As a horseman, and avid trail rider, I have recently
begun to realize that there is one group of people
left out of the enjoyment of the open spaces taht are
available in the IYIROSD.
These are the bicycle riders .
Whenever I enter NIROSD property, I note that are signs
prohibiting bicycles . It seems to me that there are
places where bicycles could be provided for. For
example: Through Rancho San Antonio County Park there
is a paved path, now being used by hikers , joggers , and
your ranger vehicles . If you were to extend this
paved path through your adjacent lands to join with
the county lands near highway 280 to the north, this
would provide a pleasant scenic ride for bicycle riders
which would be a diversion for them from the trafficed
streets and roads .
Another example: Along Skyline Road it would be poss-
ible to to move MROSD fences some ten or fifteen feet
back from the property line and thus allow the counties
space to construct bicycle paths for the use and enjoy-
ment of the open space . In your parking areas you could
provide bicycle storeage boxes similiar to those in the
county "park and fide" lots , thus allowing the bicycle
people to enjoy walking the trails where bicycles are
prohibited .
I urge you to give this matter due consideration so that
bicycle enthusiasts may enjoy MROSD open space which
they are helping to pay for.

NOTICE OF SPECIAL MEETINGS
April 20, 1983

There will be a Special Meeting of the Board of Directors of
the Midpeninsula Regional Open Space District on Wednesday,
April 20, 1983 beginning at 7 :30 P.M. at the District office,
375 Distel Circle, Suite D-1 , Los Altos. The Board will be
considering proposal criteria for the upper house at Rancho
San Antonio Open Space Preserve and a proposal for summer use
of the structures on the Coal Creek Open Space Preserve.
The Board of Directors will hold a Special Meeting on Saturday,
April' 23, 1983 beginning at 8: 30 A.M. at the District office,
375 Distel Circle, Suite D-1 , Los Altos. The purpose of the
Special Meeting is to have a workshop on "The Next Decade"
of the Midpeninsula Regional Open Space District.
A copy of the agenda for each of these Special Meetings is
attached.

The San Mateo County Parks and Recreation Commission invites you
to the dedication of the Jack Brook Memorial Horsemen's Camp,
located at Sam Mc Donald County Park on Pescadero Road near the
community of La Honda.
The Horsemen's Camp has been under development for several years
through the joint effort of the County and a number of volunteer
equestrian groups.
The dedication ceremony will take place at 11 :00 a.m. on
May 7, 1983, followed by a barbecue lunch served by the equestrian
groups.
A map is attached to assist in locating the area. Parking will be
at Sam Mc Donald Ranger Station. From there, you can either walk
or ride to the camp. Shuttle vans will also be provided. Due to
limited parking at Sam Mc Donald Ranger Station, you are encouraged
to carpool to the greatest extent possible.

SUBJECT: Proposal for Summer Use of Coal Creek Open Space
Preserve Structures
Introduction: At the time of acquisition of the Coal Creek Open Space
Preserve, you approved pursuing interim use of the house as a rental
unit while a study was being conducted on both utilization of a nearby
well as a water source and on determination of the ultimate disposition
of the house and barn (see report R-82-27 , dated June 23, 1982) . Staff
has determined and will be recommending to you that it would be best
to demolish the cabin and auonset but structure and has included funding
for this purpose in the coming fiscal year' s budget. The attractive
barn is proposed, however, to remain and to be studied further for
potential use. A disposition schedule for this structure will be
forthcoming at the regular use and management review of the property
in March 1984 .
Proposal
At the current time Conservation Earth, a non-profit corporation
which has applied for tax exempt status, is proposing to carry on
a summer day camp program on the property which would utilize the
buildings between June 6 and August 26 of this year.
The total number of participants an the property would not exceed 30
at any one time, with 15 kindergarten through third grade children
on site in separate morning and afternoon groups, and 15 fourth
through sixth grade children on site during the entire day. The
thrust of the program will be nature studies, with students coming
from several surrounding communities transported in two large vans .
A program synopsis is attached from Steve Karlin, President of Con-
servation Earth, as well as other materials which more fully outline
the proposed program. Mr. Karlin will also be available at your
meeting to make a short presentation and answer any detailed questions
you may have.
In exchange for the use of the structures, Conservation Earth is
offering to do the following:
1 . Aid District field staff in cleanup and caretaking of the Coal
Creek Preserve properties.
2 . Aid the District in working with the neighbors on upkeep and
maintenance of Crazy Pete' s Road.

They propose to keep vehicle trips to a minimum and less than 10
trips a day.
3 . Aid the District in trail construction or repair on the Coal
Creek site.
4. Provide a natural history inventory of the site which will further
aid District knowledge and planning for the Preserve.
5 . Paint or repair the structures, if necessary.
Conservation Earth plans on installing and paying for portable toilets
and helping to repair the water system. They also intend to hook up
power and telephone to the house. Any trash will be removed at the
end of each day. They are currently not able to pay rent, due to
the low program fees asked of the participants, many of whom are from
lower income families. Grants are being sought, however, to supple-
ment program fees for those who cannot afford them. Certainly one
major asset of the program to the District is the life-enhancing
natural history experience over 300 children will receive on the
Preserve this summer. Concerns of the neighbors adjacent to Coal
Creek have been considered and certainly can be further addressed
at your meeting. Their concerns have mainly dealt with retaining
their privacy and lessening any traffic and physical impact on
Crazy Pete 's Road.
Recommendation: I recommend that you authorize the General Manager
to sign the attached agreement with Conservation Earth, under the
recommendations in this report and to consider any other concerns
which may be forthcoming at your meeting, to utilize portions of
the Coal Creek Open Space Preserve and its structures for day camp
use from June 6, 1983 to September 1 , 1983.
AGREENEENT
THIS AGREEMENT is made and entered into this day of
1983, by and between Conservation t-artha non-profit
corporation I.-ITDPENINSUIAa- REGIONAL
hereinafter called "EARTH", and the -
OPEN SPACE DISTRICT, hereinafter called "DISTRICT.".
PURPOSE. In order to provide an expanded and varied program of
orgar.7ize-dnature study activities for the c-Atizens of the District,
EARTH has arranged with DISTRICT to use the Coal Creek Open Space
Preserve property, located in the Skyline Ridge corridor adjacent to
Skyline Boulevard, for a recreational Day Camp program consisting of
programs such as arts and crafts, hiking, picnicking, games, singing,
natural science study, and caring for animals. it.is understood by
both parties that the Coal Creek property is a seini-wilderness area
with certain environmental hazards, such as uneven landscape, wooded
areas, poison oak, wildlife, and rattlesnakes. EARTH shall offer no
programs that, in the estimation of DISTRICT, have a negative impact
on the environment of the area, or on the future use of the property.
In consideration of the mutual covenants and conditions contained
herein, the parties agree as follows:
1. DISTRICT agrees to provide the non-exclusive use of the Coal
Creek Preserve barn and cabin without charge for use by EARTH
to carry on a Day Camp program for the benefit of the citizens
of the District. Said facilities shall be made available for
the agreed upon uses during the times of 9:00 A.M. to 5:00 P.M.
Monday through Friday, June 6, 1983 through Septerber 1, 1983.
Use for day ca=---> overnights shall not be a part of this
Agreement.
2. Upkeep and maintenance of buildings, roads, pathways, utilities
and other improvements on the property shall be carried out by
EARTH in such a manner as may be mutually agreed upon between
the parties from time to time, provided that nothing herein
shall be deemed to impose on DISTRICT any responsibility assumed
by EARTH in Paragraph 9 hereof.
3. DISTRICT may designate certain areas as unsafe or unsuitable
for use by EARTH and restrict said areas from use. (See
attached map for areas initially designated as "closed" .)
4 . EARTH agrees to furnish and pay for all necessary supplies and
materials directly related to the program, including utilities.
5. EARTH agrees to install and pay for portable toilets at its
own expense and to work with DISTRICT on obtaining adequate-
potable water for the program. EARTH agrees to remove all
refuse accumulated on site by its program at the end of each
and every day that the program is in operation.
6. EARTH agrees to obtain all necessary permits for fire, safety,
health, and other clearances required by local, County, and
State agencies.

7 . EARTH shall be responsible for all necessary or appropriate
supervision and control over agents and employees of EARTH,
participants in the program, and other persons on the property
at the invitation of EARTH or as a result of EARTH's program.
Responsibility for supervision and control shall include pro-
viding qualified staff members and volunteers to protect the -
safety of the participants and to promote, organize and conduct
the various programs.
S . EARTH agrees to cross Crazy Pete's Road as primary access to
the structures not more than 10 one-way trips per day, and
agrees to aid DISTRICT and other road users on regular upkeep
and maintenance of Crazy Pete's Road during the period that
the program is in operation.
9. EARTH shall have the responsibility and bear primary liability
for:
a) locating and identifying any hazards, natural or manmade,
on the property and calling such hazards to the attention
of participants in the program, and to persons on the
property at the invitation of EARTH or as a result of
EARTH's program.
b) loss, damage or injury to participants in the program, and
to persons on the property at the invitation of EARTH or
as a result of EARTH's program, from any cause whatsoever,
except the willful, wanton or gross misconduct of DISTRICT's
officers, agents or employees.
c) loss of or damage to property of EARTH or of participants in
the program, and to persons on the property at the invitation
of EARTH or as a result of EARTH's program, from any cause
whatsoever, except the willful, wanton or gross misconduct
of DISTRICT' s officers, agents or employees.
d) loss, damage or injury to third persons, including employees
of DISTRICT, caused by the negligence or other wrongful act
or omission of EARTH, its officers, agents, employees,
supervisors or participants in the program.
e) loss of or damage to property of third persons, including
property of DISTRICT and its employees, caused by the
negligence or other wrongful act or omission of EARTH, its
officers, accents, employees, supervisors or participants
in the program.
Nothing herein shall be constructed to impose on EARTH responsi-
bility for any liability for which DISTRICT would otherwise be
responsible and which is in no way attributable to the conduct of
EARTH's program or activities under this agreement.
10. EARTH shall carry liability, property damage,- death and bodily
injury insurance during the term of this agreement covering,
among others, the insurable risks set forth herein, and DISTRICT
shall be named as additional insured on said policy. Said
policy shall be in the amount of not less than five hundred
thousand dollars per injury or deat

property damage. EARTH shall furnish DISTRICT a certificate of
insurance evidencing such insurance coverage. Such certificate

insurance shall provide that it shall not be cancelled or

11 . DISTRICT shall carry liability, property damage, death and bodily
injury insurance during the term of this agreement covering its
risks arising out of its ownership of the property in an amount
of not less than five hundred thousand dollars per injury or
death to one person, five hundred thousand dollars per occur-
rence, and five hundred thousand dollars property damage. -
12. EARTH hereby agrees to indemnify, defend and hold harmless the
DISTRICT from and against all liability for all claims, suits,
da_- ages, injuries, costs, losses and expenses, including
attorney' s fees, in any matter related to or occurring during
such recreational program, provided that the matter giving
rise to the liability is directly attributable to the, acts or
omissions of EARTH' s employees or agents, or otherwise arises
out of matters which by the terms of this agreement are the
responsibility of EARTH.
13. DISTRICT hereby agrees to indemnify, defend and hold harmless
EARTH, its officers, agents and employees from. and against all
liability for all claims, suits, damages, injuries, costs,
losses and expenses, including attorney' s fees, in any matter
related to or occurring during such recreational program, pro-
vided that the matter giving rise to the liability is directly
attributable to the acts of the DISTRICT ' s employees or agents
or otherwise arises out of matters which by the terms of this
agreement are the responsibility of DISTRICT.
14 . Each party shall, in good faith, attempt to avoid interference
with the activities and facilities of the other, in keeping with
the spirit and purposes of this agreement.
15. Either party may, without cause, withdraw unilaterally from this
agreement after notice in writing to the other party with the
result that this agreement shall be terminated at the end of
twenty (20) days thereafter.
