AN ORDINANCE AUnURIZING A "SPECIAL USE" IN AN R-4 NILTI-
FAMILY RESIDERrIAL DISTRICr OF ORDINANCE NO. 2325-1968, AS
AMSM, C04 M.Y KNOW AS THE ZONING ORDINANCE OF THE CITY
OF RIGNDM, INDIANA, APPROVED ,JUNE 3rd, 1968.
*MtEAS, Ordinance No. 2677-1972 is being studied concurrently by the Common
Council of,the City of Richmond, Indiana; and
WHEREAS, said Ordinance No. 2677-1972, if made effective, would change the
zoning classification of the property located at 790 National Road
West, Richn nd, Indiana, hereafter described in the attached Ex-
hibit A, from R-2, One -Family Residence District, to R-4, Multi -
Family Residence District; and
WORFAS, a funeral home 7 y be allowed as a special use in
an R-4, Multi-Fa;i y es District;
MW MERE M, BE TT MAIND BY THE CXUN COUNCIL OF THE CITY OF RIGWND,
INDIANA, as follows:
WrION 1. As provided in Article 23, Section .011 and Article 48 of Ordin-
ance No. 2325-1968, as amended, commonly known as the Zoning Ordin-
ance of the City of Richmond, Indiana, the property located at 790
National Road West, Richmond, Indiana, hereafter described in the
attached Exhibit A, shall be allowed as a special use to wit: Fun-
eral home OWL P -em�-
SECTION 2. The attached Exhibit A, containing the description of said pro-
perty is hereby made a part of this ordinance.
SECTION 3. The passage of this ordinance shall be contingent only upon the
prior passage of Ordinance No. 2677-1972, changing the zoning class-
ification of said property from R-2 to R-4.
SECTION 4. As a condition of the aforesaid special use and as an additional
restriction on said use, the following requirements shall hereafter
and at all times be met by the owner, leasee or any person, firm or
corporation using such real estate.
SBCPION S. The Zoning Administrator of the City of Richmond, Indiana, is hereby
authorized and directed, upon enactment and publication of this ordin-
ance, to record and approve the issuance of a permit for the establish-
ment of the use herein allowed.
SECTION 6. This Ordinance shall be in full force and effect from and after its
passage, approval by the Mayor and publication as by law required.

Dear Mrs. Hoskins $ Members of the Common Council:
The Richmond City Plan Commission held a public hearing on Tues-
day, June 6, 1972, at 7:30 p.m., in the Council Chambers of the
.Richmond Municipal Building to hear the request of F. Raymond,
Cecilia, and Philip Jenkins, Thomas A. Milligan, Agent, 2 North
8th Street, requesting a special use for a funeral home and crem-
atory to be located at 790 National Road West, Richmond, Indiana.
All parties interested in or affected by this request were heard.
Six (6) persons remonstrated against the subject petition and one
(1) person gave a favorable recommendation. Eighteen "(18) letters
were sent to adjoining property owners and five (5) were returned
opposed while two (2) were returned favorable.
In that same evening, the Plan Ca mdssion voted seven (7) to one
(1) to approve the 'subject petition with modifications and res-
trictions and to make that recommendation to Common Council as
follows:
1. The subject ordinance shall be amended by Council
to delete the crematory use.
2. The setbacks shall be those as shown on the plans
submitted to the Commission and Plan Department.
3. Any lighting shall be diffused so that adjoining
properties will be shielded from the light.
4. No curb cuts shall be permitted on National Road
West.
5. The yard requirements to be applied shall be those
as required for all other principle permitted uses
in an R-4 zone.
