HomeMy Public PortalAbout2722-1972 - Stricken - Prohibiting the use of Crossbows and Bow & Arrows in the CityATT: ORDINANCE COMMITTEE AMENDED ORDINANCE NO. 2722-1972 AN ORDINANCE PROHIBITING THE USE OF CROSSBOWS AND BOWS AND ARROWS IN THE CITY OF RICHMOND, INDIANA, AND AMENDING CHAPTER 43, "OF- FENSES AGAINST PUBLIC PEACE, SAFETY AND WELFARE," OF THE MUNI- CIPAL CODE OF SAID CITY. WHEREAS, The Common Council of the City of Richmond, Indiana, has the power to enact an ordinance preventing or regulating the use of firearms, fire -works, bonfires or other things or practices tending to endanger persons or property (Burns 48-1507); WHEREAS, Chapter 43, "Offenses against Public Peace, Safety and Wel- fare," of the Municipal Code of the City of Richmond, In- diana, provides for the well-being of the community and contains restrictions in compliance with public morals and conscious; WHEREAS, Section 1.07 of said Municipal Code provides for penalties for any person(s), firm(s), corporation(s), agent(s), or employee(s), convicted of violating said Municipal Code; WHEREAS, a "crossbow" as used herein is defined as a missile weapon consisting of a bow made of wood, metal, fiberglass, or other such material, and mounted transversely on a rifle - like stock; WHEREAS, the firing of crossbows within the corporate limits of said City of Richmond constitutes an unnecessary and serious hazard to the safety of the community; WHEREAS, an "arrow" as used herein is defined as a long, slender shaft with a pointed head and a "bow" as used herein is defined as a weapon made from a strip of elastic wood, fiberglass, steel, or other such material, bent by a cord and projecting an arrow by its recoil when suddenly released. WHEREAS, the shooting of bows and arrows within the corporate limits of saidCity of Richmond constitutes a potential source of danger in the community. NOW THEREFORE, BE IT ORDAINED that the Common Council of the City of Richmond, Indiana, that: Section one. The following section be added to Chapter 43, "Offenses against Public Peace, Safety and Welfare," of the Municipal Code of said City of Richmond: 43.15 CROSSBOWS; BOWS AND ARROWS. (A) No person shall fire any crossbow at a mark or target or in any way discharge any crossbow within the city. (B) Crossbow as used in the preceding section (43.15A) shall be defined as a missile weapon consisting of a bow made of wood, metal, fiberglass, or other such material, and mounted transversely on a riflelike stock. (C) No person shall shoot a bow and arrow at anything other than a well-defined target such as one made of hay, news- paper, excelsion or other such material and covered with bur- lap, paper, or other such material indicating the target bands used in scoring within the city. Firing of the weapon should at no time endanger lives or property. (D) Bow as used in the preceding section (43.15C) shall be defined as a weapon made from a strip of elastic, wood, fiber- glass, steel or other such material, bent by a cord and pro- jecting an arrow by its recoil when suddenly released and arrow as used in the preceding section (43.15C) shall be defined as a long, slender shaft with a pointed head. Section two. This ordinance shall be in full force and if effect from and after its passage, approval by the Mayor and publication as by law required.
