COUNCIL MINUTES
March 23, 1963
The Council of Bal Harbour Village met at 9:30 A.M. on Satur—
day, March 23, 1963 at the Village Hall.
Present: Messrs. Beatty, Faulkner, Hart, Kirkeby and White.
Also present were W. H. Webb, Village Manager; Mary T. Wetterer,
Village Clerk; and Thomas H. Anderson, Village Attorney.
Mr. Webb reported that in accordance with the Council's wishes
he had corresponded with Mr. Anderson as to the legality of setting up
every Saturday as a legal meeting date for Council meetings. Mr.
Anderson suggested the second Saturday and the last Saturday of each
month as meeting days. After discussion it was decided to take action
on this matter at the induction meeting.
The Village Manager reported that the Village Attorney had
checked to see if it was legal for Bal Harbour Village to use the Miami
Beach Times in the publication of delinquent taxes. After discussion
Mr. Faulkner moved to direct the Village Manager to publish the notice
in the Miami Beach Times, it being found to comply with the state law.
Mr. Hart seconded the motion and it was unanimously approved.
Mr. Webb explained that several times a year the Americana
Hotel uses the garage area under the convention hall as exhibition
space. He presented a letter from the Americana requesting permission
to use the garage area for conventions to be held May 24-30, 1963 and
October 13-16, 1963. Mr. Kirkeby moved that the request be granted
provided all fire requirements are met. Mr. Faulkner seconded the
motion and it was unanimously approved.
Mr. Webb advised the Council that the Blue Cross Insurance
Company has been granted an increase in rates. He suggested that
the Village stand the additional expense inasmuch as the employees
had already contracted for a more expensive plan this year. It was
pointed out that Mr. Kirkeby had elected to remain in his own group,
which leaves an unexpended amount in the budget item. Mr. Hart and
Mr. Faulkner suggested that the Councilmen drop out of the group and
that the cost of the policies for the Councilmen could be used to
make up the difference in the employees policies. Mr. White objected
to this suggestion. After discussion Mr. Beatty moved that the Village
pay the increase. Mr. Hart seconded the motion and it was unanimously
carried.
The Village Manager suggested that in view of the fact that
the plans for a diagnostic clinic in the Bal Harbour Hotel had not
worked out, to discourage further ideas of converting the hotels into
spas, the diagnostic clinic section be removed from the Zoning Ordi—
nance. Mr. Beatty moved that the section be removed and Mr. Anderson
prepare an ordinance repealing Ordinance No. 83, seconded by Mr. Hart
and unanimously voted.

The Village Clerk stated that at the close of registration for
the April 2, 1963 election, there were 155 registered voters and asked
that the list be approved. Mr. Hart moved to approve the voting list
as submitted, seconded by Mr. Faulkner and unanimously approved.
Mr. Webb advised the Council that on October 27, 1962 Mrs.
Sanella Cauchois, widow of Mr. Jean Cauchois, had appeared before the
Council requesting that in view of her husband's death, the Certificate
of Public Convenience and Necessity of the Bal Harbour Limousine
Company issued to Mr. Jean Cauchois be transferred to her. A temporary
certificate was granted Mrs. Cauchois, good until March, 1963, at which
time she was advised that a formal application for a Certificate of
Public Convenience and Necessity should be made. The Village Clerk
reported that Mrs. Cauchois' attorney had been notified that she must
make this formal application on March 23, 1963. After deliberation,
Mr. Faulkner moved that Mrs. Cauchois, having been previously advised
that her Certificate of Public Convenience and Necessity would expire
if she didn't appear to validate her temporary certificate, be advised
that her certificate and her permits would be canceled as of April 1,
1963. Mr. Kirkeby seconded the motion and it was unanimously approved.
Mr. Webb advised the Council that since the Village started
picking up the garbage and trash at the hotels in November, three of
the hotels have been storing garbage and trash outside of the hotel
instead of in the refrigerated garbage room and fire proof trash room
provided for that purpose. He requested the Council to pass an ordi—
nance controlling the storage of hotel trash and garbage. Mr. Hart
moved to instruct the Village Attorney to prepare an ordinance govern—
ing the storing of garbage and trash in hotel trash and garbage rooms.
Mr. Beatty seconded the motion and it was unanimously voted.
There being no further business, on motion of Mr. Hart, seconded
by Mr. Faulkner, the meeting was adjourned.

The Council of Bal Harbour Village met at the Village Ha11 on
Monday, April 15, 1963 at 10 A.M. for the purpose of inducting the new
members into office.
Present: Mr. Faulkner, Mr. Kirkeby and Mr. White.
Absents Mr. Beatty and Mr. Hart.
