As a follow up I request a meeting with you and the mayor to discuss the issue of a business license requirement for the owner of a single condo unit that may be rented on occasion. Times are changing and we hope to find a long term tenant. I have some concerns that perhaps you can enlighten me on. I have been told that the Savannah Beach and Racquet Club is being "targeted" as an easy mark. Some have been told that only voluntary compliance is being sought. Another person advised us that they simply ignored a request that they obtain a license and were never contacted again. Are all the property owners in Tybee being sent demanding letters? I feel that there are unequal practices involved here. I am not a lawyer but I believe there are laws that require equal treatment. As I mentioned in previous correspondence with Ms. Otto, I am an 89 year old WW2 vet and need more time to seek possible help on this issue from Veterans' Affairs. Below are the ordinances related to penalties for non - compliance. CHAPTER 58, TAXATION; Sec. 58 -167. Penalty. Any person violating any provisions of this article shall, upon conviction, shall be punished as provided in section 1 -8. (Code 1983, § 3 -2 -62.2) CHAPTER 1, GENERAL PROVISIONS; Sec. 1 -8. General penalty. Whenever in this Code or in any ordinance of the city any act is prohibited or is made or declared to be unlawful or an offense, or whenever in this Code or any ordinance the doing of any act is required or the failure to do any act is declared to be unlawful, where no specific penalty is provided therefore, such violation of any such provision of this Code or any ordinance shall be punishable by a fine not exceeding $1, 000.00, by sentence of imprisonment not exceeding six months and to work on the streets or public works for a period not exceeding 60 days, any or all such penalties in the discretion of the judge. It's just exquisite. Anita Butler is the primary owner (charming and local lady which is nice if you need something.) The house is also owned in part by her sister, Paula Butler Williams of Athens, Ga. The house has separate entrances for the top floor and the lower floor which will separate people very well for privacy if you like. There is DSL and wireless internet if anyone needs it. It's on 14th St., one block to the wonderful and gorgeous A.J.'s seafood restaurant, 3 blocks to Back Beach and pier, and 4 or 5 blocks to 14th St. Beach. Their price starting out is very low to me but that's good for you! :) This would be $290 per night INCLUDING all our high taxes. The one time cleaning, laundry and supply fee is $185...I can't believe our cleaning company does just all the porches for that much less the huge house...and laundry! Everything you need will be there, well done down to luxury 1 linens. Should you wish to make a reservation, we'll just need please: (I sent you this before but as a reminder) 1. The full name to put on the registration form 2. The mailing address 3. Phones..two at least please if you can 4. The exact in and out dates to be SURE we're clear.:) We'll reserve your time immediately on your request! Then we'll send a large guest packet by mail with all you need and much more. It will have two copies of a registration form for you, lots of area information on things to do, directions to your door, your key information, beach regulations, some Savannah area history and a welcome letter with everything you could want to know we believe! Your packet will also contain all contact information for the owner of your property, who will be most glad to help you and hear from you at any time! And..we'll provide a person for you to contact should you have a (rare) repair emergency who is on call. We do not want your experience to be less than the best we can think of to provide! :) I hear horror stories all the time of people who clog a toilet or something and cannot get help! :) AFTER you receive your guest packet, you'll just mail one copy of your lease form and your $250 deposit check to Anita. The (refundable if you can't come) balance would be due just shortly before you arrive and let yourself in with the instructions in your packet. And, if you can't come, all but $250 would be refunded with at least 24 hours' notice before arrival time, and that could be applied to a future time for you! That will be in the paperwork. We can't find anyone else here who will do that! You'll have all contact info for Anita in your packet. (you'd hear from her by email though as soon as you make a reservation.) There was plenty of room for the kids to spread out with their blocks and puzzles in the floor. It was great! We tried to make sure we had everything gathered up and picked up after ourselves. Since I am the primary owner of the property, the letter should have come to me. There are a couple issues 1 would like to have clarified. It is my understanding that the owner of a single property may rent that property without being classified as a business. Will you please send me a copy of any ordinance, or code, that preempts that ruling. I am 88 1/2 years of age and now limited in my personal enjoyment of my Tybee retreat so am contemplating renting my property on a yearly basis. Is there a different interpretation for that activity? On the reverse side of the business application there is an informative note saying that a health inspection is required if there is ice service. Does that include a standard household refridgerator that makes ice cubes? Your help in resolving any misunderstandings would be appreciated. Long -term rentals (by the month or year) are not subject to business license requirements. A health inspection is not required. Sec. 34-28. Definitions. Business means any business, trade, occupation, profession, avocation or calling of any kind for gain or profit, directly or indirectly; provided that this shall not include any business, trade, profession and the like licensed by the state unless city licensing is allowed by state law, nor shall it include any business operating solely under a franchise granted by the city. Engaged in business means any person subject to the requirements of this article when he performs any act of selling any goods or services or solicits business or offers goods or services for sale for payment in an attempt to make a profit, including the sales or services of the character as made by a wholesaler or retailer or involved in any of the functions performed as a manufacturer, either as an owner, operator or agent in any business within this city. Sec. 34 -29. License required. Every business in this city or doing business or engaged in business within the city is required to have a business license from the city for the privilege of engaging in a business, profession or occupation within the corporate limits, unless city licensing is prohibited under state law or the activity is exempted by this Code. The goal of this second notice is compliance. Please remit the enclosed Business License application and the appropriate fees. Also enclosed is a Hotel/Motel Monthly Tax Return. Short-term rentals are required to remit this tax. The ordinance related to this tax can be found in Chapter 58, Taxation, Article IV, Room Excise Tax, at the above referenced website. He sent me a fax that he cannot hear so I am mailing a letter to him. I've identified an owner of another property and will try to contact him on Monday. I'll keep working on it. 1 very rude; I just couldn't help it today. An elderly cousin of mine had a stroke which took time and attention. The house you wrote about isn't open for your dates; I'm sorry. It's not the best choice anyway though for ladies alone I don't think. To stay on the National Register of historic places, it could NOT be allowed to have stairs put in to the lower bedrooms. So, you have to go down the front stairs and outside and in a lattice area. If visiting on the porches after dark, I don't like that idea with no big guys along.:) Let me suggest something else for you. Stu and I are in a group of beach property owners who prefer to rent our lovely second homes full of TLC directly to you rather than turning them over to real estate companies. :) Most of us have tried that and disliked it:). We feel that most vacation rentals managed by agencies are very basic in furnishings,don't offer many if any extras,have very short time limits on cleaning (yuck),offer little personal attention and no contact with the owner host, and are quite expensive! These are our true second homes, by us and our families and friends and kept like "homes." They are NOT just someone's basic, bland investment property. Everyone works together in our group and we have quite a few listings on http : / /www.tvbeerentalsbvowner.com Right now it's my job....a very enjoyable one :)....to coordinate the bookings for the whole group. Our group works VERY :) hard to provide our guests an "above the crowd" experience. The properties in the group are NOT rented stripped, so to speak. Everyone provides linens, paper products, soap, telephones for free unlimited local calls and (it varies by property) many extras the owners like you to have and nice (not rental type) furniture and up to date decorating. I think this is my favorite property even including the one I own.:) LOL It's a gorgeous and quiet spot with the best positioning for watching ship traffic and enjoying uncrowded beach. The owners are two couples and their families from Statesboro, Georgia....about 70 miles west. Debra and Steve Chester and Max and Susan Manack adore their Tybee home and have it decorated so exquisitely and yet comfortably. Their price a large beachfront (rare anyway) house on Tybee is amazingly low. IT's $395 a night then including all applicable taxes! The only other charge would be a one time exit cleaning and laundry fee of $175. Oh...you'll find a "hospitality basket" of things you need on arrival that saves you a good big of hassle and money. People tell us all the 3 time that no one else on Tybee does this, and it keeps you from having to go right out and shop for essentials.:) Should you wish to make a reservation, we'll just need please: 1. Oh..our paperwork will show that if you can't come we'll refund all but $400 with 24 hours' notice before arrival, and even THAT can be applied to a future stay for you! The house is also owned in part by her sister, Paula Butler Williams of Athens, Ga. The house has separate entrances for the top floor and the lower floor which will separate people very well for privacy if you like. There is DSL and wireless internet if anyone needs it. It's on 14th St., one block to the wonderful and gorgeous A.J.'s seafood restaurant, 3 blocks to Back Beach and pier, and 4 or 5 blocks to 14th St. Beach. Their price starting out is very low to me but that's good for you! :) This would be $290 per night INCLUDING all our high taxes. I can understand the requirement for a business license from the City of Tybee for condo owners that run their own rental operations, collect their own money and sign contracts. I do not do any of these. I do not "operate a short-term vacation rental" business. My website on VRBO is strictly to promote leads for my Sandpiper unit (207) which I pass directly to Sandy by the Shore (912- 786 - 0531). I do not collect any money from or sign any contract with renters. 100% of this is done by Sandy. Keys, repairs and house keeping are all also handled locally by Sandy's.
