AN ORDINANCE AMENDING ORDINANCE NO. 83, RELATING TO ZONING BY DECREASING
THE REAR 'AT REQUIREMENTS FOR R-1 ZONES AND BY CHANGING THE CONDITIONS
UNDER WHICH BUILDING PERMITS ARE REQUIRED.
SECTION 1. Section 17 of Ordinance No. 83 is hereby repealed and the
following Section :17 is enacted in lieu thereof:
Section 17;. Lot Requirements. The following 'lot sizes shall be
required for ,each district as follows and in addition, each lot
shall have :=1, front, ,sider)and,Trear yards not less than the following
ollowing
depth and width per district.
R-1 District

Lot size - 90' x 140'
Front yard - 25'
Rear yard - 10' - escept where an adjacent alley is available
the requirement shall be 5'
Side yards - 9'
R-2 District
Lot size - 90' x 140'
Front and rear yard - 25'
Side yards - 5'
R-3 District
Lot size - 90' x 140'
Front and rear yards - 25'
Side yards - 5'
TC District
Lot size - 3,000 sq. feet - single trailer
5,000 sq. feet - double trailer
Front and rear yards - 20 feet
Side yards - 10 feet

Lot size - 35' x 35'
Front and rear yards - none
Side yards - none
M-1 District
Lot size - 60' x 100'
Front and rear yards - 25' front yard
Side yards - none

SECTION 2. Section 20 of Ordinance No. 83 is hereby repealed and
the following Section 20 is enacted in lieu thereof:
SECTION 20. Permits and certificates of occupancy. No land
shall be used or occupied, and no building hereafter enacted,
altered or extended, shall be used or changed in use, until a
certificate of occupancy and a building permit shall have been
issued by the mayor or other appointee of the city council in
accordance with the provisions of this ordinance and the
building code. �
Notwithstanding the previous paragraph, building permits shall
not be required for buildings; which are not situated on footings,
a permanent foundation or in excess of 168 square feet. In
addition, a building-- permit is not required fora mobile located
in a mobile home park which has been established in compliance
with Ordinance 1980-93.
SECTION 3. Section 8(4) is hereby repealed and the following Section 8(4)
is enacted in lieu thereof:
Section 8(4). In residential and commercial zones, one building
in addition to the primary building may be erected upon the lot
provided it is an accessory building to the primary use and it
is only constructed in conformance with the building permit
requirement contained in Section 200f this ordinance. In no
event, shall more than one accessory building be constructed
in residential and commercial areas.
SECTION 4. Repealer All ordinances or parts of ordinances in conflict
with the provisions of this ordinance are hereby repealed.
SECTION 5. Severability. If any section, provision or part of
this ordinance shall be adjudged to be invalid or unconstitutional,
such adjudication shall not affect the validity of the ordinance as
a whole, or any section, provision, or part thereofInot adjudged
invalid or unconstitutional.
SECTION 6. Effective Date This Ordinance shall be in effectl'after
its final passage, approval, and posting as provided by law. 1

Spivey introduced Ordinance No. 1983-115 t , and moved
that it be given its first reading. The motion was seconded by
Councilperson Rohret . Ayes: Cox, Brown,
Spivey, Rohret, Stevens . Nayes:
Motion carried
The reading of the ordinance was completed and discussed and

A motion was made by Councilperson Spivey to
adopt Ordinance # 115 and seconded by Councilperson
Rohret . Ayes : Cox, Brown, Spivey,
Rohret, Stevens
Nayes: . Motion carried.
On the 14th day of September , 1983 , at a regular
meeting of the City Council of Tiffin, Iowa, with a majority of
the Council members present, Councilperson Cox
moved that the rule requiring a second and third reading and
reading on three different dates be dispensed with. This motion
was seconded by Councilperson Stevens

Motion carried.
Whereupon the Mayor declared that Ordinance No.115 be
adopted and signified his approval of the same by fixing his
signature thereto.

thereof in three public places within the limits of the City of
Tiffin, Iowa.
