HomeMy Public PortalAbout2678-1972 - Amending Articles 12, 13, 15 and 17 of the Municipal CodeAMENDED ORDINANCE NO. 2678-1972 AN ORDINANCE AMENDING ARTICLES 12, 13, 15 AND 17 OF CHAPTER 41 OF THE MUNICIPAL CODE OF RICH- MOND, INDIANA. WHEREAS, Article 12, Section 41.72 of the Municipal Code of Richmond, Indiana, formerly read, as follows: 41.72 STANDING OR PARKING CLOSE TO CURB. Except as otherwise provided in this article every vehicle stopped or parked upon a roadway where there are adjacent curbs shall be so stopped or parked faced in the direction of travel on that side of the street with the curb -side wheels of such vehicle parallel to and within 18 inches of the curb. WHEREAS, The City Plan Department and the Traffic Division of the Police Department have recommended that said Section 41.72 now read, as follows: 41.72 STANDING OR PARKING CLOSE TO CURB. Except as otherwise provided in this article every vehicle stopped or parked upon a roadway where there are adjacent curbs shall be so stopped or parked faced in the direction of travel on that side of the street with the curb -side wheels of such vehicle pa'ral,lel to and within 12 inches of the curb. WHEREAS, Article 13, Section 41.76 of the Municipal Code of Richmond,, Indiana, formerly read as follows: 41.76 PARKING NOT TO OBSTRUCT TRAFFIC. No person shall park any vehicle upon a street other than an alley, in such a man- ner or under such conditions as to leave available less than 10 feet of the width of the roadway for free movement..of ve- E cular traffic. WHEREAS, The City Plan Department and the Traffic Division of the Police Department have recommended that said Section 41.76 now read as follows: 41.76 PARKING NOT TO OBSTRUCT TRAFFIC IN STREETS. No person shall park any vehicle upon a street, other than an alley, in such a manner or under such conditions as to leave avail- able less than 15 feet of the width of the roadway for free movement of vehicular traffic. WHEREAS, Article 13, Section 41.77 of the Municipal Code of Richmond, Indiana, formerly read, as follows: 41.77 PARKING IN ALLEYS. No person shall park a vehicle with- in an alley in such a manner or under such conditions as to leave available less than 10 feet of the width of the roadway for the free movement of veTTicular traffic, and no person shall stop, stand or park a vehicle within an alley in such a position as to block the driveway entrance to any abutting property. WHEREAS, The City Plan Department and the Traffic Division of the Police Department have recommended that said Section 41.77 now read, as follows: 41.77 PARKING IN ALLEYS. No person shall stop, stand, or park a vehicle within an alley in such a manner or position as to block the alley, or the entrance to any abutting property or driveway, except to load or unload, and only then with an at- tendant present to move subject vehicle upon request. SECTION 2. That Article 13, Section 41.76 of the Municipal Code of Richmond, Indiana, shall now read: 41.76 PARKING NOT TO OBSTRUCT TRAFFIC IN STREETS. No person shall park any vehicle upon a street, other than an alley, in such a manner or under such conditions as to ' leave available less than 15 feet of the width of the road- way for free movement of vehicular traffic. SECTION 3. That Article 13, Section 41.77 of the Municipal Code of Richmond, Indiana, shall now read: 41.77 PARKING IN ALLEYS. No person shall stop, stand, or park a vehicle within an alley in such a manner or posi- tion as to block the alley, or the entrance to any abutting property or driveway, except to load or unload, and only then with an attendant present to move subject vehicle upon request. SECTION 4. That Article 15, Section 41.94 of the Municipal Code of Richmond, Indiana, shall now read: 41.94 (a) Parking of Wide Vehicles. No person shall park any vehicle with an overall width in excess of 88 inches (except mobile homes, mobile campers, boats and boat trail- ers) at any time upon any street, alley, roadway or high- way in the City, except for the immediate loading or un- loading of such vehicle. All such vehicles found so park- ed upon any alley, street, highway or roadway for the ex- press purpose of loading or unloading shall not be left unattended. (b) Parking of Mobile Homes. No person shall park a mo- bile home of any size upon any street, alley, roadway or highway in the City, except for emergency or temporary stopping or parking. Emergency stopping or parking shall not exceed two hours in one calendar week. (C) Parking of Mobile Campers, Boats, and Boat Trailers. No person shall park mobile campers, boats or boat trail- ers upon any alley, street, roadway, or highway in the City at any time in such a manner or under such conditions as to constitute a definite hazard or obstruction to the normal movement of traffic. Should the preceding parts (a), (b), and (c) of this sec- tion conflict with Section 41,76 and 41.77 of this Chap- ter, sections (a), (b), and (c) of this Section shall be controlling. Definitions of terms used in the foregoing parts (a), (b), and (c) of this section. Boats as defined herein shall mean and include any, vehicle designed for transportation on the surface of water and not being in excess of 88 inches in width. Boat trailers as defined herein shall mean and include any vehicle designed to carry the weight of a boat and to trans- port such boat, such trailers not to exceed 48 inches in height and 88 inches in width. Mobile campers as defined herein shall mean and include any motor vehicle which is designed in itself for habi- tation or for shelter and which is not designed for the towing of another vehicle and which is of a minimum width of 72 inches and a maximum width of 88 inches. Mobile homes as defined herein shall mean and include house trailers or any other vehicles without motive power, designed for habitation or for shelter, and structured so that no' part of its weight should rest upon the towing ve- hicle, 4. r' WHEREAS, Article 15, Section 41.94 of the Municipal Code of Rich- mond, Indiana, formerly read, as follows: 41.94 PARKING OF WIDE VEHICLES. No person shallr�park a vehicle with an overall width in excess of 88 inches at any time upon any street, highway or roadway in the City. WHEREAS, The City Plan Department and the Traffic Division of the Police Department have recommended that said Section 41.94 now read, as follows: 41.94 (a) Parking of Wide Vehicles. Mobile homes as defined herein shall mean and include house trailers or any other vehicles without motive power, designed for habitation or for shelter, and structured so that no part of its weight vr-s-t-s upon the towing vehicle. �5h0 u td rem WHEREAS, Article 17, Section 41.99, Paragraph (a) of the Muni- cipal Code of Richmond, Indiana, formerly read, as fol- lows: 41.99 AUTHORITY TO IMPOUND VEHICLES. (a) Members of the Police Department are hereby authorized to remove a ve- hicle from a street or highway to the nearest garage or other place of safety, or to a garage designated or maintained by the Police Department, or otherwise main- tained by this City under the circumstances hereinafter enumerated, 1. When any vehicle is left unattended upon any bridge, viaduct, or causeway where such vehicle constitutes an ob- struction to traffic. 2. When a vehicle upon a highway is so disabled as to constitute an obstruction to traffic and the person or per- sons in charge of the vehicle are by reason of physical injury incapacitated to such an extend as to be unable to provide for its custody or removal, 3. When any vehicle is left unattended upon a street and is so parked illegally as to constitute a definite hazard of obstruction to the normal movement of traffic, WHEREAS, The City Plan Department and the Traffic Division'of the Police Department have recommended that said Section 41.99, Paragraph (a) now read as follows: 41.99 AUTHORITY TO IMPOUND VEHICLES. NOW THEREFORE, BE IT ORDAINED by the Common Council of the City of Richmond, Indiana: SECTION 1. That Article 12, Section 41.72 of the Municipal Code of Richmond, Indiana, shall now read: 41.72 STANDING OR PARKING CLOSE TO CURB. Except as other- wise provided in this article every vehicle stopped or parked upon a roadway where there are adjacent curbs shall be so stopped or parked faced in the direction of travel on that side of the street with the curb -side wheels of such vehicle parallel to and within 12 inches of the curb. SECTION S. That Article 17, Section 41.99, Paragraph (a) of the Municipal Code of Richmond, Indiana, shall now read: 41.99 AUTHORITY TO IMPOUND VEHICLES. (a) Members of the Police Department are hereby authorized to remove a vehicle from a street or highway to the nearest garage or other place of safety, or to a garage designated or maintained by the Police Department, or otherwise main- tained by this City under the circumstances hereinafter enumerated. 1. This Ordinance shall be in full force and effect from and after its passage, and approved by the Mayor and publi- cation as by law requiied.
