REGULAR COUNCIL MEETING, AUGUST 19, 2019
CALL TO ORDER
Mayor Carrie Tergin called the August 19, 2019 City Council meeting to order at 6:03
P.M.
ROLL CALL
The f ollowing Council Members were present for the roll-call:
Present: Fitzwater, Graham, Hensley, Hussey, Kemna, Mihalevich, Prather,
Schreiber, Ward, and Wiseman
Absent: None
A quorum was declared present.
ADOPTION OF THE AGENDA
A motion was made by Councilman Graham to adopt the amended agenda, adding
Item 4(c.) under Miscellaneous to recognize Lincoln University’s USDA grant fellows
from Jordan. Councilman Prather seconded the motion. There being no objection, the
motion to adopt the amended agenda was approved unanimously.
MISCELLANEOUS AGENDA ITEMS
Mayor Tergin invited Shelby Welling to the podium. Shelby was recognized and
congratulated for winning the Miss Missouri Pre-Teen crown.
Mayor Tergin then introduced the Lincoln University Women’s Outdoor Track and Field
Team and Coach Victor Thomas. The team won the 2019 NCAA Division II
Championship this past May 2019. The team also had an accumulating GPA higher
than 3.0 earning them the title, “National Scholar Team of the Year” by the United
States Track & Field and Cross Country Coaches Association.
Mayor Tergin and Councilman Graham welcomed Lincoln University’s USDA grant
fellows from Jordan. Dr. Majed El-Dweik, Dean of the Department of Agriculture,
introduced the fellows to the City Council and explained the grant that was awarded to
the University enabling the college to host the prestigious, intensive, two-week
fellowship program.
PUBLIC HEARINGS
a. Adopting the 2019-2020 Operating Budget
i. Associated pending Bill 2019-036.

A Staff presentation was made by Margie Mueller, Director of Finance and
Information Technology.
There being no one to speak on the bill, Mayor Tergin declared the
evidentiary portion of the public hearing concluded and stated that the City
Council would now take up the associated bill.
2019-036 sponsored by Councilman Mihalevich, entitled
AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, ADOPTING A
BUDGET AND PERSONNEL CLASSIFICATION PLAN FOR THE CITY FOR
THE PERIOD OF NOVEMBER 1, 2019, TO OCTOBER 31, 2020, AND
APPROPRIATING MONEY IN THE CITY TREASURY TO PAY THE COST
OF OPERATING THE CITY GOVERNMENT DURING THAT PERIOD IN
ACCORDANCE WITH THE BUDGET.
Councilman Mihalevich requested the bill be placed on the informal calendar
since the Budget Committee has not approved the budget yet. There was no
objection.
b. Establishing 2019 GRUT and Property Tax Levy Rate
i. Associated pending Bill 2019-037.
A Staff presentation was made by Ms. Mueller.
There being no one to speak on the bill, Mayor Tergin declared the
evidentiary portion of the public hearing concluded and stated that the City
Council would now take up the associated bill.

There being no objection, Bill 2019-037 was read third time by title, placed on
final passage, and passed by the following roll-call vote as Ordinance 15945.

Councilwoman W iseman motioned, and Councilwoman Ward seconded the motion to
approve the above appointment. The motion passed unanimously.
PRESENTATIONS FROM STAFF, CONSULTANTS, AND INVITED GUESTS
David Bandré, the attorney representing the property owners of 202 East High Street,
updated the City Council on the status of property. Councilman Hussey requested
another status update from Mr. Bandré by the next City Council meeting on September
3rd.
Matt Morasch, Director of Public Works provided an update on the concrete pavement
joint spall repair program.
ANNOUNCEMENTS BY MAYOR, COUNCIL, AND STAFF
Councilman Mihalevich announced the next Budget Committee meeting, scheduled for
this Thursday, August 22nd at 5:30 P.M. in City Council Chambers.
Councilman Graham announced the next Public Safety Committee meeting, scheduled
for Thursday, August 29th. If any Councilmembers have items they would like to be
added to the agenda, Councilman Graham requested that those items be emailed to
Kay Stuefer with the Police Department.
Mayor Tergin’s announcements included:
Missouri’s Bicentennial Celebration is scheduled for August 10, 2021.
Councilmembers wishing to contribute to the City’s United Way Pacesetter
Campaign should return the contribution forms to Jennifer Suchanek by
early next week.
Mayor Tergin will be presenting a plaque to the City of Columbia at their
City Council meeting later this evening, thanking the City for their flood
and tornado assistance.
She will also be attending the Honor Flight’s return at the Courtyard by
Marriott, at approximately 10:00 P.M. tonight.
The Guns and Hoses Hockey Game is scheduled for August 24 th, 7:00
P.M. at the Washington Park Ice Skating Arena. All proceeds will go to
SafetyNet. Tickets are sold out, but donations are still being taken for
SafetyNet.

Last Saturday was the Newsboys “Stronger after the Storm” concert which
was held at the Cole County Jaycees Fairgrounds.
Sonny Sanders, Director of Planning and Protective Services announced the next
Comprehensive Plan Community Workshop which is scheduled for August 29th,
5:30 P.M. – 7:30 P.M. at the Hawthorn Bank Community Room, 3600 Amazonas Drive.
LINCOLN UNIVERSITY STUDENT REPRESENTATIVE UPDATE – Caroline Wanjiru
Ms. Wanjiru made the following announcements:
Saturday, August 10th – Casino Night was a success.
Monday, August 19th – Fall 2019 classes started today.

d. Approve Change Order #2 with Lamke Trenching and Excavating, in the Amount
of $62,072.18, for Project No. 31139 – Basin 17 Sanitary Sewer Relief Basin
A motion was made by Councilman Mihalevich and seconded by Councilwoman
Wiseman to approve the Consent Items. The motion was approved unanimously.

After Council and Staff discussion, Mayor Tergin requested information be provided by
Staff on how other cities handle overtime and compensatory time as it relates to exempt
employees in emergency situations.

After citizens spoke against the bill earlier in the evening and City and Staff discussion,
with no objection, Councilman Hussey placed the bill on the informal calendar. City
Counselor Ryan Moehlman suggested dividing the bill into two, 2019-040 A and
2019-041 B for the next City Council meeting.

A motion was made by Councilman Graham to approv the August 5, 2019 Closed
Session Minutes. Councilwoman Ward seconded the motion. The motion passed
unanimously.

NEW BUSINESS
a. Mayor Tergin presented Special Tax Bill 17021 for consideration of release. West
Apartments presented proof of the bill paid to Republic Services for a pickup of
illegal trash dumping at their property. Councilman Graham motioned, and
Councilman Fitzwater seconded the motion to release the tax bill. The motion
passed unanimously.
b. Mayor Tergin stated that, pursuant to Sec. 610.021 of the Revised Statutes of
Missouri, she would entertain a motion to go into Closed Session to discuss the
following:
1) Legal actions, causes of action or litigation involving a public governmental
body and any confidential or privileged communications between a public
governmental body or its representatives and its attorneys. [Sec. 610.021(1)]
2) Leasing, purchase or sale of real estate by a public governmental body where
public knowledge of the transaction might adversely affect the legal
consideration therefor. [Sec. 610.021(2)]
A motion was made by Councilman Fitzwater to go into Closed Session for the
above-stated reasons, seconded by Councilman Hensley, and approved by the
following roll-call vote at 8:23 P.M.:

RECONVENE IN OPEN SESSION
