ORDINANCE
AN ORDINANCE AMENDING THE ZONING ORDINANCE MUNICIPAL
CODE OF TIFFIN, IOWA BY CHANGING THE USE REGULATION OF CERTAIN PROPERTY
FROM R-1 (SINGLE-FAMILY RESIDENTIAL) TO R-3 (MULTI-FAMILY RESIDENTIAL)
BE IT ENACTED BY THE CITY COUNCIL OF TIFFIN, IOWA:
SECTION I. Purpose, The purpose of this Ordinance is to amend the
present City of Tiffin Ordinance N . 197 81 by changing the use
classificationof the real estate described in Section II from R-1
,(single-family reSidentia ) to R-3 (multi-family residential).
SECTION II. ,Amendment. The parcel of land hereinafter described
shall be zonedas follows:

Commencing at 'a point on the North Line of the Marengo Road in the
Southeast Quarter Sectio 28, Township 80 North, Range 7 West of the .
5th P.M. , at the 'Southe At corner cdf. the public school grounds in
Tiffin, Johnson County, Iowa; thence s utheasterly along the north line
of the MarengP Road 76./18 feet to the point of beginning; thence
continuing southeesterly along the north line of the Marengo Road 89
feet; thence north 135 feet; '
thence west 89 feet; thence south 135 feet
to the place of beginning': subject to driveway easement over the west
15 feet thereof for the 'purposes of ingress and egress to Vendor's
remaining property. / '

SECTION TII. Authorization� . The Maybr or other designee of the
City Council is hereby authorized and '|direct d to change to Zoning Map
of the City of Tffin, Iowa, which was duly recorded in Book 19, page 53,
of the Records of ,Johnsori County, Iola, to conform to this amendment
upon the final passage, approval and publiCatimo of the ordinance as
required by law. `

SECTION IV. Certification. The Ctiy Clerk] is hereby authorized and
directed to certify a copy, of this Ordinance, to the Recorder of Janson
County, Iowa, upon,-final passage as provided by law.

SECTION V. Repealer. All ordinances, or parts of ordinances, in
conflict with the provisions of this ordinance are hereby repealed.
SECTION VI. Severability. If any section, provision or part of
this ordinance shall be adjudged invalid or unconstitutional, such
adjudication shall 'not affect the ordinance as a whole, or any section,
provision or part thereof 'not adjudged invalid or unconstitutional.

SECTION VII. When Effective. This ordinance shall be in effect
after its final passage, approval and publication as provided by law.
Councilman 'Stoner, introduced the foregoing ordinance which
was then duly read and considered by the Council. Its adoption was
moved by Councilman Stoner and seconded by CourncilmanSlaymaker,
On roll call vote Councilman' Stoner, Slaymaker, Morgan , Brown ,
Bartels I t voted "Aye".
Councilman - ' I voted "Nay". Mayor declared motion
carried.
Councilman Brown then moved that the rule or law requiring
three readings of 'this ordinance on three different dates be dispensed
with. Seconded by Councilman Bartels On roll call vote

Councilman voted "Nay".
Councilman Stoner then moved for final adoption of this
ordinance, seconded by Co'.incilman Brown . On roll call vote
Councilman Stoner , S,laymaker , Morgan , Brown , Bartels
voted "Aye. "
Councilman I voted "Nay. "
The Mayor then declared Ordinance No. 1990-169 duly passed and
adopted on this 12th day of September, 1990.
