SUBJECT: District Position on the Advisory Measure
Concerning Private Use of Moffett Field
This item has been placed on the agenda at the request of
Director Shelley, who will be inviting a member of the Mountain
View City Council to address the Board on the use of Moffett
Field by civilian pilots. Director Shelley has also indicated
he will be asking the members of the Board to take a District
position opposing such use.

SUBJECT: Procedure for Filling Board Vacancy in Ward 3
Introduction: Vice-President H. Turner, serving as interim Board Presi-
dent, requested this item be placed on the agenda of a Special Meeting
because of the timing for setting an election on this matter if a majority
of the Board so desires. For your information, Barbara Green resigned
her position as Director for Ward 3 (the Sunnyvale area north of Fremont
Avenue) as of Sunday, August 14 , 1983, and as S. Norton stated at your
Regular Meeting of August 10, 1983 , the Board, according to Section 1780
of the Government Code, may appoint someone to fill the vacancy or call
an election within 60 days of the occurrence of the vacancy.
This matter has been placed before you at this time to discuss the
possible alternatives for filling the vacancy. It should be noted that
if the Board wishes to consolidate a special election to fill the
vacancy with the still uncertain statewide election on December 13,
certain Board action would be necessary prior to Monday, August 22, 1983 .
Discussion: The District Clerk has been in contact with John E. Molchan,
Assistant Registrar of Voters for Santa Clara County, and S. Norton
regarding the alternatives for filling the vacancy, and the following
summarizes information received:
1. Filling Vacancy by Appointment: The Board of Directors may appoint
to fill the vacancy within 60 days of the occurrence of the vacancy.
The Board needs to determine the exact procedure it will follow 'if the
vacancy is filled by appointment. A committee of N. Hanko and
K. Duffy was appointed at the August 10 Regular Meeting to review
the application form that might be used. This was in anticipation
of a procedure decision at your meeting of August 24 .
2. Filling the Vacancy by Calling an Election: If the Board decided
to fill the vacancy by the election process, the first plausible
election date might be Tuesday, December 13 , 1983. However, there is
still a question as to whether this special statewide election will
actually be held.
Assuming the special election is held, the Board would have to pass
a resolution calling the election and requesting consolidation with
the special election. This action would have to be done prior to
Monday, August 22 , 1983, which is the opening date of the nomination
period for the December 13 election.
Election costs for consolidating with the possible December 13
special election are estimated at $13,500.

If the state' s special election were cancelled after the Board
called its Ward 3 election on that date, the District' s election
would not take place because of the cancellation of the special
election.
The next available election date would then be Tuesday, April 10,
1984 . In the event there was no other item on the ballot for the
Sunnyvale residents who comprise Ward 3, the total cost of the elec-
tion would have to be covered by the District and would be approxi-
mately $26,000. At this time,John Molchan does not know of any
items for Sunnyvale residents that would appear on the April 10
ballot.
It should be noted, a person appointed or elected to fill B. Green' s
term in office would have to run for election or reelection in Novem-
ber, 1984.

RESOLUTION OF THE BOARD OF DIRECTORS OF
THE MIDPENINSbLA .REGIONAL OPEN SPACE
DISTRICT CALLING ELECTION AND REQUESTING 86-06^�
CONSOLIDATION (SANTA CLARA COUNTY--WARD 3) jwo(442-0f
WHEREAS, a vacancy has been created by the resignation of
the Director of Ward 3 of the Midpeninsula Regional Open Space District,
and WHEREAS, the Board of Directors wishes to fill this vacancy I
by calling an election; and
WHEREAS, a special statewide election has been scheduled with-
in Santa Clara County on December 13, 1983;
NOW, THEREFORE, the Board of Directors of the Midpeninsula
Regional Open Space District does resolve as follows:
1. Pursuant to Government Code Section 1780, the Board of
Directors of the Midpeninsula Regional Open Space Dis-
trict does call an election in the District for the
election of one (1) member of the Board of Directors of
the District in Ward 3 on Tuesday, December 13, 1983
2. That said election be consolidated with the statewide
special election to be held in Santa Clara County on
said date.
3. That the election precincts, polling places, voting
booths, and election officials in each of the precincts
shall, to the extent practicable, be the same as provided
for the statewide election on said date, as prescribed by
the ordinance, order, resolution or notice of the Board
of Supervisors of said County calling, providing for or
giving notice of such other election and which sets forth
such precincts, voting booths, polling places and elec-
tion officials.
4 . That the Board of Supervisors of Santa Clara County is
hereby authorized and instructed to canvass the returns
of said election for the office of Director - Ward 3 of
the Board of Directors of the Midpeninsula Regional open
Space District and is requested to certify the results of
said election to the Board of Directors of the District.
5. The boundaries of the ward or subdivision, for the purpose
of electing a Director for Ward 3 , shall be the same as those
established by the Board of Directors of the Midpeninsula
Regional Open Space District by Resolution 82-29 , adopted
on July 14 , 1982.
6. The Board of Directors further requests, pursuant to
Elections Code Section 22003, that the County Clerk,
Registrar of Voters or other appropriate County official
be authorized to render services to the District relating
to the conduct of said election. The services shall be
of the type normally performed by such County official (s)

in assisting the clerks of special districts in the con-
duct of elections including, but not limited to, checking
registrations, printinq and mailing ballots, ballot argu-
ments, candidates' statements, hiring election officers
and arranging for polling places, and providing and dis-
tributing election supplies.
7. The Clerk of the Midpeninsula Regional Open Space District
is hereby authorized to hire the services of the appro-
priate officials of said County to aid in the conduct of
said election as hereinabove provided, and the General
Manager of the District is hereby authorized and directed
to pay the cost of said services, provided that no payment
shall be made for services which said County officials are
otherwise required by law to perform.
8. The District Clerk is hereby directed to submit a certi-
fied copy of this resolution to the Board of Supervisors
of the County of Santa Clara, and to the appropriate
County election officials of said County.
