HomeMy Public PortalAboutOrdinances-1985-132 • Ordinance No. 1985-132 ORDINANCE NO. 1983-132 AN ORDINANCE AMENDING ORDINANCE NOS. 62 AND 63 AND REPEALING • ORDINANCE NO. 72 OF THE MUNICIPAL CODE OF TIFFIN, IOWA,' ESTABLISHING RATES, CHARGES AND RULES FOR THE USE AND SERVICE OF THE MUNICIPAL WATER SYSTEM OF TIFFIN, IOWA BE IT ENACTED by the City Council of the City of Tiffin, Iowa: SECTION I. Purpose: The purpose of this ordinance is to amend Ordinance Nos. 62 and 63 and repeal Ordinance No. 72 of Tiffin, Iowa, establishing payment due date, late^ fee charges, and terms for discontinuance of the use' and service of the municipal water system. ^ ' • / . . SECTION II. Repeal : Section 2 of Ordinance No. 62 and Sections 7 and 8 of Ordinance 'No. 63 and Ordinance No. 72 are hereby repealed. SECTION III. Enaction. The following SECTION 2 is enacted as part of Ordinance No. 62. SECTION 2: Bills shall be dated and mailed on the first business day of each month. The due date shall be • the fifteenth ( 15th) day of the month, unless that date falls on a Saturday, Sunday or legal holiday, in which case, the due date shall be the next regular business day of the month. Bills shall be postmarked on or before the due date, or delivered to the City Clerk on or before the due date, to be considered paid on time. If any bill is not paid on or before the due date, a late fee shall be added thereto in the amount of ten percent ( 10%) of the water fee. If any bills for the services of the system shall remain unpaid after the due date, the account shall be termed deliquent and the Clerk shall send first notice of delinquency to the property owner and the owner shall have one month to pay the account in full. Should the same account become delinquent at any time in the futurei the Clerk shall send final notice of delinquency. Final notice of delinquency shall give the property owner five (5) days ' to pay the account in full. If the account remains unpaid five (5) days after final notice of delinquency, the water supply for the lot, parcel of land, or premise affected, shall be cut off ,and shall not be turned on again except on payment in full of all delinquent charges. In addition, where the water supply to a customer has been discontinued for nonpayment of delinquent water bills, a charge of $25. 00 will be made for reconnection ' of water service and the 'connections will not be made until after all delinquent bills have been paid. The City may also require a deposit of up to $100. 00 at the time of reconnection of service. . . Ordinance No. 1985-132 • SECTION IV. Repealer: ' All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. SECTION V. Severability: If any section, provision or part of this ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not affect the ordinance as a whole,` or any section, provision or part thereof not adjudged invalid or unconstitutional. SECTION VI. Effective Date: This Ordinance shall be in effect after its final passage, approval, and posting as provided by law. Councilman Cox __________ introduced the foregoing ordinance which was then duly read and considered by the Council. Its adoption was moved by Councilman ______ and seconded by Councilman Stevensi . Councilman I���� then moved that the' rule or law requiring three reading of this ordinance on three . different dates be dispensed with. Seconded by Councilman Runge .
