SEPTEMBER 16, 1969
INITIATION:
1. Mayor Harker called the regular meeting of the City Council to
order at 7:45 p.m.
2. The invocation was given by Father Stephen Blaire, St. Luke's
Catholic Church, 9451 Broadway, Temple City.
3. Mayor Harker led the Pledge of Allegiance to the Flag.
4. ROLL CALL:
PRESENT: Councilmen: Briggs, Merritt, Tyrell, Harker
ABSENT: Councilmen: Beckley
ALSO PRESENT: City Manager Koski, City Attorney Martin,
Director of Public Works Pizzorno, Planning
Director Dragicevich, Traffic Engineer Envall
Councilman Merritt moved to excuse the absence of Councilman
Beckley by reason of vacation, seconded by Councilman Briggs
and unanimously carried.
5. APPROVAL OF MINUTES:
Councilman Merritt moved to approve the minutes of the
regular meeting of September 2, 1969, as mailed, seconded by
Councilman Briggs and carried.
6 PUBLIC HEARING: 7:30 p.m. Re. Curb, Gutter and Driveway
Approaches - Halifax, east side, Olive to Freer.
City Manager Koski advised that Public Hearing had been set
to consider improvements on Halifax, east side, Olive to Freer,
for which petition signed by 85% of property owners had been
received. Estimated cost for the project was $2,500 to cover
surveys, inspection, paveout and rebate.
Mayor Harker declared the Public Hearing open, and invited those
in the audience who wished to speak either for or against the
matter to come forward.
Richard Fry, 5350 N. Halifax, inquired as to whether the street
would. be ,graded to eliminate the run. -off onto his property.
Staff was directed that this be given consideration in the design
of the curb and gutter and paveouts, and Director of Public Works
Pizzorno arranged to meet with Mr. Fry to discuss the details of
the problem at his particular location. No one else wished to spe <.
Councilman Briggs moved to close the Public Hearing, seconded by
Councilman Merritt and unanimously carried.
Councilman Briggs moved to find the project in the public interest
and to instruct the Superintendent of Streets to cause the work
to be done. The motion was seconded by Councilman Merritt and
unanimously carried.
7. PUBLIC HEARING: 7:30 p.m. Re. Appeal of Applicant, John
Marshall, re. Zone Variance Case No. 69- 292PC, 9240 Longden
City Manager Koski advised that an appeal had been received from
the applicant, John Marshall, in regard to Zone Variance Case
No. 69- 292PC, for which Public Hearing had been set. He reviewed

the reasons for the denial by the Planning Commission, advising
that: 1) the proposed parcels would contain 1,535 sq. ft. less
than required by the Zoning Code; 2) an existing old house located
on the subject property does not justify splitting the lot into
substandard size parcels, and that the old house could be upgraded
instead; and 3) the proposed parcels would not have a large yard
area in the back and would not be compatible with the development
immediately to the west.
Mayor Harker declared the Public Hearing open.
Planning Director Dragicevich, by use of exhibits, described the
properties involved, advising that each of the proposed lots
would contain 5665 sq. ft. of area, and a street frontage of 55 ft.
Councilman Merritt moved that the minutes and previous testimony
before the Planning Commission relative to the case be made a
part of the record of this Public Hearing, seconded by Councilman
Briggs and unanimously carried.
Mayor Harker invited those present who wished to speak in favor
of the appeal to come forward.
John R. Shaw, 5816 Temple City Boulevard, Attorney, representing
applicant John Marshall, advised that while the area is less than
that called for in the ordinance for two parcels, and that the
frontage is about 5' less, that this was the reason for requesting
the variance. He outlined financial disadvantages of building a
single family residence on the large expensive lot, and considered
the lot split and proposed construction of two residences as the
only means of upgrading the property which now contained an older
single family residence. He presented 2 petitions containing
signatures of 5 home owners in favor of the zone variance, photo-
graph of the present structure at Longden and Oak, and seven
other photographs of properties constructed by the builder, and
of other structures on lots of less than the required square
footage. He advised that if the property were split north /south
the frontage would be less, or approximately 512' of frontage.
William Newton, 6306 N. Oak, advised that his property was
diagonally across from 9240 Longden, and that he was in favor of
the lot split. His property, measuring 95' x 150' would also
be eligible for lot split if the subject property was given this
consideration.
Mayor Harker inquired if anyone wished to speak against the appeal.
Ross Ostrander, 9228 Longden, advised that he was on the west side
of the property in question, and that if the lot split were
approved with the two lots facing Oak, that he would be forced
into a position of having a key lot with the back of three
residences alongside his property. He advised that he would
have no complaint if the lot split were accomplished with both
lots fronting on Longden.
No one else came forward to speak either for or against the
matter.
Councilman Briggs moved to close the Public Hearing, seconded
by Councilman Merritt and unanimously carried.
Council reviewed the views set forth by the applicant and the
considerations of the Planning Commission, with the consensus that
there, was not a valid reason for granting a variance since
the applicant is not being denied something that others receive,
that economic reasons are not valid considerations for a variance,
that the granting of a variance would allow this property to be

B. Directional Signing to Santa Anita Race Track. Traffic
Engineer Envall advised that a request had been received from
the Oak Tree Racing Association to place directional signs
to the Santa Anita Race Track at the same, locations as they
have been placed in previous years, however that this year
the signs would remain at the designated locations from October 3,
1969 to April 8, 1970. Councilman Tyrell moved to grant the
request for the placement of directional signs at the locations
designated, namely: Baldwin Avenue at Lower Azusa Road, southeast
corner; Temple City Boulevard at Lower Azusa Road, southeast
corner; Temple City Boulevard at Las Tunas Drive, southeast
corner; Temple City ,Boulevard at, Ellis Lane, southeast corner;
and Las Tunas Drive at Rosemead Boulevard, southwest corner,
subject to the maintenance of the signs by the Association. The
motion was seconded by Mayor Harker and carried by the following
roll call vote:
AYES: Councilmen- Merritt, Tyrell, Harker
NOES: Councilmen - Briggs
ABSENT: Councilmen- Beckley
C. Sereno Drive and Sultana Avenue'- Boulevard Stop Sign.
Traffic Engineer Envall advised that the Traffic Commission
recommended placement of a boulevard stop sign with stop and
stop bar pavement markings on Sultana Avenue at the south
approach to Sereno Drive. Councilman Tyrell moved to approve,
seconded by Councilman Merritt and unanimously carried.
D. Rancho Real at Sultana Avenue - Additional Regulations.
Traffic Engineer Envall advised that the Traffic Commission
recommended placement of stop signs, stop and stop bar pavement
markings on Rancho Real at the east and west approaches to
Sultana Avenue. Councilman Merritt moved to approve, Councilman
Briggs seconded, and the motion carried unanimously.
10. AGREEMENTS
A. Title Insurance and Trust Company - Service Agreement for
Title Services. City Manager Koski advised that in order to
provide uniform rates and charges for services to governmental
agencies, an agreement had been drawn with Title Insurance
and Trust Company to bind them to furnishing these services at
set rates, for a one -year period. It was moved by Councilman
Tyrell, seconded by Councilman Briggs and unanimously carried
to approve the agreement for title services with Title Insurance
and Trust Company, to June 30, 1970, and authorize the Mayor
and City Clerk to sign.
B. Los Angeles County for Community Recreation Program,- Renewal
of Agreement. City Manager Koski presented a renewal agreement
for community recreation program with County of Los Angeles
Department of Parks and Recreation for the operation of the
recreational program at Emperor School, which is in unincorpor-
ated territory, in the amount of $2280. 'Councilman Tyrell
moved to approve, and to authorize the Mayor and City Clerk
to sign, seconded by Councilman Merritt and unanimously carried.
11. PERSONNEL APPOINTMENTS
City Manager Koski presented Resolution No. 69 -950, A RESOLUTION
OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY APPOINTING
PERSONNEL, for the appointment of Linda Lozar as Receptionist -
Clerk. Councilman Merritt moved to adopt, seconded by Council-
man Briggs and unanimously carried.

10' closer to the street than other properties which would not
be fair to other property owners, that certain considerations must
be made for the overall esthetic values of the community as set
forth in the Ordinance, and that the recommendations of the
Planning Commission were valid and should be upheld. Based on
these considerations, Councilman Merritt moved that the appeal
for zone variance be denied, and that the CtyAttorne' be instruc-
ted.to prepar.e;a resolution denying the- appeal; - seconded by
Councilman Briggs and unanimously carried.
At this point. Mayor Harker invited the YMCA representatives present
in the audience to come forward to speak in behalf of YMCA Week,
which had been proclaimed for the period of October 6 -12, 1969.
Richard B. Dame, Chairman of the Board of Directors, Temple City
YMCA, bestowed on Mayor Harker the title of Honorary Chief of Temple
City Nation, .in recognition of his _performance_as Mayor of the great
community of Temple City, and invited the members of the Council and
residents to attend the rally to be held at Temple City Park on
October 1 1 , 1969., from 1 p..m. to 7...p...m. as a._ speci.a.l..._.event of YMCA,
Week.
8. RECOMMENDATIONS FROM THE PLANNING COMMISSION - Meeting of
September 9, 1969
A. Drive -in, Drive - through, Take -out Restaurants. Planning
Director Dragicevich advised that the Planning Commission rec-
ommended consideration of amendment of the Temple City Zoning
Code re. drive -in businesses to be included in conditional use
permit category. Councilman Tyrell moved to set for Public Hear-
ing on October 21, 1969, at 7:30 p.m. in the Council Chambers
of the City Hall, seconded by Councilman Merritt and unanimously
carried.
B. Height of Walls, Fences and Hedges on Corner and Reverse
Corner Lots in Residential Zones. Planning Director Dragicevich
advised that the Planning Commission recommended consideration of
amendment of the Temple City Zoning Code with respect to the
height of walls, fences and hedges on corner and reverse corner
lots in residential areas. Councilman Tyrell moved to set for
Public Hearing. on October 21, 1969, at 7:30 p.m. in the Council
Chambers of the City Hall, seconded by Councilman Merritt and
unanimously carried.
C. Household Pets. Planning Director Dragicevich advised that
the Planning Commission wished to review Ordinance No. 69 -293,
with reference to household pets, and recommended postponement
of second reading and adoption of the proposed ordinance to the
next meeting of the Council. Councilman Briggs moved that second
reading of Ordinance No. 69 -293 relative to household pets be
held over to October 7,..1969, seconded by Councilman Merritt and
unanimously carried.
9 RECOMMENDATIONS FROM THE TRAFFIC COMMISSION - Meeting of
September 3, 1969
A. Pentland Avenue & Encinita Avenue - Additional Regulations.
Traffic Engineer Envall advised that the Traffic Commission
recommended placement of a 30 -foot white zone stenciled "MAIL BOX
USE ONLY" to accommodate mailing at the snorkel mail box on the
East side of Encinita Avenue, commencing 31 feet north of the
north curb line of Pentland Avenue to.a point 61 feet north. Also
that on Encinita Avenue at Pentland, there was not room for
movement of traffic without crossing the centerline when a car
was parked at this location, and that the Traffic Commission
recommended placement of three signs indicating "NO STOPPING AT
ANY TIME" on the east side of Encinita, from a point 18 feet
south of the south curb line to a point 258 feet southerly.
It was moved by Councilman Briggs to approve the additional
regulations outlined by the Traffic Engineer, seconded by
Councilman Tyrell and unanimously carried.

City Manager Koski presented Resolution No. 69 -951, A RESOL-
UTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY
APPOINTING PERSONNEL - TEMPORARY, providing for budgeted
part time recreation positions. Councilman Briggs moved to
adopt, seconded by Councilman Merritt and unanimously carried.
12. WARRANTS & DEMANDS: RESOLUTION No. 69 -952
Councilman Merritt moved adoption of Resolution No. 69 -952, A
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY
ALLOWING CLAIMS AND DEMANDS IN THE SUM OF $21,201.42, DEMAND
NOS. 667 THROUGH 753. Councilman Briggs seconded, and the
motion carried unanimously.
13 COMMUNICATIONS:
A.... -. United _Crusade _._Committee - to place thermometer sign in
Temple City Park. City Manager Koski presented a communication
from Robert H. Green, 1969 Community Campaign Chairman, for
United Crusade to erect a campaign thermometer sign in Temple
City Park for the 1969 United Crusade Campaign. Councilman
Briggs moved to approve, subject to the filing of certificate
of insurance naming the City additionally insured, seconded by
Councilman Merritt and unanimously carried.
B. League of California Cities - Selection of Voting Delegate
for Conference, September 28 to October 1, 1969 - San Francisco.
City Manager Koski presented a communication from the League of
California Cities, requesting each City to designate a voting
representative and alternate voting representative for business
to be conducted at the League Conference to be held September 28
to October 1, 1969, at San Francisco. It was moved by Council-
man Tyrell that Councilman Merritt be the voting representative
and Mayor Harker be named alternate. The motion was seconded by
Councilman Briggs and carried unanimously.
C. Church Women United - requesting permission to solicit for
UNICEF at the Halloween Season. City Manager Koski presented
a communication from Mrs. John Holthaus, Secretary, Church
Women United, requesting permission to solicit for UNICEF at
the Halloween Season, 1969. Councilman Briggs moved to approve,
seconded by Mayor Harker, and the motion carried by the follow-
ing roll call vote:
AYES: Councilmen- Briggs, Tyrell, Harker
NOES: Councilmen- Merritt
ABSENT: Councilmen - Beckley
D. Lions International - requesting permission to erect a
banner on behalf of White Cane Sight Conservation Project at the
intersection of Temple City Boulevard and Las Tunas. City
Manager Koski presented a communication from Willis Ward, Deputy
District Governor, District 4 -12, Lions International, to erect
a banner in behalf of the White Cane drive for funds, at the
intersection of Temple City Boulevard and Las Tunas Drive, from
September 29 through October 6, 1969. Councilman Tyrell moved
to approve, subject to the filing of insurance certificate
naming the City additionally insured, seconded by Councilman
Briggs and unanimously carried.
14. TIME FOR THOSE IN AUDIENCE WHO WISH TO SPEAK:
Jack Riley, 9530 Lower Azusa Road, Temple City, advised that
he was the spokesman for a group of 25 property owners, who
wished to complain of the nuisance created in their neighbor-
hood, caused by the Natter Tool and Manufacturing Company, and
that the problem was in the nature of a public nuisance. He

stated that the District Attorney's office had been contacted
and they had been advised that they did not have a criminal
complaint, and that the matter should be brought back to the
City, therefore he was requesting the City to direct an inves-
tigation into the matter. It was moved by Councilman Tyrell
to set the matter for Public Hearing on Thursday evening,
September 25, 1969, at 7:30 p.m. at an adjourned meeting of
the City Council, seconded by Councilman Briggs and unanimously
carried. Mr. Stan Christensen, Vice President and General
Manager of Natter Company was present in the audience and was
so notified of the hearing, as was Mr. Riley, spokesman for
Citizens Committee for Reasonable Quiet in Temple City.
15. MATTERS FROM CITY OFFICIALS:
A. Councilman Briggs inquired as to the progress of the Temple
City Boulevard Project, and Public Works Director Pizzorno
advised that a meeting had been held that morning to discuss
final aspects.
B. Councilrnan Tyrell complimented Mayor Harker on the
articles he has been contributing to a column in the Temple City
Times, in providing the public with information.
C. Councilman Merritt stated that although he had voted against
the City entrance signs, that he felt they were presenting a
fine impression to people entering the City. He noted however
that a couple of them are placed behind trees, and that the trees
will need to be trimmed at these locations.
D. City Manager Koski advised that Councilman Tyrell had
previously discussed a proposed resolution, whereby the Los
Angeles County Grand Jury would be urged to investigate the
breakdown of law and order in the schools, and presented
Resolution No. 69 -953 for consideration. Councilman Tyrell
moved to adopt Resolution No. 69 -953 entitled RESOLUTION OF THE
CITY COUNCIL OF THE CITY OF TEMPLE CITY URGING THE LOS ANGELES
COUNTY GRAND JURY TO INVESTIGATE THE BREAKDOWN OF LAW AND
ORDER IN OUR SCHOOLS AND MAKE PUBLIC ITS FINDINGS, seconded by
Councilman Briggs and unanimously carried.
16. ADJOURNMENT:
Councilman Merritt moved to adjourn to a personnel session at
9:15 p.m., seconded by Councilman Briggs and unanimously
carried.
At 10:00 p.m. Council reconvened, and it was moved, seconded
and carried to adjourn to Thursday, September 25, 1969, in
the Council Chambers of the City Hall, 5938 North Kauffman
Avenue, Temple City.
