R , .� • It b 2 § ti A BE IT ENACTED BY THE COUNCIL OF TIFFIN, IOWA: SECTION I . Purpose. The purpose of this ordinance is to amend the present City of Tiffin Ordinance No. 83 so as to establish a minimum width for dwellings constructed in residential districts and to allow the placement of certain manufactured homes within the residential districts of the City of Tiffin. SECTION II . Amendment. Sections 17 through 27 of the existing Ordinance No. 83 are hereby renumbered Sections 19 through 29 consecutively. Furrtherofthee 0 owing sec sections snali be numbers I7 an City of Tiffin Zoning Ordinance: Section 17. Minimum Building Width. The following shall be the minimum dimensions for each zoning district listed below and no dwelling shall be less than the stated minimum width: Ri District - 20 feet width for at least 75% of the building length. R2 District - 20 feet width for at least 75% of the building length. R3 District - 20 feet width for at least 75% of the building length. Section 18. Manufactured Homes. A manufactured home is defined in Iowa Code Section 414 .26 (1983) (S.F. 2228 1984) and 42 U.S.C. Sec. 5403 may be located in districts R1 , R2 , and R3 so long as such manufactured home complies with all of the other requirements of this zoning ordinance and provided that (a) it is used for human habitation, (b) it is not constructed with or equipped with a permanent hitch, (c) it is not equipped with axles and wheels, and (d) it is converted to real property as provided by Iowa Code Section 135D.26 (1983) . SECTION III . Repealer. All ordinances or parts of ordinances in conflict with the provisions of this Ordinance are hereby repealed. SECTION IV. Saving Clause. If any part, portion, or provision of this Ordinance shall be adjudged to be invalid or unconstitutional , such adjudication shall not affect the validity of this Ordinance as a whole, or any Ordinance No. 1983-126 Page 2 section thereof which has not been adjudged invalid or unconstitutional . SECTION V. When Effective. This Ordinance shall be effective upon compliance with the provisions of Section 23 of Ordinance No. 83 as delineated prior to this amendment. Its adoption was moved by Councilman Spivey and seconded by Councilman Morgan On roll call vote Councilmen Cox, Kobold, Morgan, Spivey voted "Aye. " "Nays. Stevens Absent. Whereupon the Mayor declared the motion carried. Councilman Spivey then moved that the rule or law requiring three readings of this ordinance on three different dates be dispensed with.
