ORDINANCE NO. 1985-127
AN ORDINANCE AMENDING ORDINANCE NO. 83 OF THE ORDINANCES OF TIFFIN, IOWA,
FOR THE PURPOSE OF PLACING TIME LIMITATIONS ON THE VALIDITY OF BUILDING
PERMITS AND CERTIFICATES OF OCCUPANCY ISSUED PURSUANT TO THE TERMS OF
ORDINANCE NO. 83.
BE IT ENACTED BY THE CITY COUNCIL OF TIFFIN, IOWA:
SECTION I. Purpose. The purpose of this ordinance is to amend the
present City Ordinance No. 83 so as to establish limitations of time for
the validity of building permits and 'certificates of occupancy issued
by. the City of Tiffin.
SECTION II. Amendment. Section 20 of Ordinance No. 83 of the City
of Tiffin Ordinances is hereby amended by adding the following to the
existing paragraph.
Any building permit or, certificate'.ofooacupancy issued pursuant
to this section shall be valid for a perid of one year following
its issuance. Any building project or occupancy which is not
commenced within one year of the date the Council approves the
issuance of the building permit or which is not completed within
two years of the date the Council approves the issuance of the
building permit shall require the party applying for the permit
to make a new application for the project or occupancy contemplated.
All building permits or certificates of occupancy outstanding as of
January 7, 1985 shall be deemed to have been issued on January 7, 1985
for the purpose of this section.
SECTION III. Repealer. All ordinances or parts of. ordinances in
conflict with the provisios of this Ordinance are repealed.
SECTION IV. Saving Clause. If any part, portion or provision of
thia Ordinance shall be adjudged to be invalid of unconstitutional,
such adjudication shall not affect the validity of the Ordinance as a
whole, or any part, portion or provision thereof not adjudged invalid
or unconstitutional.
SECTION V. When Effective. This Ordinance shall be in effect after
its final passage and approval as provided by law.
Passed the the Council on this 7th day of January, 1985, and approval
on this 7th day of January, 1985.

Councilman Kobold introduced the foregoing Ordinance which was
then duly read and considered by the Council. Its adoption was moved
:. by Councilman Kobold and seconded by. Councilman 'Spivey
On roll call vote Councilman Cox, Kobold, Morgan, Spivey, Stevens
voted "Aye". "Nay'.. Mayor declared motion carried.

Councilman Kobold then moved that the rule or law requiring three
( readings of this Ordinance on three different dates be dispensed with.
Seconded by Councilman Stevens . On roll call vote Councilman ,
Cox, Kobold, Morgan. Spivey. Stevens vtoed "Aye" . "Nay" .
The Mayor then declared Ordinance No. 1985-127 duly passed and adopted
on this 7th day of Janaury, 1985.

The foregoing ordinance entitled AN ORDINANCE AMENDING ORDINANCE NO, 83
OF THE ORDINANCES OF TIFFIN, IOWA, FOR THE PURPOSE OF PLACING TIME
LIMITATIONS ON THE VALIDITY OF BUILDING PERMITS AND CERTIFICATES OF
OCCUPANCY ISSUED PURSUANT TO THE TERMS OF ORDINANCE NO. 83 was published
on the 15th days of January, 1985 by posting copies thereof in three
public places within the limits, two. of which are the mayor's office and
the post office.
