AN ORDINANCE AMENDING ORDINANCE NO. 90 BY
REPEALING SECTION VIII THEREIN AND INSERTING
THE FOLLOWING REGARDING THE ABATEMENT OF
NUISANCES IN EMERGENCY.
BE IT ENACTED by the City Council of the City
of Tiffin, Iowa :
SECTION I . Purpose. The purpose of this Ordinance
is to amend Ordinance No. 90 by repealing Section VIII
therein and inserting the following language as Section
VIII as set forth below regarding the abatement of
nuisances in emergency.
SECTION II . Repeal . Section VIII of Ordinance No.
90 is hereby repealed.

SECTION III . Enaction. The following Section VIII
is enacted as a part of Ordinance No. 90:
Section VIII : If it is determined that an
emergency °exists by reason of the continuing maintenance
of the nuisance or condition the City may perform any ti
action which may be• required under this Ordinance
without prior notice. Open burning, as prohibited in
Sections III . 1 . (1) of this Ordinance, shall be
considered an emergency in all cases, and the Tiffin
'Voluntary Fire Department shall be notified and directed
to extinguish the fire without prior notice. The City
shall tax a fee of $25 .00 for the services of the Fire
Department when it shall be called out . The City shall
assess the costs of the Fire Department and all other
costs for the emergency abatement of nuisances as
provided in Section X of this Ordinance after notice to
the property owner under the applicable provisions of
Sections IV and V and hearing as provided in Section VI .
SECTION IV. Repealer . All ordinances or parts of
ordinances in conflict with the provisions of this
Ordinance are hereby repealed.
SECTION V. Severability. If any section,
provision, or part of this Ordinance shall be adjudged
to be invalid of unconstitutional, such adjudication

shall not affect the validity of the ordinance as a
whole, or any section, provision, or part thereof not
adjudged invalid or unconstitutional .
SECTION VI . Effective Date. This Ordinance shall
be effect after its final passage, approval, and posting
as provided by law.
Councilman Stevens .introduced the
foregoing Ordinance which was then duly read and
considered by the Council . Its adoption was moved by
Councilman Runge and seconded by Councilman
Stevens On;, roll call vote Councilman
Stoner. Stevens, Runge
voted "Aye" . "Nays
Absent: Flansburg, Morgan
Whereupon the Mayor declared the motion carried.
Councilman Stevens then moved that the ruleor law
requiring three readings of this ordinance on three
different dates be dispensed with. On roll call
Councilmen Stoner, Stevens, Runge
voted "Aye" . "Nays" .
Absent: Flansburg, Morgan
The Mayor then declared this Ordinance duly passed and
adopted on this 14th day of Many , 1986 .

The foregoing ordinance entitled AN ORDINANCE
AMENDING ORDINANCE NO. 90 BY REPLEAING SECTION VIII
THEREIN AND INSERTING THE FOLLOWING REGARDING THE
ABATEMENT OF NUISANCES IN EMERGENCY, was published on
the 19th day of May 1986 by posting
copies thereof in three public places within the limits,
two of which are the mayor ' s office and the post office.
