HomeMy Public PortalAbout1997/01/16 The Regular Meeting of the Mayor and Council of the Borough of Carteret was called to order by Mayor Peter 1. Sica at 7:30 P.M., at the Municipal Court/Police Facility, 230 Roosevelt Avenue, Carteret, New Jersey on Thursday, January 16, 1997. Upon individual roll can vote, the following were noted present: Councilmember Deborah Bialowarczuk John P. DuPont James Failace Jack Fazekas William Feingold Stanley Gutowski " " " " " Also noted present was Borough Attorney Robert A. Hedesh. The meeting was opened with a minute of silent prayer and the pledge of allegiance led by Mayor Peter 1. Sica. The Clerk stated that on January 10, 1997, in full compliance with the Open Public Meetings Act, a notice oftonight's meeting was sent to The Home News & Tribune, The Star Ledger and posted on the bulletin board. Upon MMS&C, by Councilmembers Fazekas and Bialowarczuk and unanimous affirmative vote of the full Council present, the minutes of December 5, 1996 were approved as transcribed and engrossed by the Clerk. ORDINANCE #97-1 was introduced and adopted on First Reading and the Clerk authorized and directed to advertise same for Public Hearing to be held February 6, 1997, upon MMS&C, by Councilmembers Failace and DuPont. Upon individual roll call vote, Councilmembers DuPont, Failace, Fazekas and Gutowski voted in the affirmative for the adoption. Councilmembers Bialowarczuk and Feingold voted no. First Reading ORDINANCE #97-2 "AN ORDINANCE CREATING AND ESTABLISHING A LINE OF AUTHORITY RELATING TO POLICE FUNCTIONS AND DESIGNATING "APPROPRIATE AUTHORITY" Corrments Councilmember Feingold asked why after two years that he's sitting up there, all of a sudden it is determined that a panel is better suited to hear these types of matters than the Mayor. Why did they go along with the Mayor last year and not this year? Mayor Sica stated that it is the Council's prerogative and he can't answer for the Council. Councilmember Gutowski said that he moved for the adoption. He stated his reason at the Agenda Meeting and also two years ago. It is a more fair approach to have a panel listen to it than one person. One person should not be put into that situation no matter who that one person is. Councilmember Feingold asked how three people who have no experience could make better determinations than someone who has almost twenty years of experience. Councilmember Gutowski said that they have to start somewhere, just like he started. Councilmember Feingold added that they will start somewhere at the expense of a Police Officer. ORDINANCE #97-3 ORDINANCE #97-3 was introduced and adopted on First Reading and the Clerk authorized and directed to advertise same for Public Hearing to be held February 6, 1997, upon MMS&C, by Councilmembers Bialowarczuk and Fazekas. Upon individual roll call vote, Councilmembers Bialowarczuk, Failace, Fazekas and Feingold voted in the affirmative. Councilmembers DuPont and Gutowski abstained. First Reading ORDINANCE #97-3 "AN ORDINANCE TO AMEND ORDINANCE #71-3 ESTABLISHING SALARY SCHEDULES AND FIXING THE MANNER OF PAYMENTS OF SALARIES FOR VARIOUS OFFICIALS AND EMPLOYEES OF THE BOROUGH OF CARTERET Corrments Councilmember DuPont said that he wasn't here for this last year, so he will abstain. 2 The Clerk stated that Ordinance #96-33 was introduced and passed upon First Reading at a Regular Meeting of the Borough Council of the Borough ofCarteret held on December 19,1996. It was duly published in The Home News & Tribune on December 24, 1996 with notice that it will be considered for final passage after Public Hearing to be held on January 16, 1997 at approximately 7:30 P.M.. The Ordinance was posted on the bulletin board and copies were made available to the general public and according to law, she read the Ordinance by title. Upon MM S&C, by Councilmembers Gutowski and Failace and unanimous affirmative vote of the full Council present, the Mayor declared the Public Hearing to be open: There being no comments or objections to the Ordinance, the Mayor declared the Public Hearing to be closed upon MMS&C, by Council members Fazekas and Gutowski and unanimous affirmative vote of the full Council present. Councilmember Feingold said that he will look tòrward to working with Mr. Gutowsb and Mr. Fazekas to (inaudible) between themselves and the Board of Education. Mayor Sica said that he'd like to comment on the last three resolutions. He and Mr. Ferguson met many times with the insurance companies to get these kinds of rates. They will probably save $30,000.00, $40,000.00 or $50,000.00 on these insurance premiums right here. When you look at what is happening with insurance in the State of New Jersey, Mr. Ferguson did one heck of a job and paid for his salary just on these negotiations alone. He thought that we had appropriated the money last year, but Patrick DeBlasio said we haven't. We should talk about this. COI1tlUNICATION Borough of tlillto,m The Clerk stated that she was in receipt of a Resolution trom the Borough of Milltown urging repeal and redraft of NJ. SA 40:55D-66.1 & 66.2, Re: Community Residences for Developmentally Disabled. Upon MMS&C, by Councilmembers Bialowarczuk and Fazekas and unanimous affirmative vote of the full Council present, it was ordered to be received and placed on file. REPORTS Departments The Clerk stated that she was in receipt of the following reports: Clerk's Office - December ]996; to Treasurer - $1,036.00 Inspection of Buildings - a) December 1996; Total Estimated Cost of Construction - $418,477.00; To Treasurer - $10,039.00 b) 1996 Fee Revenue Report Office for the Disabled - 1996 Annual Report Upon MMS&C, by Councilmembers Failace and Fazekas and unanimous affirmative vote of the full Council present, all reports were ordered to be received and placed on file. Standing Committees BUILDINGS & GROUNDS: Committee Chairperson Bialowarczuk reported that she would like to get the stairs done this year on the Borough Hall. She is trying to get all of the infornlation she can as to what is going to be needed on the new building. She should have more on it two weeks from now. She reported progress. FINANCE & ADMINISTRATION: Committee Chairperson Failace reported that it is 1997 and the budget process has begun. He spoke with Patrick DeBlasio today and asked the Mayor to call a meeting with the whole Council like they did last year with Department Heads to go over their 1997 budgets so they can meet the February 10, 1997 deadline. He reported progress. 12 JANUARY 16, 1997 FIRE: Committee Chairperson Fazekas reported that they have not had their first Committee Meeting yet this year The Valentine's Day Dance is February 15, 1997. He encouraged everyone to attend. It will be at 7:00 P.M., $20.00 per person or $35.00 per couple. Standing Corrmittees Can't. PARKS & RECREATION: Committee Chairperson Gutowski reported that he met with Mr. Kolibas who just returned !Tom vacation this past weekend. Everything seems to be running very smoothly down the parks. For anyone that is concerned, there is a problem with the cherry picker. They guys are out there dong the best they can with the trees. They do have one estimate on repairing it. Mr Kolibas will see to it that we get another and they'll decide what they're going to do. He said that he is glad that he is in the parks and he is looking forward to this year - POLICE: Committee Chairperson DuPont reported that they had their first Police Committee Meeting on Tuesday. If anyone has read the paper, it got a lot of attention. He was kind of surprised by it, but he found out why. The Police Committee hasn't met in at least three years. One thing they will do is meet at least once a month. The Chief came and it was very informative. He had several things he needed to discuss. It was a good induction for them and they got to know the Chief a little better and the department a little better They will move in the right direction and it is something that they need. He reported the start of progress at this point. PUBLIC WORKS Committee Chairperson Failace reported that there was a small storm last week. The kind that is very dangerous because nobody stays home. The guys got out there and got the roads plowed He drove around with Ted Surick Saturday to look at the roads, salted some of them and sanded some of them because they needed it. He got some calls questioning why the men were sent out because it wasn't that bad, but with the cold it was a good thing they did. He reported progress. MUNICIPAL GARAGE SERVICES: Committee Chairperson Feingold reported that the Police Committee did meet in the past two years. He reported progress. 3 · , JANUARY 16, 1997 t1AYOR The Mayor made the following appointments: a) Air Pollution: GEORGE MALEK b) Planning Board Class 4: JOHN VESEY 12/31/00 12/3 ]/99 Mayor Sica reported that he received a letter ftom the Church on Essex Street. That church is really old and in bad shape. The minister, Mr. Hoffman, has requested a piece of Borough property on Warren or Mercer Streets, which is adequate to build a new church. He wants us to look into perhaps leasing the property to that church for $1.00 per year for the next 100 years. Similar to what we did on Essex Street and the possibility of either buying or swapping a piece ofland on Essex Street and tear that church down and use it for housing for the poor people or whatever. He said that he would bring it up at the Council Meeting. So, at the next Agenda Meeting he wants to discuss it. It's a good idea. Councilmember Failace stated.....(inaudible)... .Union Street. The Mayor said that it is a great idea. The new minister seems to be one heck of a guy and they want to really be involved in the community. They will have a computer type program for kids down there to learn computers. The city should do anything it can to help them to expedite getting a new church because that old church is actually falling apart. It's time that they did get a piece of property that they can continue to grow on. PUBLIC DISCUSSION Upon MMS&C, by Councilmembers Gutowski and Failace and unanimous affirmative vote of the full Council present, the meeting was opened to the public. Board of Education/ Council Liaison Committee PAT TOZZI referred to Resolution #97-24, the Board of Education/Council Liaison Committee and asked what it will accomplish? Councilmember Gutowski said that he feels that there needs to be a line of communication between the Board of Education and the Council. For whatever reason, it hasn't been done in the past. We are working towards one goal which is our community and our kids. It's also the same tax dollar. It all comes out of the same pot. NIr. Tozzi asked what the committee would be able to do. 14 -----~-. JANUARY 16, 1997 Mayor Sica said that last year he asked on numerous occasions for the Board of Education to meet with the Council so that they could discuss things even prior to the building of the schools, so that we could discuss things and see what direction the Board of Education is moving in. Unfortunately, all of those letters and overtures that we made to the Board of Education last year fell on deaf ears. He thinks the concept of it is good. What can be accomplished with that is perhaps jointly sharing in the schools. For instance, the High School uses Sullivan Field to play baseball, soccer, to practice and have gym. Perhaps because we're being good there, maybe they'll open up schools for us to use for recreational programs not only for the kids but for Seniors or various things. We've all heard about the work they've done on the schools so far is like putting a band-aid on a bullet wound. It's not finished. Even though we've built some new schools and added some additions and tore some schools down, there's other work that is going to have to be done on those schools. Unless the Borough of Carteret and the Mayor and Council who's in charge of the dollars in the long run, sit down and do a conservative effort and some real constructive planning, they'll have the same problems they've had for the past 100 years this town's been in existence. Nobody looks to the future. He thinks that if the committee is going to look at it in that aspect, then he thinks the committee will be a good thing. Board of Education/ Council Liaison Corrmittee Can't. Pat Tozzi asked who represents the citizens? This is between two people of the same color, the Council and the School Board. If a budget is voted down, okay, then it comes to the Council for approval. The committee will be buddy-buddy with the School Board and before you know it, it won't be looked at in a way to save monies or cut down taxes. He said that personally he thinks it is a waste. If anybody should get involved, you should have outside people also on that committee to represent the people of Carteret. Mayor Sica said that #1, the Committee can meet, talk, do anything they want. They don't have the power to spend 5¢. They don't have the power to commit anything to the School Board. It is just an informative body to try to move things in the right direction for the future of CaIteret. They--- don't have the right to spend money. The committee is specifically told, not only by our legal representative, but by the School Board's legal representaÜve, that they cannot discuss budget matters. Mr. Tozzi noted that those are the things that should be included in these meetings. The Mayor stated that the ultimate decisions with anybody with the Board of Education or the City of Carteret, ultimately will result in the spending of money or the planning of spending of money. Ifwe have more heads looking into the future of spending it in a constructive manner, than at that point in time, he doesn't think there is anything wrong with it. ) Mr. Tozzi said it is not only spending, but savings. The Mayor said that he doesn't see anything other than construction coming out of it. If it becomes divisive, he'll be the first one to speak out against it. If it becomes divisive, the committee that is representing the Council on it will speak out against it. JANUARY 16, 1997 Board of Education/ Council Liaison Corrmit tee Con't. SOPHIE CHEREPON said that she agrees with Mr. Tozzi. The people voted down the bond for the schools. Yes, there was work that had to be done. What did the Board of Education do? They by-passed our rights and by- passed the citizens and signed the lease purchase. All ofthese committees and boards and Councils, Board of Education members.....it's a lot of hot air. Mayor Sica said that he may agree with some of the things she says, but on this one he is in total disagreement with her. If we don't have constructive and informative meetings, we can't plan the future of Carteret. If we don't start planning what is good for the City ofCarteret tomorrow and next year and ten years down the road, then we're going to continue to lose the total evaluation of the City. Every year the city evaluations go down. We add new industries and buildings, build new projects, people build additions to their homes, but the total value of the City of Carteret continues to decline. Why? Because we had one of the worst planned operating school systems in the county as far as he is concerned. The schools were deplorable. If we don't do things to increase those values then the values of the houses are going to continue to decline. If the value of house continue to decline, the taxes are going to continue to rise to meet the decline of the values of the houses. Unless we have some constructive planning by the schools and by the city jointly, this town is doomed.
