HomeMy Public PortalAboutRES-CC-1996-23.b �i c RESOLUTION 23-96 A RESOLUTION ADOPTING AN INTERLOCAL AGREEMENT AS TO THE FUNDING OF THE MOAB AREA ECONOMIC DEVELOPMENT OFFICE BY AND BETWEEN MOAB CITY, UTAH AND GRAND COUNTY, UTAH. WHEREAS, Grand County, Utah ("Grand County") and Moab City, Utah ("City") have had discussions regarding the funding of the Moab Area Economic Development Office; and WHEREAS, Grand County and the City have determined that the funding of the office can best be accomplished through an interlocal agreement; and WHEREAS, the Interlocal Agreement as to the funding of the Moab Area Economic Development Office has been submitted to the Grand County Council and the Moab City Council, NOW, THEREFORE, BE IT RESOLVED BY THE MOAB CITY COUNCIL that: 1. The Council hereby authorizes and approves the Agreement in substantially the form presented to this meeting of the Moab City Council. 2. The appropriate officials are hereby authorized and directed to execute and deliver the Agreement in substantially the form presented to this meeting of the Council. 3. From: Earl Sires, County Adminlshator Grand County Fax: 801.259.2574,orafter 5pm269.2969 Voice:901.259.1346 To: Donna Metzler at: City of Moab Page 2 of4 Thursday, December 12, 1996 4:20:26 PM INTERLOCAL AGREEMENT AS TO THE FUNDING OF THE MOAB AREA ECONOMIC DEVELOPMENT OFFICE BY AND BETWEEN MOAB CITY, UTAH AND GRAND COUNTY, UTAH Pursuant to the Interlocal Cooperation Act (Section 11-13-1 ed seq., Utah Code Annotated), and for the mutual benefit of the citizens and inhabitants of Grand County, Utah (the "County") and Moab City, located in Grand County, Utah (the "City"), the County and the City hereby agree as follows: 1. Purpose. The purpose of this agreement is to provide funding in support of services to be provided by the Moab Area Economic Development Office ("Office), an office of Grand County. 2. Provision of Services. Immediately upon this agreement becoming effective as provided in Section 5 hereof, the Moab Area Economic Development Office (the "Office") shall provide the economic development services defined in Attachment A on behalf of Moab City and the unincorporated areas of Grand County. Management of the office shall be under the direction of the County Administrator. 3. Financial Responsibilities. Grand County will show in its annual budget all projected expenses associated with the operation and stalling of the office as well as all revenues supporting the office. The City agrees to fund the office in the amount of $4,000.00 which shall serve as funding for the period ending June 30, 1997. Said payment shall be made prior to March 1, 1997. The City further agrees to fund the office in the amount of $10,000.00 which shall serve as funding for the period ending June 30, 1998. Said payment shall be made prior to September 1, 1997. The County agrees to fund the office in the amount of $10,000 annually. The obligations of the County and the City under this agreement are subject to the annual budget and appropriation process in accordance with applicable laws. The County and the City may utilize internal billings or administrative transfers to make funds available to meet their respective obligations hereunder. 4. Control of Property. Pursuant to Section 11-13-7, Utah Code Annotated, the County shall exercise control over all property provided by the County in fulfilling its obligations under this agreement; and the City shall exercise control over any property provided by the City in connection with this agreement or the operation of the department. 5. Effectiveness and Duration of Agreement. This agreement shall become effective immediately upon its approval by resolutions of the County Council and City Council, upon its execution by appropriate County and City officials, and upon approval by the County Attorney and the City Attorney. This agreement shall remain in effect until 90 days after notice of termination is given by either party to the other party. 6. Budget Administration. The County Administrator will administer the budget for the office. On or before December 1 of each year, the City Council will approve the proposed budget and return it to the County. Funding for obligations under this agreement will be allocated and approved by the City Council and County Council as a part of each entity's annual budget process. 7. Administration of Agreement. The provisions of this agreement shall be administered by the County Administrator and City Manager. They will review the agreement and make recommendations as to improvements or changes to the agreement. They will also coordinate budgetary and other matters regarding this agreement between the governing bodies of the County and City. The County Administrator and City Manager will develop a formal system of complaint resolution and will serve as the contact persons for the City and County in matters related to the provisions of service by the County to the City under the agreement. 8. Executed copies of this agreement shall be filed with the County Clerk and the City Clerk. DATED this day of , 1996.
