Currently, the soil and erosion measures that are in place are inadequate to such an extent that there are both upstream and downstream erosion concerns existing. Stabilization to this site is required within five (5) days of the receipt of this letter. If this matter is not corrected within that timeframe, this matter will be turned over to the City Marshal for proper enforcement actions, which can result in a citation for failure to comply. It is my understanding that at least one of those has not made correction or responded. In the Spring of last year, the CM called the Chief, Joe and I into her office to discuss the process of taking violators beyond the notification of deficiency. I cannot remember is D.Otto or Chuck were in the meeting. Let me advise you of my understanding of the process. I note any violations in my inspection. The LDAP holder is notified initially verbally and if correction is not made promptly in writing by certified mail. (d) When a violation of this chapter in the form of taking action without a permit,failure to maintain a stream buffer, or significant amounts of sediment, as determined by the local issuing authority or by the director or his or her designee, have been or are being discharged into state waters and where best management practices have not been properly designed, installed, and maintained, a stop work order shall be issued by the local issuing authority or by the director or his or her designee. All such stop work orders shall be effective immediately upon issuance and shall be in effect until the necessary corrective action or mitigation has occurred. Such stop work orders shall apply to all land-disturbing activity on the site with the exception of the installation and maintenance of temporary or permanent erosion and sediment controls. Sediment has migrated further into the grass buffer upstream of the marsh to the east. These deficiencies need to be addressed immediately. Your prompt attention to the deficiencies noted is required to allow your site to be in compliance with the City of Tybee Island Land Development Code. Future inspections will determine your compliance. Haywood F,ye called to report that the Co at 8 Seventeenth Street has been extended with rock as requested. Corrective action acceptable. No new deficiencies noted 2. John Barr is ready for inspection at 1602 Jones Avenue. This one just needed the Co to be added since your first visit. Co was mostly completed. The Co was completed from the edge of the pavement into the project around 10'. The rest of the Co stone was in place but just needed to be graded down further(it was around 1-1.5'high) once some equipment inside the site was moved. I recommend this one be released. 3. Could you revisit the 4 sites that received violation letters and then discuss with Jonathan what enforcement measures he would want to use? The locations are: 17 Izlar Avenue, 13 Eighteenth Street, 19 Pine Street, and 1230 A &B Solomon Avenue. Izlar deficiencies had been corrected. Mack advised that the best way for us to notify him in the future was mackkitchens@comcast.net. 13 18th Street has not been corrected. 19 Pine Street has not been corrected. 1230 A&B Solomon Avenue deficiencies have been corrected. 4. An invoice for the ice machine is needed. Sent under separate cover. 5. The walkway/patio work at 8 Palmwood Court is finished. Could you please recertify the drainage at the site? Attached. Also, I have underlined the portions that are applicable in the case of Tommy Clark on Pine Street. I spoke with Dusty Williams with Dixie several times about this matter. Dusty is with Dixie, the company that did the work. At least a month age I recommended to Dusty that he offer to Tommy Clark services to correct the deficiency. On Friday, I spoke with Dusty one last time on this matter. Dusty advised that Tommy had told him he had maintenance workers who could perform this work. If Tommy did not respond to your notice by certified mail, I am not aware of any responsible alternative to the City proceeding further with enforcement action. It is my understanding the next step is to proceed with assessing a civil penalty. I have underlined and used bold at the end of the pasted sections to highlight our limited options. I imaging, as other municipalities have done, Tybee will want to confer with their atty. as they first enter the legal arena for erosion control enforcement. If the person engaged in the land-disturbing activity fails to comply within the time specified,he shall be deemed in violation of this ordinance. B. The department of zoning/public works shall have the power to conduct such investigations as it may reasonably deem necessary to carry out duties as prescribed in this ordinance, and for this purpose to enter at reasonable times upon any property, public or private, for the purpose of investigation and inspecting the sites of land-disturbing activities. 1 C. No person shall refuse entry or access to any authorized representative or agent of the issuing authority, the commission, the district, or division who requests entry for the purposes of inspection, and who presents appropriate credentials, nor shall any person obstruct, hamper or interfere with any such representative while in the process of carrying out his official duties. Sec. 15-070. Penalties and incentives. A. Failure to obtain a permit for land-disturbing activity. If any person commences any land-disturbing activity requiring a land-disturbing permit as prescribed in this ordinance without first obtaining said permit, the person shall be subject to revocation of his business license, work permit or other authorization for the conduct of a business and associated work activities within the jurisdictional boundaries of the issuing authority. For the purpose of enforcing the provisions of this ordinance, notwithstanding any provisions in any city charter to the contrary, municipal courts shall be authorized to impose penalty not to exceed $2,500.00 for each violation.Notwithstanding any limitation of law as to penalties which can be assessed for violations of county ordinances, any magistrate court or any other court of competent jurisdiction trying cases brought as violations of this ordinance under county ordinances approved under this ordinance shall be authorized to impose penalties for such violations not to exceed $2,500.00 for each violation. Future lot development will probably require a wider driveway, as I have not seen any new driveways much less than the 25'maximum width. The culvert appears to be unnecessarily in front of the property to the west. We normally do not allow drives to be located beyond the projection of the side lot line. As this is City ROW, I leave that to others. Should the City require the drive to be moved eastward, I doubt my involvement would be required in that matter. This site has been unstable for over 15 days. Stabilization is required at this time. The plan review to address the alignment took only a few minutes and no further design bill will occur. The proposed project will be the construction of a new residential drive pipe for access to a future residential structure and will have a permeable driveway. The total site is approximately 0.05 acres with the new project being approximately 0.02 acres disturbed. Detention will not be required for this project. The soils in this area have been classified by the Soil Conservation Service as being CuC ( Chipley Urban Complex).
