Fiddes, Administrative Assistant SUBJECT: Discussion of Process for Filling Vacant Directorship in Ward 3 by Appointment Background: At the Special Meeting of August 18, 1983, you called an election for December 13 to''fill the vacant directorship in Ward" 3 with the added provision that "if it is allowed by law, the District appoint by appropriate procedures the re- placement, if the election is cancelled." Because of constitutional conflicts, the State Supreme Court cancelled the election scheduled for December 13. You now need to determine the procedure for filling the Ward 3 vacancy by appointment. Discussion: In order to fill the Ward 3 vacancy by appointment, the appointment would have to be made by October 13, 1983 (60 days from Barbara Green's August 14 resignation date) . In that case the following items need your consideration: 1 ) Approval of an application form: Directors Duffy and Hanko were appointed on August 10, 1983 to review the application form that had been used in filling prior vacancies. Accordingly, the application form they are recommending for use is attached for your consideration. 2) Establishing a procedure for filling the vacancy - interviewing of appli- cants: Options you may want to consider include: a) No interviews. b) Public interviews by the full Board (a date or dates will need to be set for these interviews). c) Appointment of a Board committee to review applications. The role of such a committee will need to be defined. 3) Establishing a timetable for filling the vacancy: Government Code Section 1780 requires that a notice of vacancy shall be posted in three or more conspicuous places in the District at least 15 days before the appointment is made. Staff would post the notice from Tuesday, September 20, 1983 through Wednesday, October 4, 1983. Directors Duffy and Hanko have indicated they would also like the Board to discuss whether the appointment process for filling the vacancy in Ward 3 should be limited to individuals who filed nomination papers for the position.
