The Council of the City of Medina met in regular session on Tuesday, September 2, 1980 at 7:30 P.M. Present: Mayor, Thomas Anderson; Councilmembers, William Reiser, Thomas Crosby, Nancy Laurent, Sarah Lutz at 7:45 P.M.; Clerk -Treasurer, Donna Roehl; Planning and Zoning Administrator, JoEllen Hurr; Police Chief, Charles Hoover; Attorney, Richard Schieffer. Members agreed to discuss the following items: Approval of additional names as election judges Change in dates for disbursement of State Aid funds 1. MINUTES OF AUGUST 19, 1980 JoEllen Hurr asked that Item 4, Page 86 be corrected to indicate size of barn being pro- posed by Gary Petrucci to be 30' x 40'. Motion by Reiser, seconded by Laurent to approve minutes of September 2, 1980, as amended. Motion declared carried 2. MINUTES OF AUGUST 26, 1980 Motion by Reiser, seconded by Laurent to approve minutes of August 26, 1980, as presented. Motion declared carried 3. ROLLING GREEN COUNTRY CLUB Tom Winkle, Manager of Rolling Green Country Club, appeared to request permission for the golf club to serve drinks at a pre -arranged, pre -paid golf tournament on September 9th, (Primary Election Day) before the 8:00 P.M. poll closing time. Richard Schieffer advised that Minnesota Election laws do not allow serving of liquor on Election Days and that if a situation arose the city could be involved under the Dram Shop law. Mr. Winkle stated that their attorney had advised them that they would be covered under their Dram Shop insurance if Medina were to allow the serving of liquor. He added that the event had been arranged for 2 years ago, with no thought to an election day. Motion by Crosby, seconded by Reiser to deny the special request of Rolling Green Coun- try Club to serve liquor which would have been paid for prior to Primary Election Day, due to the understanding of Minnesota Election Day laws. Motion declared carried 4. PLANNING AND ZONING DEPARTMENT North Star Marina Ray Kempf of North Star Marina, appeared to discuss the continuation of boat storage at 1602 Homestead Tr. if the property were to be sold. He stated that they had made a counter- proposal to the prospective buyer asking to be allowed to continue to use the buildings for storage until the existing Special Use Permit expires in 1987. Thomas Crosby stated that he would not partake in discussion or voting as he had spoken to the buyer, Bruce Dayton, about the matter and had represented Mr. Dayton in other matters. JoEllen Hurr reported that several families are living in the house and that it should not be sold as a multi -family dwelling. Realtor, Patti Fleischaker, stated that it would be a single family dwelling. Ms. Burr explained that Ordinance 166 adopted in 1977 would allow a new owner to make an application for boat storage. Council discussed the need to see any agreement that the buyer and North Star Marina may make for use of the buildings. Motion by Reiser, seconded by Lutz to grant approval for the extension of the existing Special Use Permit provided that only North Star Marina store boats in the buildings and that the city be provided with a copy of the agreement North Star has with Mr. Dayton. Motion declared carried Ralph Miller Division JoEllen Hurr explained that Mr. Miller has requested that an additional 1.1 acres be combined with the previously approved 8.9 acre division so that a new owner would qualify under the Green Acres Law. 92 She stated that the additional acreage would not increase the amount of suitable septic system soil. • Motion by Crosby, seconded by Lutz to grant the addition of 1.1 acres to the Miller Division. Motion declared carried 701 Grant JoE11en Burr explained that she would be attending a second meeting on September 4th to discuss Medina's application fora701 planninggrantto assist the city indeveloping its zoning ordinance and comprehensive plan. Garr Petrucci JoEllen Hurr explained that there had been a request for an -increase in the size of the barn to 40' x 46' from the orignal plans for a 30' x 40' structure. She stated that it will not be closer than 150 ft. from Co. Rd. 24. The 150 ft. set -back is the requirement under the new ordinance. Motion by Lutz, seconded by Crosby to allow the increase in barn size to 40' x 46'. Motion declared carried 5. WATER SUPPLY COMPANY Marlon Haugen and Ray Bergerson appeared to requst a rate increase be approved for Medina Morningside water customers from $1.65 to $2.20 per thousand gallons of water. Mr. Bergerson presented the following reasons for the request: Officers receive no salary, there are no reserves being accumulated and no note payments being made. The owners have also lent the system $16,000 to maintain the operation. Thomas Crosby explained that the city has not heard anything regarding the sewer installation grant so they have not pursued the purchase of the water system. The City should know what affect a purchase price may have on the per lot assessment in Medina Morningside. Mr. Bergerson stated that they had discussed charging a hydrant fee to the city, also they still would like to discuss selling to Medina. Thomas Crosby and William Reiser agreed to meet with the owners to discuss a purchase price. Thomas Anderson stated that the city would be making a decision as to sewer installation after January 1, 1981. Matter was tabled until September 16th. 6. RIGHT-OF-WAY ALTERATION ORDINANCE Attorney Schaeffer explained that the ordinance would provide for a number of things that would not be allowed in a road right-of-way and a penalty provision for violation. Motion by Laurent, seconded by Lutz to approve Ordinance 194, Regulating use of City Right - of -Way, with the addition, under Section 477 (2) of earth being added to right-of-way. Motion declared carried 7. ST. ANNE'S CHURCH Motion by Reiser, seconded by Crosby to grant a Non -Intoxicating Malt Liquor license to Father Ardolph and St. Anne's Church for Sunday, September 28, 1980, from 12:00 noon until 5:00 P.M. Motion declared carried 8. ELPCTION JUDGES Motion by Crosby, seconded by Lutz to include the following names as election judges for Primary and General Elections: Carolyn Smith, Sue Ravenscraft, Marilyn Glampe, Bonne Theis, Kayla Scherer, Laura Miller, Peggy Hosp, Joyce Johnson, Maureen Petrucci. Motion declared carried 9. GOVERNMENT AIDvPAYMENT SURVEY Consensus of the Council was not to take a posistion on the possibility of changes being ade in the dates for distribution of State Aid monies. 10. WOODLAKE SANITARY LANDFILL Mayor Anderson stated that he had attended a session to discuss the expansion of Woodlake, with County Commissioners Robb, Kraemer, Johnson, representatives of Commissioner Olkon and Luther Nelson, Hennepin County Environmentalist. Clerk was asked to send copy of letter to PCA to the Commissioners and others interested 11. LONG LAKE FIRE DEPARTMENT BUDGET Thomas Crosby commented on the tentative Long Lake Fire Department budget. He noted that.38o of the budget is undesignated and that salary amounts do not compare with those of the Hamel FireDepartment. 12. BILLS Motion by Crosby, seconded by Laurent to pay the bills: Order Checks # 8987 - 9038 in the amount of 129046.34 and Payroll Checks #5859 -5882 in the amount of $9968.50. Motion declared carried 13. ZONING ORDINANCE CLARIFICATION JoEllen Burr presented the following list for clarification of the Zoning Ordinance that was adopted at the August 19th meeting. Motion declared carried 14. COMPREHENSIVE PLAN Chuck Riesenberg discussed with Council the Zoning of the Hamel area and the expansion of the sewer district which would double the capacity of.the sewer pond. He will incorporate suggestions that will include expansion of the district between Hunter Dr. and Brockton Lane to the south; additional to the west; and provision for multi family housing along the Rolling Green Golf Club. He will also have the Transportation, Park and Land Use plan for Council. Motion by Crosby, seconded by Reiser to authorize changes in the sewer district, as drawn.
