTION 4. Effective Date. This Ordinance shall be in
effect after its final passage, approval , and posting as provided
by law.
On the 10th day of . August , 1.983, at a regular
meeting of the Tiffin City Council , Tiffin, Iowa, Councilperson
Spivey introduced Ordinance No. 113 , and moved that it
be given its first reading. The motion was seconded by
Councilperson Cox . Ayes: Cox; Brown,
Spivey, Rohret, Stevens

Motion carried.
The reading of the ordinance was completed and discussed and
placed on record.
A motion was made by Councilperson Spivey to
adopt Ordinance # 1983-113 and seconded by Councilperson Cox
. Ayes: Cox, Brown, Spivey, Rohret, Stevens

On the 10th day of August , 1983 , at a regular
meeting of the City Council of Tiffin, Iowa, with a majority of
the Council members present, Councilperson Stevens
moved that the rule requiring a second and third reading and
reading on three different dates be dispensed with. This motion
was seconded by Councilperson Spivey
Ayes: Cox, Brown, Spivey, Stevens, Rohret
Nayes:
Motion carried.
Whereupon the Mayor declared that Ordinance No. 113 be
adopted and signified his approval of the same by fixing his
signature thereto.
Passed by the Council on the 10th day of August
1983 , and approved by the Mayor on the 10th day of August
1983.

I , Clerk of the City of Tiffin, Iowa, state that an
Ordinance entitled AN ORDINANCE AMENDING ORDINANCE NO. 62
RELATING TO THE WATER SYSTEM SO AS TO ELIMINATE PAYMENT OF A
WATER DEPOSIT, and known as1983-113 was duly passed by
the Council on the 10th day of August , 1983, and
signed by the Mayor on the 10th day of August , 1983,
and published on the 15th day of August , 1983 , by
posting copies thereof in three public places within the limits
of the City of Tiffin, Iowa.
