The Georgia Environmental Protection Division administers the rules. In most cases, the rules require both the owner and the involved contractors to assure the portion of the building involved in the project is thoroughly inspected by an Accredited Asbestos Inspector for materials that contain asbestos; and the removal of the asbestos before renovation, wrecking, or demolition begins almost without exemption. Georgia EPD requires a completed demolition notification from be submitted 10 workings days in advance even if no asbestos is present in the building. Your request includes construction of a stairway on the south side of an existing residence. The stairway will be construction on an existing concrete pad with no new impacts to the jurisdictional area. Concrete pavers will be placed over the existing mowed lawn connecting the new stairs (on the southern side) to the existing sidewalk on the eastern side of the residence. No impacts are proposed in the dunes. The Department authorizes the construction and maintenance of the stairway and pavers as depicted in the attached drawing. Please contact staff to determine placement of the pavers prior to installation. You must use all appropriate best management practices to protect the habitat and dune system. This Letter of Permission is not meant to exempt the above referenced activity from future environmental laws. No construction materials may be disposed of or stored in jurisdictional areas. Any incidental impacts the sand sharing system associated with this project must be rectified by fully restoring areas to their pre-construction topographic and vegetative states. This project must comply with all other Federal, State, and local statutes, ordinances and regulations. In addition, during a December 1, 2009 site visit, staff noted that approximately 450 square feet area of protected dune vegetation has been cut to the ground. According to the Shore Protection Act: O.C.G.A. § 12-5-237 (a), "No person shall construct or erect any structure or construct, erect, conduct, or engage in any shoreline engineering activity or engage in any land alteration which alters the natural topography or vegetation of any area within the jurisdiction of this part, except in accordance with the terms and conditions of a permit therefore issued in accordance with this part." Each day of continued violation shall subject said person to a separate civil penalty." To resolve this unauthorized cutting of dune vegetation, the dune area must be allowed to re- vegetate naturally. No cutting pruning or mowing is permitted in the dunes at any time. Staff will revisit the site to assure that the area has been allowed to re-vegetate. If the area does not re- vegetate naturally you will be required to meet with staff to develop a plan to restore the dune area.
