AN ORDINANCE AMENDING ORDINANCE NO. 62 AND REPEALING ORDINANCE
NO. 139 OF THE ORDINANCES OF TIFFIN, IOWA, SAID ORDINANCE
ESTABLISHING RATES, CHARGES, AND RULES FOR THE USE AND SERVICE OF
THE MUNICIPAL WATER SYSTEM OF TIFFIN, IOWA.
BE IT ENACTED BY THE CITY COUNCIL OF TIFFIN, IOWA:
Section 1. Purpose. The purpose of this ordinance is to
amend Ordinance No. 62 and repeal Ordinance No. 139 so as to
establish a minimum monthly water rate for each family,
residential dwelling, living unit, business, or building, or any
user of the Municipal Water System of the City of Tiffin, Iowa.

Section 2. Amendment. Section 1 of Ordinance No. 62 and
Ordinance No. 1985-139 of the City of Tiffin Ordinances are
repealed and the following Section I is substituted in lieu
thereof:
Section I . That there shall be and there are
established rates and charges for the use of
the service supplied by the Municipal Water
System of the City of Tiffin, Iowa, to each
residential dwelling, family, living unit,
business, or building located on any premises,
or any user, based upon the water reading
of the amount of water consumed, as follows:
a) First 3 ,000 gallons or lesser amount, for
each family, residential dwelling, living
unit, business, or building, or user, the
minimum monthly fee shall be $9.50
b) All water used over 3,000 gallons per
month shall be charged in increments of 1,000
gallons at $3.00 per 1,000
Section 3. Repealer. All ordinances or parts of
ordinances in conflict with the provisions of this Ordinance are
hereby repealed.
Section 4. Severability. If any section, provision, or
part of this Ordinance shall be adjudged to be invalid or uncon-
stitutional, such adjudication shall not -affect the validity of
the ordinance as a wholeiior any section, provision„. or part
thereof not -adjudged invalid or, unconstitutional .
Section 5. Effective Date. This Ordinance shall be in
effect after its final passage, approval, land posting as provided
by law.

Oh the 10th day of January . , 1990' at a regular
meeting of the Tiffin City Council , Tiffin, Iowa, Councilperson
Brown introduced Ordinance No. ' 164 . , and moved
that it be given its first reading. The motion was seconded by
Councilperson . Bartels
Ayes: Bartels , Brown , .Morgan , Slaymaker , Stoner
Naves: .. . . . . . . . . . . . . .. . . . . . . . .
Five members of the council being present and having voted
"Aye" , Mayor Glenn R. Potter declared Motion carried, and Ordinance
No. 164 was read the first time and discussed and placed on
record. '
Thereupon, it was\moved by Councilperson Morgan
and seconded-by Council°person :y• .•..Stoner

Ayes: Bartels , Brown , Morgan , Slaymaker , Stoner ,.
Nays:
Five members of the council being •present and having voted
"Aye" , Mayor Potter thereupon declared the motion to be carried,
and Ordinance No. 164 was then placed upon its last reading and
was read the last time.
/hereupon, it was moved by Councilperson Bartels
and seconded by Councilperson Brown
that Ordinance No. 164 be placed upon its final passage and '
adopted.
Ayes : Bartels , Brown , Morgan , Slaymaker , Stoner
Nays : .
Five members of the Council being present and having voted
"Aye" , Mayor Potter declared the motion carried, and the Ordinance
passed and adopted.
Whereupon the Mayor declared that Ordinance No. 164 be
adopted and signified his approval of the 'same by fixing his
signature thereto.
