HomeMy Public PortalAboutOrdinances-1987-142 Ordinance No. 198(7=142 page 1 ORDINANCE NO. 198L-142 AN ORDINANCE AMENDING THE ANIMAL CONTROL ORDINANCEE NO. 1979-80 OF THE MUNICIPAL CODE OF TIFFIN, IOWA, BY AMENDING THE IMPONDING AND BOARDING FEES OF PET ANIMALS BE IT ENACTED BY THE CITY COUNCIL OF TIFFIN, IOWA: SECTION I. Purpose. The purpose of this ordinance is to amend the Aniaml Control Ordinance No. 1979-80 of the Municipal Code of . Tiffin, Iowa, by amedning the impounding and boarding fees set forth in Section IX. SECTION II. Amendment. Section IX of Ordinance No. 1979-80 is hereby repealed and the following Section IX is adopted in lieu thereof: Section IX. Impounding: Any dog or cat found at large, or any dog • or cat found without proper immunization tags shall be impounded at the facility prescribed by the City of Tiffin, Iowa. The owners of any licensed dog or cat shall be notified, and upon payment of the $20.00 impounding costs plus $5.00 per day boarding costs, such animal will be returned. If the impounded licensed dog or cat is not recovered by its owner within three days after notice, the dog or cat shall be disposed of by Animal Shelter personnel, or as otherwise ordered by the Mayor. Any impounded unlicensed dog or cat may be recovered by the owner upon proper identification and by producing at the time of recovery a current license from the City of Tiffin, Iowa, and also a record of immunization against rabies. Upon said showing and paying the impounding costs of $20.00 plus $5.00 per day boarding costs, the dog or cat shall be returned to its owner. If said conditions are not met within the three days the unlicensed dog or cat shall be disposed of by the Animal Shelter personnel or as otherwise ordered by the Mayor. SECTION III. Repealer. All ordinances, or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. SECTION IV. Severability. If any section, provision or part of this ordinance shall be adjudged invalid , or unconstitutional, such adjudication shall not affect the ordinance as a whole, or any section, provision or part thereof not adjudged invalid or unconstitutional. Ordinance No. 1986-142 page 2 SECTION V. Effective Date. This ordinance shall be in effect after its final passage, approval and posting as provided by law. Councilman _Runge introduced the foregoing ordinance which was then duly read and considered by the Council. Its adoption was moved by Councilman Stmagr and seconded by Councilman Morgg•n . On roll call vote Councilman Morgan, Stories Stratton voted "Aye". voted "Nay". Mayor declared motion carried. Flensburg , absent . Councilman Stoner then moved that the rule or law requiring three readings of this ordinance on three different dates be dispensed with. Seconded by Councilman Runge . On roll call vote Councilman Morgan., Stratton , Runge,• Stoner voted "Aye. " Councilman voted "Nay". Flensburg , absent . Councilman Stratton then moved for final adoption of this ordinance, seconded by Councilman M organ . On roll call vote Councilman MorganL Rune Stoner, Stratton voted "Aye. " Flensburg , absent .
