A a ,r_ e.<: severely restrict the abi + . Lynwood, and other cities, :.z -- ansfer funds derived from water and power utility operations to the general fund. B. Assembly Bill No. 318 is vague and uncertain as to whether, by its terms, a municipality would be prohibited in the future from including in its rates for utility services an in -lieu franchise fee or an in -lieu property tax. C. The Water Fund in the City of Lynwood has historically contributed to the City's General Fund substantial revenues in the form of in -lieu franchise fees and in -lieu property taxes, as 'well as reimbursement for the City's administrative saprart services. D. If the revenues and reimbursement received by the city o.' NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOOD DOES RESOLVE AS FOLLOWS: Section 1 . The City Council of the City of Lynwood opposes the adoption by the California State Legislature of Assembly Bill No. 318 because it constitutes an inappropriate and unwarranted intrusion into the rate - setting authority of the City of Lynwood with regard to its water and power utility operations. Section 2. The city Clerk is directed to certify the adoption of this Resolution and to forward copies of it to the Chairman and Members of the Senate Committee on Local Gover- yment, the State Legislators representing the City of = .� the Executive Director of the League of California Cities, the Executive Director of the California Contract Cities Association, and the Governor of the State of California.
