HomeMy Public PortalAbout95-063 (05-16-95)RESOLUTION NO. 9 5 - 6 3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD DECLARING ITS INTENTION TO ORDER THE LEVY AND COLLECTION OF ANNUAL ASSESSMENTS FOR FISCAL YEAR 1995 -96 WITHIN LYNWOOD LANDSCAPE MAINTENANCE DISTRICT PURSUANT TO THE "LANDSCAPE AND LIGHTING ACT OF 1972" AS AMENDED COMMENCING ' WITH STREETS AND HIGHWAYS CODE SECTION 22585 ET SEQ. AND FDCING THE TIME AND PLACE FOR HEARING PROTESTS AND OBJECTIONS WHEREAS, the City Council has directed and the City Engineer has prepared and filed a report in writing containing all matters required by Council under Streets and Highways Code, Section 22565, et seq.; and WHEREAS, said report has been presented to the City Council for consideration and has been received and approved. NOW, THEREFORE, the City Council does hereby resolve, order and determine as follows: Sect ion 1. Pursuant to the Landscaping and Lighting Act of 1972 as amended, commencing with Streets and Highways Code Section 22585 et seq., the City Council of the City of Lynwood hereby declares its intention to order the levy and collection of assessmentsagainst the assessable lots and parcels of land within an existing assessment district designated "Lynwood Landscape Maintenance District" (the "District ") for fiscal year 1995 -96 to pay for the costs of those existing, proposed and previously proposed improvements described as: ' Improvements include the installation or construction of previously proposed landscaping and appurtenant facilities within parks and landscaped areas within public rights -of- way and City owned properties in the City of Lynwood and the maintenance and servicing of existing and previously proposed landscaping and appurtenant facilities within parks and landscaped areas within public rights -of -way and City owned properties in the City. The Boundaries of the District are coterminous ith the boundaries of the City of Lynwood as shown on the map identified as Assessment District Map No. 1995 -L on file in the Office of the City Clerk. S ection 2. Reference is hereby made to the report of the Engineer approved by Council on May 2, 1995, by a resolution, and on file in the Office of the City Clerk, describing in detail the improvements to be made, the boundaries of the assessment district and any zones therein, and the proposed assessments upon assessable lots and parcels of land within the District. S ection 3. Notice is hereby given that June 20, 1995 at the hour of 7:30 p.m., in the Council Chambers of City Hall, 11330 Bullis Road, Lynwood, California, is the date, hour and place fixed for the hearing of protests and objections by the City Council to the levy and collection of the proposed assessments against the lots and parcels of land within the District for fiscal year 1995 -96. Any and all persons having any protest or objection to the proposed ' improvements, the extent of the assessment district, or the levy and collection of the proposed assessments may appear before the City Council at said hearing and show cause why said improvements should not be carried out and the proposed assessment and diagram confirmed, all in accordance with this Resolution of Intent and the report of the City Engineer. Prior to the conclusion of the hearing, any interested person may file a written protest with the City Clerk, or, having previously filed a protest, may file a written withdrawal of protest. A written protest shall state all grounds of objection. A protest by a property owner shall contain a description sufficient to identify the property owned by him. The City Council shall consider all oral statements and written protests or communications made or filed by an interested person. n J Section 4. The City Clerk is hereby directed to cause notice of the passage of this resolution to be given at the time and place in the form and manner provided by law. Section 5. The proposed assessment of $1.97 per foot of property frontage for fiscal year 1995 -96 reflects a zero increase over the assessment for fiscal year 1994 -95. Sectio 6. This resolution shall take effect immediately upon its adoption. PASSED, APPROVED and ADOPTED this 16th day of Ma y 1995.
