RESOLUTION ACCEPTING THE STREET PAVING IMPROVEMENTS IN WOODS
ESTATES, PHASE III, WITH CONDITIONS
WHEREAS, the City of Riverdale, Iowa ("City") is a municipal corporation, organized and operating under
the laws of the State of Iowa; and,
WHEREAS, the City's Engineer, Chris Cooper, MSA Professional Services ("Engineer"), has inspected the
street paving improvements in Woods Estates, Phase III, and has recommended acceptance of these
roadways with conditions (Attachment A); and,
WHEREAS, City Council has determined that the following conditions must be met for final acceptance:
• The punch list, except for Mason Drive - Station 116+50, is to be completed prior to the end of
the year;
• The areas of sealant defect, as noted, should be trimmed as soon as possible;
• The City accept a settlement for the acceptance of the non -conforming emergency access path
pavement. Instead of an extended warranty, MSA recommends a financial settlement where the
Developer will pay the City to cover future repairs of several panels in this pavement. At a
potential cost of $90 per square yard for future repairs, MSA recommends a payment of $2,900
from the Developer as an acceptable amount to mitigate possible future damages that may occur
if a large firefighting apparatus ever has to traverse this route;
• The Developer accepts that any observed defects in PCC roadway panels that were cast and then
traveled on before specified strength was reached may be cause to replace the panels near the
end of the warranty period;
• The Developer/Contractor post a bond in the minimum amount of $2,000,000. This warranty
bond should be good for the period of two years; and,
WHEREAS, the street paving improvements being considered for conditional acceptance are highlighted
in green in the attached map (Attachment B) and include:
• Mason Drive from Lot 12 through Lots 50 and 51
• Elizabeth Way at Lots 55 and 56
• Ann Avenue at Lots 67 and 68
• Madison Drive from Lots 70 and 5 through Lot 74 and a portion of Lot 1
• Out Lot A, Public Park Access, between Lots 49 and 50; and,

WHEREAS, City Council has determined that the street paving improvements check marked below are
included in this conditional acceptance;
✓ Mason Drive from Lot 12 through Lots 50 and 51
✓ Elizabeth Way at Lots 55 and 56
✓ Ann Avenue at Lots 67 and 68
✓ Madison Drive from Lots 70 and 5 through Lot 74 and a portion of Lot 1
✓ Out Lot A, Public Park Access, between Lots 49 and 50; and,
WHEREAS, City Council has determined that payment for all expenses related to the remediation of
Phase I I I deficiencies, as listed above, shall be the responsibility of the Developer.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RIVERDALE, IOWA,
THAT:

The street paving improvements for Woods Estates, Phase I II, are conditionally accepted as
having been constructed in substantial compliance with the plans, specifications, plats, and
other documents.
The street paving improvements for Woods Estates, Phase III, will be accepted in -full once
the Engineer is satisfied that the conditions listed above have been met and recommends
same to Council, and by order of the Council, via a separate Resolution.
