All trees with a 6" diameter at 4.5 feet above ground count toward the density count. • Significant trees may be removed only under certain circumstances and must be replaced inch - for -inch in like species with minimum 2 -inch diameter trees or be otherwise mitigated. Allen; Diane Schleicher Subject: RE: sand project 4.40'09 .1 4 -ZI -a Good Morning Dianne - I have looked at the letter & have spoken to Diane Schleicher. I think the city would have had to have done a "zoning letter" in connection with an earlier permit & we can hopefully use that to go by for this one. I do not think the intent of 3 -100 was to address situations like this. I am not certain if this is something that would be covered under the beach management plan. I do agree that a literal reading of 3 -100 would appear to apply to this as it would "alter in any way the beach ", however I do not think a variance is the remedy- the remedy is the permit- if secured. Has DNR marked the jurisdiction yet? It seems obvious it is within the shore protection area & DNR jurisdiction. The bottom line is I think that subject to their obtaining the DNR permit, they would be able to obtain the permission from the city. The zoning letter can be sent- subject to the proof of agency as you point out. That is the way I think this should work but I am open for discussion. Allen; Diane Schleicher Subject: sand project Bubba: I received the attached document yesterday from Stacye (Smith) Jarrell requesting a letter from the City to the DNR stating that the proposed sand project would not violate any zoning ordinances. (I explained to her that the second item requested, a "letter of permission," from the City would not be issued until after a DNR permit or Letter of Permission was obtained, and then it would be in the form of a permit to do the work. By the way, the Agent document referred to on page 2 of Ms. Jarrell's letter was not included with her submission.) The Planning Commission /City Council heard a variance request in November /December of 2006 proposing to remove sand on the back river that was encroaching on homes. It was a variance from Section 5- 010(J) (Shore Protection with Variance Clause). That ordinance has since been repealed (10/09/08). The Planning Commission will hear on 03/16/09 and City Council on 04/09/09 a proposed Text Amendment that would amend Section 3 -100 (Beach, Dune or Vegetation Disturbance) to add language related to a 10 -foot setback from the toe of the landward -most dune. My interpretation of Section 3 -100 is that in both its present and proposed forms it prohibits the type of sand project being requested by Ms. Jarrell. This will require approximately 40 cubic yards of sand. 1 The purpose of this request is to complete the renourishment of the area covering dangerous rocks and holes between the rocks. All trees with a 6" diameter at 4.5 feet above ground count toward the density count. • Significant trees may be removed only under certain circumstances and must be replaced inch - for -inch in like species with minimum 2 -inch diameter trees or be otherwise mitigated. (See reverse side for definition.) • By accepting the Tree Removal Permit, the property owner and the applicant agree to comply with all requirements of the Tree Ordinance including mitigation requirements, planting specifications and tree survival requirements. APPLICATION REQUIREMENTS Scaled plot plan showing location, size and species of all trees on the lot which have a diameter of 6 inches or more at 4.5 feet above ground, all existing improvements, all proposed improvements, and property setbacks.
