Ordinance No. 1990-168

FLOOD PLAIN DEVELOPMENT ORDINANCE
BE IT ENACTED BY THE CITY COUNCIL OF THE CITY OF TIFFIN, IOWA:
SECTION I - PURPOSE
The purpose of this Ordinance is to further define and
effectuate the purposes and requirements regarding the Tiffin
Flood Plain set out in Ordinance No. 1990-167 "Flood Plain
Management Ordinance" and further, to supplement and clarify the
requirements of the Flood Plain Management Ordinance with the
provisions of Ordinance No. 1987-145 "An Ordinance Adopting the
C.A.B.O. One and Two Family Dwelling Code, etc. for Tiffin, Iowa. "
SECTION II - DEFINITIONS
All definitions set forth in Ordinance No. 1990-167 "Flood
Plain Management Ordinance" and in Ordinance No. 1987-145 "An
Ordinance Adopting the C.A.B.O. One and Two Family Dwelling Code,
etc. for Tiffin, Iowa" are hereby incorporated into this Ordinance.
SECTION III - PERMIT REQUIRED
All development in the Tiffin Flood Plain as described in
Ordinance No. 1990-167 shall require a permit to be issued by the
City of Tiffin. The permit shall meet the requirements as set
forth in Ordinance No. 1990-167 "Flood Plain Management
Ordinance" . The permit shall be applied for by the owner of the real
property upon which the proposed development is to be located.
SECTION .IV -. FEES FOR PERMIT°
The fee for a flood plain development permit shall be
$ E.35. O0 .
However, if, inYaddition to the flood plain
development permit, an applicant _must also obtain a building
permit pursuant to the provisions of Ordinance No. 1987-145 and
147 , then the applicant shall pay only the greater of either the
flood plain development permit fee dr the building permit fee.
If multiple," simultaneous developments at the same location
are proposed, only one fee for the flood plain development
application or building permit shall be required so long as all
of the developments may be inspected during one trip to the
proposed development site.

IT'DELEGATION OF DUTIES `

The Flood Plain D � .eVelopment -Adrrministrator (the Mayor) may
delegate his inspection duties set forth in Ordinance No. 1990-
167 to the City of Tiffin Building Inspector or the City' s Engineer.

SECTION VI - REPEALER
All ordinances or parts of ordinances in conflict with the
provisions of this Ordinance are hereby repealed.
SECTION VII- - SEVERABILITY
If any section, provision, or part of this Ordinance shall
be adjudged to be invalid or unconstitutional , such adjudication
shall not affect the validity of the ordinance as a whole, or any
section, provision, or part thereof not adjudged invalid or '
unconstitutional .
SECTION VIII - EFFECTIVE DATE-
This. Ordinance shall be in effect after its final passage,
approval , and posting as provided by law.
On the 11th , day of July , 1990 at a regular
meeting of the Tiffin City Council , Tiffin, Iowa, Councilperson
Brown introduced Ordinance No. 168 , and
moved that it be ,given its first reading. The motion was
seconded by Councilperson Slaymaker
Ayes : Bartels , Brown , Morgan, Slaymaker, Stoner
Nayes : none
Five members of the council being present and having voted
"Aye" , Mayor Glenn R. Potter declared Motion carried, and
Ordinance No. 168 was read the first time and discussed and
placed on record.
Thereupon, it was moved by Councilperson
Morgan and seconded by Councilperson
Brown that the laws and rules
providing, that ordinances be considered and voted on for passage,
at two council meetings prior to the meeting at which it is to be
finally passed (e)suspended and dispensed with and that Ordinance
No. 168 be placed on its last reading.
Ayes : Bartels , Brown , Morgan , Slaymaker, Stoner
Nayes : none
Five members Of- the council being present and having voted
"Aye" , Mayor Potter -thereupon declared the motion to be carried,
and Ordinance Noi 168 was then placed upon its last reading and
was read the last time.

Thereupon, it was moved by Councilperson
Brown f and seconded by CouncilpersOn
Slaymaker that Ordinance No. 168 be placed upon
its final passage and adopted.
Ayes : Bartels , Brown , Morgan , Slaymaker , Stoner
Nayes: noner
Five members of the Council being present and having+ voted
"Aye" , Mayor Potter• declar1ed the motion= carried, and the
Ordinance passed and adopted.
Whereupon the Mayor declared that Ordinance No. 168 be
adopted and signified his approval of the same by fixing his
signature thereto.
Passed by the Council on the 11th day of July
1990 and approved by the Mayor on the 11th day of
July , 1990 .
