• AN ORDINANCE REGULATING THE PERFORMANCEAOF
CONTRACTS AFFECTING PUBLIC PROPERTY OR
DIRECTLY AFFECTING THE PUBLIC WITHIN THE CITY
LIMITS OF TIFFIN', IOWA.
BE IT ENACTED by the City Council of 'the City
of Tiffin, Iowa :
SECTION I . Purpose. The purpose of this. Ordinance
is to protect the City of Tiffin and public property
from damage resulting from the performance of contracts,,
and to insure performance of contracts which affect the
public.
SECTION II . Permit. Before any person shall
perform any contract which effects public property
within Tiffin, Iowa, or has a direct effect upon the •
public within the City of'Tiffin, he or she must obtain
• a written permit from the designated representative of
the City Council . The application shall include a
description of the property, the name of the property
owner, the amount of the costs for the work, a general
description of the work to be done, the date when the
work is expected to begin, the date when the work is
expected to be done, a copy of any written contract, and
• the name and address of the person who would do the
work.
SECTION III . Bond. Bond, with good and sufficient
sureties, in an amount deemed adequate, not only to
insure performance of the contract in the time and '
manner prescribed, in the contract, but also to save,
indemnify, and keep harmless the City against all loss,
damages, claims, liabilities, judgments, costs and
expenses which may- in any way accrue against the City,
or which may in any way result from the performance of
the contract, may be required of each person upon
contracts involving amounts in excess of #`ED when
performance of- the contract may damage public property
within the City of Tiffin or have a direct effect upon
,the public within the City of Tiffin, and in the opinion
of the designated representative of the Council, the
public interest will be served thereby.

SECTION III . Enforcement. The designated
representative of the Council shall supervise the
performance of the contracts affecting public property
and the public, and enforce all regulations 'pertaining
thereto in accordance with this Ordinance. The
designated representative of the Council may make such
regulations as are necessary and that do not conflict
with this Ordinance.
SECTION IV. Penalty. Anyone who violates any of the
provisions of this Ordinance shall be subject, upon
condition, to imprisonment not exceeding 30 days, or a
fine not exceeding $100.00.
Section V. Repealer. All ordinances or parts of
ordinances in conflict with the provisions of this
Ordinance are hereby repealed.
Section VI . Severability. If any section,
provision, or part of this Ordinance shall be adjudged
to be invalid or unconstitutional, such adjudication
shall not affect the validity of the ordinance as a
whole, or any section, provision, or part thereof not
adjudged invalid or unconstitutional .
Section VII . Effective Date. This Ordinance shall
be in effect after its final passage, approval , and
posting as provided by law.
On the 10th day of August , 1988 at a
regular meeting of the Tiffin City Council , Tiffin,
Iowa, Councilperson Mor ah introduced
Ordinance No. CCEi4 , and' moved that it be given its
first reading. The motion was seconded by Councilperson
Spivey
Ayes:
Spivey , Stratton , Morgan , Stoner , Eggers
Nayes:
Five members of the council being present and
having voted "Aye" , Mayor Glenn Potter declared Motion
carried, and Ordinance No. 154,,,,E was read the first time
and discussed and placed on record.
Thereupon, it was moved by Councilperson stratton
and seconded by Councilperson Eggers
that the laws and rules providing that ordinances be
considered and voted on for passage at two council,
meetings prior to the meeting at which it is to be
finally passed be suspended and dispensed with and that
Ordinance No. '15.g be placed on its last reading.

Spivey , Stratton , Morgan , Stoner , Eggers -
Nays:
Five members of the council being present and
having voted "Aye" , Mayor Glenn Potter thereupon
declared the motion to be carried, and Ordinance No.
X154? was then placed upon its last reading and was read
the last time.
Thereupon, it was moved by Councilperson Eggers
and seconded by Councilperson Spivey
that Ordinance No. 1;54) be placed upon its final
passage and adopted.

Spivey , Stratton , Morgan , Stoner , Eggers
Nays:
Five members of the Council being present and
having voted "Aye" ,Mayor Glenn Potter declared the
motion carried, and the Ordinance passed and adopted.
Whereupon the Mayor declared that Ordinance No.
1:541 be adopted and signified his approval of the same
by fixing ,his signature thereto.
Passed by the Council on the 10th " day of
August , 1988 and approved by the Mayor on the
10th day of August 1988.

I, Clerk of the City of Tiffin, . Iowa, state that an
Ordinance entitled AN ORDINANCE REGULATING THE
PERFORMANCE OF CONTRACTS FAFFECTING .PUBLIC PROPERTY OR
DIRECTLY AFFECTING THE PUBLIC WITHIN THE CITY LIMITS OF
TIFFIN, IOWA and known as 154 ' was duly passed by the
Council on the 10th day of August , 1988 and
signed by the Mayor on the . 10th- day ,of
August , 1988 and published on the 15th day
of August , 1988 by posting copies thereof in
three public places within the limits of the City of
Tiffin, -Iowa.
