Home My Public Portal AboutOrdinances-1989-159 Ordinance No. 1989-1589 page 1 ORDINANCE 1989-159 AN ORDINANCE AMENDING THE ZONING ORDINANCE NO. 1979-83 OF THE MUNICIPAL CODE OF 'TIFFIN, IOWA BY CHANGING THE USE REGULATIONS OF CERTAIN PROPERTY FROM R-1 (SINGLE-FAMILY RESIDENTIAL) TO M-1 (INDUSTRIAL) BE IT ENACTED BY THE CITY COUNCIL OF TIFFIN, IOWA: SECTION I. Purpose. The purpose of this Ordinance is to amend the present City of Tiffin Ordinance No. 1979-83 by changing the use classification of the real estate described in Section II from R-1 (single-family residential) to M-1 (industrial). ' SECTION II. Amendment. The parcel of land hereinafter described shall be zoned as follows: pn s From R-1 (single-family residential) to M-1 (industrial) Commencing at a concrete nail found at the South Quarter corner of Sec 28, Twp 80N, R7W of the 5th .P,M: N00'00"E (an assumed bearing) along the W line of the SE Qtr of said Sec 28, 630.45 ft; thence N87 40'24"E, 594.56 ft; to a point which is 50.00 ft normally distant Northwesterly of the centerline of the Main trackage of the Chicago, Rock Island and Pacific Railroad Co; and which point is the point of beginning; thence N2 19' 36"W, 100.00 ft, to a point on the Southeasterly line of Railroad St; thence S87 40'24"W, 321. 25 ft. along said Southeasterly line; thence S2 19' 36"E, 100.00 ft, to a point which is 50.00 ft normally distant Northeasterly of said Railroad centerline; thence N87 40'24"E, 321.25 ft to the point of beginning. SECTION III. Authorization. The Mayor or other designee of the City Council is hereby authorized and directed to change the Zoning Map of the City of Tiffin, Iowa, which was duly recorded in Book 19,_ page 53, of the Records of Johnson County, Iowa, to conform to this amendment, upon the final passage, approval and publication of the ordinance as provided by law. SECTION IV. CERTIFICATION. The City Clerk is hereby authorized and directed to certify a copy of this Ordinance to the Recorder of Johnson County, Iowa, upon final passage and publication as provided by law. SECTION V. Repealer. All ordinances, or parts of ordinances, in conflict with the provisions of thisordinance are hereby repealed. ' SECTION VI. Severability. If any section, provision or part of this ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not affect the ordinance as a whole, or any section, provision or part thereof not adjudged invalid or unconstitutional. Ordinance No. 1989-1589 page 2 SECTION VII. Effective Date. This ordinance shall be in effect after its final passage, approval and posting as provided by law. Councilman Spivey introduced the foregoing ordinance which was then duly read and considered by the Council. Its adoption was moved by Councilman Stoner and sec nded by Councilman Spivey . On roll Call vote Councilman Eggers , Morgan , Spivey , Stoner , Stratton voted "Aye". Councilman voted "Nay". Mayor declared motion carried. Councilman Eggers then Moved that the rule or law requiring three readings of this ordinance on three different dates be dispensed with. Seconded by Councilman Spivey On roll call vote Councilman Eggers , Morgan , Spivey , 'Stoner , Stratton voted "Aye. " Councilman voted "Nay". Councilman Stratton then moved for final adoption of this ordinance, seconded by Councilman Morgan . On roll call vote Councilman Eggers , Morgan , Spivey , Stoner , Stratton voted "Aye.
