Absent: Barbara Burgo Also present: Janine Perry, Mary Ellen Ackerman, Marion Hobbs, Dick Perry, David i Pranga, Steve Jones, David Hill, Doug Scalise, Ellen St. Sure, and Jillian Douglas. Approval of minutes of December 9, 2015 meeting. Motion made by Peter Johnson to approve the December 9, 2015 meeting minutes as amended. William Klein seconded, VOTE: 6-0-1 2. Acceptance of funding request from Cape Rep Theatre and possible vote to refer the request to the Brewster Historical Commission for its review and recommendation. Janine Perry, Artistic Director of the Cape Rep Theatre reviewed the application for funds to support the first phase of a project to rehabilitate the Crosby Barn on Isaac F. and Sarah Crosby Historic Site occupied by the Cape Cod Repertory Theatre Co. Cape Rep Theatre , has a long-term lease with the Commonwealth and has agreed to protect the buildings located on the property. The Crosby Barn is listed on the State Register of Historic places and is eligible for listing on the National Register of Historic Places. It needs some structural work to rehabilitate it and save it. A structural analysis has been done and will begin with a foundation being installed under the building as phase 1. The total cost of phase I is estimated at $484,890 and they are CPC Meeting Minutes j January 13,2016 Page 1 of S I 1 1 1 requesting $225,000 of CPC funds for the first phase. The figures are not in from the architect or engineer on the rest of the restoration or Phase II. There was a brief review of the history of the property and the proposed project and it is moped to keep the character and integrity of the original barn dating from 1889. A site visit to the property can be arranged. Motion made by Roland Bassett to refer this to the Brewster Historic Commission for their review, Elizabeth Taylor seconded, VOTE: 7-0-0 The CPC will also refer this project to their Historic Consultant, Eric Dray for his take on the j project and he will be asked to perhaps attend the Historic Commission meeting if they want. The meeting moved to Agenda item 9. 3. Report of the Housing Sub-committee's meetings on the Harwich Ecumenical Council for the Homeless' $118,000 funding request for a second year of the Housing Emergency Loan E Program and on Cape Cod Village's $100,000 funding request for 16 units of community I housing for adults with autism at a site in Orleans. The Chair reviewed the two Housing Subcommittee meetings held January 8, 2016 and January 13, 2016. There have been four home repair loans approved this year with another 3 applicants on a waiting list. There appears to be demand for the program. It is hoped to streamline the process as change orders bog down the process currently. Each time the price changes to the scope of work, there needs to be a new vote by the Committee. It is hoped going forward that the votes taken by the Committee be "up to $25,00W' A mortgage modification will be made once the project is completed. Another avenue would be to allocate the funds to HECH at the beginning and allow them to administer the program with the Assistant Town Administrator's approval. However, in our instance where the town holds the mortgage, the Board of Selectmen will need to sign off on each loan, but perhaps at the end of the process. HECH recommends keeping each loan capped at $25,000. The purpose is to maximize the distribution of the funds available and any funds not expended will be returned to the town. Part of the close out process of HECH will be an evaluation of the program so that CPC will receive some feedback. There was a review of the Cape Cod Villages application and the Housing Subcommittee is making a favorable recommendation for this project. It is felt that there are currently 5 or 6 Nauset students and there are adults living at home that may be eligible to live in these facilities. The plan is to advertise and list the eligibility requirements that include a diagnosis, receiving benefits from the state department, and being compatible with others living in the homes. There was discussion on perhaps investigating if there was any way that a regional or local preference via a lottery could be put somehow in the process since Brewster would be putting up this money. Wellfleet and Provincetown CPCs have also been approached for funds. Orleans has a $300,000 request for this regional facility that will be located in their town. It was requested to know if these16 units would be lifetime units. It is recommended that there be a deed restriction that if the property is sold for another purpose, that the $100,000 comes back to the town. CPC Meeting Minutes January 13, 2016 Page 2 of 5 i 4. Vote to increase the funding amount on two of the mortgages in the Harwich Ecumenical Council for the Homeless' Housing Emergency Loan Program. Full information has not been received to date so this will be voted at the next meeting. i 5. Discussion and vote on a new application/mortgage in the Harwich Ecumenical Council for the Homeless' Housing Emergency Loan Program. This project is still in the process of getting estimates. I i 6. Vote on an Open Space professional services request. Jeanne Boehm recused herself. Peter Johnson left the meeting. There was a review of the Open Space professional appraisal request for $3,000, Motion made by Roland Bassett to approve the open space acquisition professional appraisal request for $3,000. Bill Klein seconded. VOTE: 5-0-0 It was decided to submit an application for this open space application, but it may not make the Spring Town Meeting. 7. Review of the draft 2015 Community Preservation Committee annual report for the Town Report. Elizabeth Taylor asked the Committee to review the annual report and any suggested changes/revisions are to be submitted to her. 8. Treasurer's report. Elizabeth Taylor reviewed the Treasurer's report. Additional information will be requested of the Finance Director to determine funding available. There was discussion on where the current applications would be charged and it may make the most sense to take these out of the 30 percent fund. 9. Update on the Brewster Baptist Church project. There was a review of the issues that have occurred due to the materials used on the exterior of the Brewster Baptist Church. There was a review of the responses and opinions from Town Counsel, Eric Dray, and Stuart Saginor. Removing a structure from the National Register is a complicated process and has not occurred. There are seven Massachusetts historic districts or properties located in Brewster and some were briefly reviewed. The Church is still listed in Massachusetts Historic District, along with 376 other properties, and is a contributing structure. In the future the CPC may want to list the non-contributing structures as not eligible for CPC funding. CPC Meeting Minutes January 13, 2016 Page 3 of 5 I II There was discussion on amending the award letter to reflect a local historic district restriction instead of the Massachusetts historic district restriction. The Chair has been in touch with the historic consultant, Eric Dray on this issue. Town Counsel is looking at this currently to see if this local historic deed restriction will resolve the issue. There was discussion on whether the deed restriction should be only on the exterior of the building or include the interior (particularly the second floor) and exterior. The original proposal was strictly for the exterior. The deed restriction is being drafted by Eric Dray and needs to be reviewed by Town Counsel. It will be forwarded to the Church's legal counsel for review once completed. It is felt that the historic nature of the Church was important to the town as when discussing this originally, part of the Church's discussion was of tearing down the Church and building a more energy efficient building to meet the Church's needs as this would have been more economical. It was decided due to the historic importance to the town that they would invest in j the current building if the town would partnership with them. The consensus of the Committee was to skip the historical commission step, going against 1 Town Counsel advice. The next step will be to revise the award letter dated July 13, 2014 with item #4 to read "submitted and approved by the Board of Selectmen and the Brewster Community Preservation Committee" taking out the Massachusetts Historic Commission approval. The Committee returned to the agenda item #3. 10. Discussion on whether to request that Community Preservation Committee meetings be regularly televised. There does not appear to be any funding restraints with having our CPC meetings videotaped or televised though permission is needed from the Board of Selectmen to have it televised. There was discussion on the pros and cons of videotaping and televising the meetings. Ellen St. Sure would like to be able to view the videotape of the meetings. It was the consensus of the Committee that though information about the CPC is available on the website, it may be a good idea to have a videotaped archive of the meetings going forward. i 11. Topics that can be legally discussed that the chair could not have reasonably anticipated. The Cemetery application has been withdrawn and will be resubmitted in the fall. i 12.
