Be it Ordainediby the Common Council of the City of Richmond, Indiana; that: SECTICN 1. Section One (1) of Ordinance No. 2330-1968, The Human Relations Ordinance as Authorized by the General Assembly of the State of Indiana, Acts of 1967, C hapter 276, Section 4, as Amended, Be Amended to Read as follows: SECTION-4 PURPOSE AND COVERAGE The promotion of equal opportunity without regard to race, religion, sex, color, national origin or -ancestry, through reasonable methods that do not create that which it seeks to enjoin is the purpose of this ordinance. It is also its purpose to protect employers, labor organizations, employ- ment agencies, property owners, real estate brokers, builders and lending institutions and educational institutions from unfounded charges of dis- crimination. It is the public policy of the City of Richmond to eliminate segregation or separation based solely on race, color, sex, religion, national origin or ancestry, since such segregation is an impediment to equal opportunity. Equal educational and employment opportunities and equal access to and use of public accommodations and equal opportunity for acquisition of real property, to the extent that remedies for the prevention of their denial are herein provided, are hereby declared to be civil rights. The denial of these rights to properly qualified persons by reason of the race, religion, sex, color, national origin or ancestry of such persons is hereby declared to be an unlawful discriminatory practice. SECTION 2. Section Three (3) of said Ordinance No. 2330-1968, be amended to read as follows: SECTION 3. COMMISSION CREATED -MEMBERSHIP - TERMS There is hereby created a Human Relations Commission composed of nine (9) members serving without compensation, and broadly representative of the' racial, ethnic, political, religious, economic and educational groups in the community. They shall be appointed by the Mayor with the advise and consent of the City Council within sixty (60) days from the date of passage of this Ordinance. Of the nine members first appointed, three shall be appointed for one year, three for two years, and three for three years. Thereafter each appointment shall be for a term of three years. If a member dies or resigns, his successor shall be appointed to serve for the unexpired period of the term for which the member had been appointed. The Mayor, with the consent of the City Council, may remove Commission members for cause but for no other reason. The Commission shall elect from its mem- bership at its first meeting and thereafter at its April meeting a chair- man, vice-chairman and secretary. The Commission shall meet once each month and may hold special meetings as the Chairman deems necessary. The first meeting of the Commission shall be held within thirty (30)days after the appointment of the nine members pursuant to this ordinance. On December 31, 1972, all positions will be vacated so that nine members may be appointed. SECPICN 3. The following section shall be added to the said Ordinance 'Na . 2330- 1968, said section to read as follows: SECTION 5. CITY CONTRACTS: CONTRACTORS Every contract to which the city or airy of its political or civil sub- divisions is a party, including f,Tanchises granted to the public util- ities, shall contain a provision requiring the contractor and his sub-con- tractors not to discriminate against any employee or applicant for employment who is to be employed in the performance of such contract with respect to his hire, tenure, terms, conditions or privileges of employment of any matter directly or indirectly related to employment, because of his race, relgion, color, sex, national origin or ancestry. Breach of this provision may be considered a ma- terial breach of the contract.
