A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
TEMPLE CITY ADOPTING REGULATIONS FOR CANDIDATES
FOR ELECTIVE OFFICE PERTAINING TO COSTS OF
MATERIALS SUBMITTED TO THE ELECTORATE FOR THE
GENERAL MUNICIPAL ELECTION TO BE HELD ON TUESDAY,
APRIL 13, 1982
WHEREAS, Section 10012 of the Elections Code of the State: of Cali -
fornia provides that the governing body of any local agency adopt
regulations pertaining to materials prepared by any candidate for a
municipal election, including costs thereof; and
WHEREAS, Resolution No. 81 -2031 limits the Candidate Statement to
not more than 200 words, and Resolution No. 81 -2032 prohibits a candi-
date from preparing separately other materials to be sent to each voter
in addition to the sample ballot, the voter's pamphlet, and the candi-
date's statement:
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TEMPLE CITY,
CALIFORNIA, DOES HEREBY RESOLVE,` DECLARE, DETERMINE AND ORDER AS FOLLOWS:
SECTION 1...Pursuant to Section 10012 of. the Elections Code of the
State of California, each candidate who prepares a candidate's statement
on an appropriate form provided by the City Clerk shall not include the
party affiliation of the candidate, nor membership or activity in parti-
san political organizations. Such statement shall be filed in the office
of the City Clerk at the time the candidate's nomination papers are filed.
Such statement may be withdrawn., but not changed, during the period for
filing nomination papers and until 5 p.m. of the next working day after
the close of the nomination period.
SECTION 2. Under requirements of the 1975 amendments to the Federal
Voting Rights Act, the City Clerk shall arrange to provide translation
of these ballot materials into the Spanish language. A translation of
these ballot materials may be obtained in person at the City Clerk's
office in the City Hall or, if requested by letter or telephone, a trans-
lation will be promptly mailed.
SECTION 3. The City Clerk shall estimate the total cost of printing,
handling, translating, and mailing the candidate's statements filed pur-
suant to the Elections Code, and require each candidate filing a state-
ment to pay in advance his or her pro rata share as a condition of having
his or her statement included in the voter's pamphlet. The City Clerk
shall bill each candidate for any cost in excess of the deposit and
shall refund any unused portion of any deposit.
SECTION 4. The City Clerk shall provide each candidate or the
candidate's representative a copy of this Resolution at the time
nominating petitions are issued.
SECTION 5. The City Clerk shall certify to the passage and adoption
of this Resolution; shall enter the_same in the book of original Reso-
lutions of said City; and shall make a minutes of passage and adoption
thereof in the records of the proceedings of the City Council of said
City, in the minutes of the meeting at which the same is passed and adopted.
