The City Council of Tiffin, Iowa, hereby makes the ` following findings: A: That the City Council herd a public hearing on the proposal contained- in the resolution vacating the alley located +` in Block 2 , of the Original Town of Tiffin, Iowa, as shown-by the plat in Deed Record 27, Page'462 , -of the Records of Johnson County, Iowa, Recorder, which is bordered by Grant Street and College Street to the east and west, and is- between Second and Railroad Streets in Tiffin-, Johnson County, Iowa, at Tiffin fire station Tiffin., Iowa-, on the 12th day of July 1989 , at 7: 00 o'clock p . m. after the City Clerk- had published notice of the public hearing as required by law in the following manner: Publication of the'"resolution vacating the alley located in Block 2., of the Original° Town of Tiffin, Iowa, as shown by the plat in Deed Record 27 , Page 462 , of the Records of Johnson County, Iowa, Recorder, which is bordered by Grant Street and College Street to the east and west, and is between `Second and Railroad Streets in Tiffin, Johnson County, Iowa, in the Clear Creek Leader on the 5th_ day of July , 1989 , which is a newspaper published at least Once weekly and having general circulation in the City of Tiffin, Iowa. 'T B. That the above-described property is not needed for the use of the public. 2.. The alley .located in Block 2 , of the Original Town of Tiffin, Iowa, as-shown by the plat in Deed Record 27 , Page 462 , of the Records of the Johnson County, Iowa, YRecorder, which is bordered by Grant Street and College Street to the east and west, and _is between Second and Railroad Streets- in Tiffin, Johnson County;_ Iowa, is hereby vacated and declared no longer a part of' the public grounds of Tiffin, Iowa. L • • 1 3 • 4 Section 3 . Repealer. All ordinances or parts of ordinances in conflict with the provisions of this Ordinance are hereby repealed. Section 4 . Severability. If any section, provision, or part of this Ordinance shall be adjudged to be invalid or uncon- stitutional , such adjudication shall not affect the validity of the ordinance as a whole, or any section, provision, or part thereof not adjudged invalid or unconstitutional . Section 5 . Effective Date. This Ordinance shall be in effect after its final passage, approval , and posting as provided by law. On the 12th day of July , 1989 at a regular meeting of the Tiffin City Council , Tiffin, Iowa, Councilperson Spivey introduced Ordinance No. 160 , and moved that it be given its first reading. The motion was seconded by Councilperson Stoner Ayes: Spivey , Stratton, 1Morgan , Stoner Nayes: . . . . . . Absent : Eggers Four members of the council being present and having voted "Aye" , Mayor Glen Potter declared Motion carried, and Ordinance No. 160 was read the first time and discussed and placed on record. l Thereupon, it was moved by Councilperson Spivey and seconded by Councilperson Stoner that the laws and rules providing that ordinances be considered and voted on for passage at two council meetings prior to the meeting at which it is to be finally passed b1e suspended and dispensed with and that Ordinance No. 160 bei placed on its last reading'. Ayes : Spivey , Stratton , Morgan , Stoner Nays: Absent : Eggers Four members of the council being present and having voted "Aye" , Mayor Glen Potter thereupon declared the motion to be carried, and Ordinance No. 160 was then placed upon its last reading and was read the last time. Thereupon, it was moved by Councilperson' Stratton and seconded by Councilperson Spivey that Ordinance No. 160 be placed upon its final passage and adopted. I Ayes: Spivey , Stratton , Morgan , Stoner Nays: Absent : Eggers Four members ofIthe Council being present and having voted "Aye" , Mayor Glen Potter declared the motion tarried, and the Ordinance passed and 'adopted.
