The applicant seeks an appeal of the Zoning Agent's decision under MGL Chapter 40A Section S to allow a lot in two zoning districts that received a special permit(case#99-23)tinder Section 179-SE of the Zoning By-laws to be used for residential purposes,to also/continue to have a commercial use on the lot. Mr. Staley stated that after receiving a copy of the Zoning Board's Decision of application 15-17 Sullivan he needs some clarification. Mr.Staley gave some background to this issue; • Corridor Overlay Protection District (COPD) was in place in 1999 when this property was first purchased • Previous Building Commission did not suggest/tell the applicant to go through this process • Review process NOW is Site Plan Review • Zoning Board was only presented with ZA letter dated April 17, 2015 • Zoning Board did not have building commissioners previous letters from 2000-2014 Board Questions • Board did NOT say anything to bypass any other review processes • Other use was there • One does NOT preclude the other • if Mr. Staley feels they need Site Plan Review then that is where they must go.
