HomeMy Public PortalAbout95-005 (01-17-95)RESOLUTION NO. 95 -5 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD AUTHORIZING THE MAYOR TO ENTER INTO MAINTENANCE /HOLD HARMLESS AGREEMENTS WITH CALTRANS AND THE CITY OF SOUTH GATE, AND AUTHORIZING STAFF TO PROCEED WITH THE RELIN- QUISHMENT OF CALTRANS' RIGHT -OF -WAY OVER IMPERIAL HIGHWAY. IMPERIAL HIGHWAY MEDIAN ISLAND PROJECT WHEREAS, the Imperial Highway Median Island Project is listed in FY 1994 -95 Capital Improvement Project list; and WHEREAS, the project encompasses the planting of palm trees and ground cover with irrigation system, and the installation of wrought iron fence and street lighting poles, etc. from Wright Road to the east city limits; and WHEREAS, portions of said median island lie in the City of South Gate and in Caltrans' right -of -way; and WHEREAS, said encroachment requires the City to enter into maintenance /hold harmless agreements with the affected agencies; and WHEREAS, said encroachment also requires that certain Caltrans' right -of -way on Imperial Highway be relinquished to the City of Lynwood. NOW, THEREFORE, the City Council of the City of Lynwood does hereby find, proclaim, order and resolve as follows: Section 1 . That the Mayor is authorized to execute maintenance /hold harmless agreements with Caltrans and the City of ' South Gate for the affected portions of the median island on Imperial Highway, between Wright Road and the east city limits, for the Imperial Highway Median Island Project, Project No. 5 -5153. Section 2 . That staff is authorized to proceed to accept relinquishment of certain Caltrans' right -of -way on Imperial Highway. Section 3 . City Clerk, City of Ly wood C20 -012A J RESOLUTION NO. 95 -6 • RESOLUTION OF THE CITY OF LYNWOOD DECLARING • LOCAL EMERGENCY IN THE CITY OF LYNWOOD CAUSED BY JANUARY 1995 WINTER STORMS WHEREAS, Chapter 2, Section 2 -18 of the City of Lynwood Municipal Code establishes the procedures in addressing a local emergency, when the City is affected or likely to be affected by actual or threatened disaster; and WHEREAS, on January 4, 1995, conditions of extreme peril to the safety of persons and property arose as a result of severe flooding caused by storms throughout Los Angeles County and more specifically, the City of Lynwood, which conditions are beyond the control of local resources; and WHEREAS, the existence of these conditions warrants and necessitates the declaration of the existence of a local emergency. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOOD RESOLVES AS FOLLOWS: Section 1 . The City Council proclaims that a local emergency exists throughout the City of Lynwood, Los Angeles County, and shall be deemed to continue to exist until its termination is proclaimed by the Council. Section 2 . That the City Council directs that a copy of this Resolution be forwarded to the Governor of the State of California with the request that he proclaim the existence ' of a State of Emergency in the City of Lynwood. Section 3 . That the City Council directs that a copy of this Resolution be forwarded to the State Director of the Office of Emergency Services with the request that he find it acceptable in accordance with the provisions of the National Disaster Assistance Act. Section 4 . That the City Council directs that a copy of this Resolution be forwarded to the Board of Supervisors of Los Angeles County. Section 5 . That this resolution shall take effect immediately upon its adoption.
