ORDINANCE NO. 1990-162
AN ORDINANCE PROVIDING FOR A WATER AGREEMENT WITH. THE IOWA
DEPARTMENT, OF TRANSPORTATION.
BE IT ORDAINED by the City Council of Tiffin, 'Iowa:
Section 1 . Purpose: The purpose of this ordinance is to
allow the Mayor and Clerk to enter into an agreement with the
Iowa Department of Transportation, wherein in consideration of
one dollar and other valuable consideration, the City of Tiffin
would provide water service to the north and south rest areas on
Interstate 80 , located in Section 32 , Township 80 , Range 7 , West
of the 5th Principal Meridian, Johnson Countyl, Iowal.

Section 2 . Findings : The City Council If Tiffin, Iowa,
finds that it would be in the best interest of the City of Tiffin
to enter into an'- agreement with the Iowa Department[ of
Transportation, wherein the City of Tiffin provides water to the
Department of Transportation at their rest areas located in
Section 32, Township 80, Range 7, West of the 5th Principal
Meridian, Johnson County, Iowa, in exchange for a fee.
Section 3 . Contract: The Mayor and Clerk are hereby
authorized to enter into an agreement with the Iowa Department of
Transportation, wherein the City of Tiffin, Iowa, agrees to
furnish water to the Iowa Department of Transportation-north and
south rest areas on Interstate 80 , located in Section 32 ,
Township 80 , Range 7 , West of the Fifth Principal Meridian, in
exchange for fees to be paid.
Section 4. Repealer. All ordinances or parts of
ordinances in conflict with the provisions of this Ordinance are
hereby repealed.
Section 5. Severability. If 'any section, provision, or
part of this Ordinance shall. be4adjudged z to- be invalid or uncon-
stitutiona-1 , such' adjudication shall ,,not affect The ,validity of

Section 6 . Effective Date.-. This Ordinance shall be in
effect after its final passage, approval , and posting as provided
by law.,
On •the 10th day of January , 1990 at a regular
meeting of the Tiffin City Council , Tiffin, Iowa, Councilperson
Morgan introduced Ordinance No. 162 , and moved
that it be given its first reading. The motion was seconded by
Councilperson Slaymaker
Ayes: Bartels , Slaymaker , Brown , Morgan , Stoner
Nayes: - -

Five members of the council being present and having voted
"Aye" , Mayor Glenn S. Potter declared Motion carried, and
Ordinance No. 162 wasread„ the first time and discussed and
placed on record.
Thereupon, it ,was moved by Councilperson Br.,own
• and secondedcby,,Councilperson : 'Slaymaker
that the laws and rules providing that ordinances be considered
and voted on for passage at two council meetings prior to the
meeting at which it is to be finally passed be suspended and
dispensed with and that Ordinance No. 162 be placed on its last
reading.
Ayes: Bartels , Slaymaker , Brown , morgan , Stoner
Nays:
Five members of the council being present andi having voted
"Aye" , Mayor Glenn S. Potter thereupon declared the motion to be
carried, and Ordinance No. 162 was then placed upon its last
reading and was read the last time.
Thereupon, it was moved by Councilperson Morgan
and seconded by Councilperson _ - Brown. ..
that Ordinance No. 162 be placed upon its final passage and
adopted.
Ayes : Bartels , Slaymaker , Brown , Morgan , Stoned
Nays:
Five members of the Council being present and having voted
"Aye" , Mayor Glenn S. Potter declared the motion carried, and the
Ordinance passed and adopted.
Whereupon the Mayor declared that Ordinance No. 162 be
adopted and signified his approval of the same by fixing his
signature thereto. lI

Ordinance entitled An Ordinance Providing for a Water Agreement
with the Iowa Department of Transportation and known as 162
was duly passed by the Council on the 10th day of
January , 1990 and signed by the Mayor on the 10th day
of January , 1990 and published on the 22nd day of
January , 1990 by posting copies thereof in three public
places within. the limits of the City of Tiffin, Iowa.
