AN ORDINANCE AMENDING ORDINANCE 2325-1968 COMMONLY KNOWN AS THE
ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA, ADOPTED JUNE
3, 1968.
WHEREAS, Mayor Byron E. Klute of the City of Richmond, Indiana, has
requested the Department of City Planning to draft and sub-
mit an ordinance to Common Council to closely regulate the
number of service stations permitted in the community.
WHEREAS, the Department of City Planning has examined problems as-
sociated with service stations on both a local and a
national level.
WHEREAS, it has been found both on a national level and a local
scale that oil companies are abandoning service stations,
while at the same time, there is a continuing demand by
large oil companies to purchase new sites for additional
development.
WHEREAS, abandoned service stations constitute a hazard to the pub-
lic health, safety, and welfare of the community as well
as constitute a blighting influence within the neighbor-
hoods in which the stations are located.
WHEREAS, the uncontrolled development and location of service stations
are not in the best interest of the community.
WHEREAS, the Zoning Ordinance of Richmond, Indiana. n—, permits
Motor Vehicle Service Stations in C-2, C-3, and C-4. Districts.
and the Planning Commission suggests that Motor vehicles
service stations should be allowed in said Districts only
by special use.
WHEREAS, Section 31.005 of said Zoning Ordinance now reads as follows:
31.005 Motor Vehicle Service Motor vehicle service station and
garage, isplay, hire, sales and general automobile re-
pair not including major body or fender repairs or the
storage or parking of buses subject to the provisions of
- Article 44.
WHEREAS, Section 33.002 now reads as follows:
33.111 Wholesale, Motor Vehicle Service, Production Farm Implement,
Miscellaneous; T e following uses provided tthatbuildings
shall be at least fifty (50) feet from any R-District and
shall have no openings adjoining any R-District other than
stationary wiirlows and fire escapes:
(1) Automobiles, trucks, trailers, farm implements for
sale, display, hire,_,major or minor repair including sales,
lots, used car lots;' trailer lots, body and fender shops,
paint shops and bus storage.
(2) Battery and tire service stations.
(3) Building materials, sales.
(4) Commercial greenhouses.
(5) Contractor or construction shops, such as: Building,
cement, electr-ical, roofing, refrigeration, heating and
ventilating, masonry, painting, plumbing, air-conditioning.
(6) Dry-cleaning establishments.
(7) Frozen food lockers.
(8) Garages, model display and sales.
(9) House trailer sales.'
(10) Laundries.
(11) Linen, towel, diaper and other similar supply service.
(12) Machinery sales.
(13) Mail order house.
(14) Monument sales.
(15) Motorcycle sales, including servicing and repair.
(16) Repair of household or office machinery or equipment.
(17) Trailers, for motor vehicles, sales and rentals, not
including house trailers or mobile homes.
Production and processing, limited to the following uses or
products:
(18) Advertising displays.
(19) Art needle -work and hand weaving.
(20) Awnings, venetian blinds, window shades.
(21) Bakeries, wholesale.
(22) Books, hand binding and tooling.
(23) Brushes and brooms.
(24) Carpenter shops for custom furniture making.
(25) Clothing, custom manufacturing and alterations, for
retail only.
(26) Cosmetics, drugs and perfumes.
(27) Dentures.
(28) Food processing, packaging and distribuing (except meat
and fish, sauerkraut, vinegar, years and the rendering or
refinishing of fats or oils).
(29) Garages and parking lots, other than accessory, for
the storage of motor vehicles including buses and bus bodies
(but not trmck trailers) and subject to the provisions of
Chapter 10.
(30) Glass cutting and glazing.
(31) Jewelry (from precious metals.
(32) Laboratories, medical, dental, research, experimental,
and Cresting, provided there is no danger from fire or ex-
plosion nor of offensive noise, vibration, smoke, dust,
odors, heat, glare or other objectionable influences.
(33) Light sheet metal products.
(34) Optical lenses.
(35) Packing and crating.
(36) Printing, commercial, including engraving and photo
engraving.
(37) Soldering and welding.
(38) Tool, die and pattern -making.
(39 ) Watches.
(40) Wholesale offices and storerooms with storage.
WHEREAS, Section 32.001 and Special Use Section 32.011,w hich read
as follows, are unclear:
32.001 General: Any use permitted and as regulated in the C-2
District except one and two-family dwellings are not permitted.
32.011 General: Any use which may be allowed as a special use in
time C-2 District, except mobile home parks are not permitted.
NOW THEREFORE, BE IT ORDAINED that Ordinance 2325-1968 commonly known
as the Zoning Ordinance of Richmond, Indiana, be amended.
Section 1: Section 31.005 shall read amended as follows:
31.005 Motor Vehicle Service: Garages, display, hire, sales and
general automobile repair not including major body or fen-
der repairs or the storage or parking of buses subject to
the provisions of Article 44.
Section 2: Section 31.023 (Special Use) shall be added and
read as follows:
31.023 Motor Vehicle Service Stations: Any motor service station
which is determined by the commission to be of the same
genera]- character as the Above principal permitted uses.
Section 3: Section 33.002 shall read amended as follows:
33.002 Wholesale, Motor Vehicle Service excluding Motor Vehicle
Service Stations, Production Fart m Im lement, Miscellaneous:

Section 4: Section 33.014 (Special Use) shall be added and
read as follows:
33.014 Motor Vehicle Service Stations: Any motor service station
which is determined by the Commission to be of the same
general character as the above permitted uses.
Section 5: Section 32.001 shall read amended as follows:
32.001 General: Any use permitted and as regulated in the C-2
District with the following exception: one and two-family
dwellings are not permitted.
Section 6: Section 32.011 (Special Use) shall read amended
as follows:
32.011 General: Any use which may be allowed as a special use in
t-The—L--T District with the following exception: mobile
homes are not permitted.
Section 7. This ordinance shall be in full force and effect from and after
its passage and approval by the Mayor.
PASSED AND ADOPTED by the Common Council of the City of Richmond Indiana,
