HomeMy Public PortalAbout96-005 (01-08-96)RESOLUTION NO. 96 -5 A RESOLUTION OF THE LYNWOOD CITY COUNCIL SUPPORTING THE EFFORTS OF THE COMPTON UNIFIED SCHOOL DISTRICT BOARD MEMBERS TO REGAIN CONTROL OF THE COMPTON UNIFIED SCHOOL DISTRICT FROM STATE CONTROL ' WHEREAS, it is a fundamental right of a community to participate in the electoral process that governs the offices of that community's educational system, and WHEREAS, it is also a fundamental right of a community to have its duly elected representatives participate in the decision making process with regard to its educational system, and WHEREAS, if the State or Federal Government finds that it is important and necessary to intercede in the affairs of School District Governance for purposes of preserving the right to educational opportunity for its students, such a move should also contemplate the expeditious return of any such district to the people of the School District in question within the shortest possible time, and WHEREAS, said return of District Control to the community through its duly elected representatives should not be based on arbitrary and capricious standards set by the State, and WHEREAS, said return of District Control should be based on realistic and achievable standards that don't constitute a threat to viable academic programming, ' and WHEREAS, the State has taken total control of the Compton Unified School District and said standard for return to the people of the greater Compton Community appear to be unfair, arbitrary, capricious, unrealistic and detrimental to the educational process, and WHEREAS, in an effort to regain control of the Compton Unified School District, members of the Compton School Board are considering filing a lawsuit against the State to eliminate State control of the Compton Unified School District, and WHEREAS, the Compton School Board voted December 27, 1995 to hire an attorney to file lawsuits in State and Federal Courts to challenge the legality of the 1993 State takeover of the Compton Unified School District, and WHEREAS, the lawsuit is an action that has been taken by several board members acting as individuals and not as the District's Advisory Board of Trustees, and WHEREAS, the Compton School Board has indicated that they need to stand up for the rights of the people of the community who deserve to have elected representatives with a voice. NOW, THEREFORE, the City Council of the City of Lynwood does find, order, proclaim and resolve as follows: Section 1. The City of Lynwood hereby support the efforts of the Citizens of the greater Compton Community and their duly elected representative to regain control of their school district. Section 2. That the City of Lynwood urges the State and legislature to set fair, realistic and unbiased standards for the return of said school district to the people. Section 3. That a certified copy of this resolution be forwarded to Governor Pete Wilson. Section 4. That a certified copy of this resolution be forwarded to Lieutenant Governor Gray Davis, President of the Senate. Section 5. That a certified copy of this resolution be forwarded to the Speaker of the State Assembly. Section 6. That a certified copy of this resolution be forwarded to Senator Ralph Dills and Senator Teresa Hughes. Section 7. That a certified copy of this resolution be forwarded to Assemblyman Willard H. Murray, Jr. and Assemblywoman Juanita McDonald. Section 8. That a certified copy of this resolution be forwarded to the Lynwood Unified School District. Section 9. That a certified copy of this resolution be forwarded to the Compton College Board of Trustees. Section 10. That a certified copy of this resolution be forwarded to the Compton Unified School District. Section 11. That a certified copy of this resolution be forwarded to the State Superintendent of Public Instruction. Section 12. That a certified copy of this resolution be forwarded to the Paramount City Council. Section 13. That a certified copy of this resolution be forwarded to the L.A. County Board of Supervisors. Section 14. That a certified copy of this resolution be forwarded to the Los Angeles School Board of Education. Section 15. That a certified copy of this resolution be forwarded to all members of the State Senate and the State Assembly. Section 16. This resolution takes effect immediately upon its adoption.
