HomeMy Public PortalAboutOrdinances-1986-138 Ordinance No. 1986-138 page 1 ORDINANCE NO. 1985-138 AN ORDINANCE AMENDING ORDINANCE NOS. 57 AND 1981-103 OF THE ORDINANCES OF TIFFIN, IOWA SAID ORDINANCE ESTABLISHING RATES, CHARGES AND RULES FOR THE USE AND SERVICE OF THE MUNICIPAL SEWER SYSTEM OF TIFFIN, IOWA. BE IT ENACTED BY THE CITY COUNCIL OF TIFFIN, IOWA: SECTION I. Purpose. The purpose of this ordinance is to amend Ordinance Nos. 57 and 1981-103 so as to establish a minimum sewer rate for each family, residential dwelling, or living unit, located on any premises in Tiffin, Iowa. SECTION II. Amendment. Section VI of Ordinance No. 57 and Section II of Ordinance No. 1981-103 of the City of Tiffin Ordinances are repealed and the following. Section VI is substituted in lieu thereof: SECTION VI. Sewer Rental Charge Set. The sewer rental charge for each single dewlling unit shall be $10.00 per month. All sewer rental charges paid by owners previous to the effective date of this ordinance shall be applied and credited to the account of the user. Fees for installations classed as a multiple user shall be charged as a multiple of the single dwelling unit and said sewer rental charge shall be approved be resolution of the Council. Effective date of this rate increase is September 1, 1986. SECTION III. Repealer. All ordinances, or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. SECTION IV. Severability. If any section, provision or part of this ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not affect the ordinance as a whole, or any section, provision or part thereof not adjudged invalid or unconstitutional. SECTION V. Effective Date. This ordinance shall be in effect after its final passage, approval and posting as provided by law. Councilman Stevens introduced the foregoing ordinance which was then duly read and considered by the Council. Its adoption was moved by Councilman Runze and seconded by Councilman Morgan On roll call vote Councilman Flansbur1 MorzanL Runze, Stevens, Stoner voted "Aye". voted "Nay". Seconded by Councilman Morgan On roll call vote Councilman Flansburg, Morgan, -Runge, STevens, Stoner voted "Aye. " Councilman voted "Nay".
